Thomas H. Durham } between John P. Burns of the Coun
ty of Crockett and State of Tenn-
essee of the one part and Thomas H. Durham of
the Said County & State aforesaid of the other part
Witnesseth, that the Said John P. Burns for and in
Consideration of the Sum of One Hundred and twen
ty five dollars, to him in hand paid by note of
this date, due the 25th day of Decr. Next, the receipt
Whereof is hereby acknowledged hath this day bargained,
Sold, aliened, and by these presents doth bargain
Sell, and Convey, unto the Said Thomas H. Durham
his heirs and assigns forever, a certain piece
or Lot of Land, Situated lying and being
in the Said County & State aforesaid and
in the Town of Alamo North West of the
Square North of Elm Street, and taken from
the South East Corner of Said J. P. Burns tract
Butted and bounded as follows, to Wit: Beginning
at a Stake in the Center of Said Elm Street and
on the West boundary line of Pamelia Rhoads. Runs
North with Said Pamelia Rhoads West boundary line
Thirteen and three fourths poles (13 ¾) to a Stake in
Said line. Thence West Eleven poles and fifteen
links to a Stake Thence South Thirteen and three
fourth (13 ¾) poles to a Stake the Center of Said
Elm Street With 2 White oak pointers Thence East
Eleven poles 15 Links to the beginning Containing
by estimation One Acre, together With all and
Singular the hereditaments and appertenances
thereunto belonging or in any Wise appertaining
to the only proper use, benefit and behoof of
him the Said Thomas H. Durham his heirs &c.; and
the Said John P. Burns doth agree and bind him-
self his heirs &c; to Warrant and Will forever defend
the right, title claim and enterest in and to
the said lot of land and bargained premise
to him the said T. H. Durham his heirs &c;
against the lawful claim or claims of any
and all persons Whatsoever. I Witness Whereof

this the 24th day of October, A.D. One
To Deed } thousand and Eight hundred and seventy three,
between Henry M. Klyce and wife Rebecca Klyce of the county
T. H. Durham } of Crockett and state of Tennessee, of
the one part, and Thomas H. Durham
of the said county & state aforesaid of the other part.
Witnesseth that the said H. M. Klyce and Rebecca
Klyce for and in consideration of the sum of five
hundred dollars to them in hand paid or secured
to be paid by notes, The receipt whereof is hereby
acknowledged, hath this day bargained, sold,
aliened, and by these presents, doth bargain,
sell, and convey unto the said Thomas M.
Durham, his heirs, and assigns forever, a certain
piece, or lot of land, Situated lying and being
in said county, and state aforesaid, and in the
town of Alamo, West of Bells, street, and north
of Vine street, Beginning at a stake on the
north margin of Vine street, B. Tyu’s south
west corner, runs west with Vine twelve and
three fourth (12 ¾) poles to a stake thence north

thirty one & one half (31 ½) poles to a stake on cedar street,
Thence East with cedar 12 ¾ poles to a stake in said Tyu’s
Wesr B. line thence south 31 ½ poles to the beginning, contain-
-ing by estimation two and one half acres, more or less, together
with all and singular the hereditamants, and appurtenances
thereunto belonging, or in any wise appertaining, to the only
proper use benefit, and behoof of him the said T. H.
Durham, his heirs and assigns, and the said H. M. Klyce
and his wife Rebecca Klyce, doth further covenant, agree
and bind themselves their heirs &c.; to warrant and will forever
defend, the to the said T. H. Durham his heirs &c.; the right, title,
claim and interest in and to the above described lot of land,
and bargained premise, to him his heirs &c; against the
claim or claims of any and all persons whatsoever.

an express lien is retained to secure the
full payment of the purchase money.

J. P. Burns, and B. J. Lea Know all men by these
presents that I. J. P Burns
To Deed in my individual capasity,
Durham and Klyce and also as Attorney in fact
Town lot for B. J. Lea have this day
In Alamo. bargained and Sold and do
$480. hereby transfer and convey to
T. H. Durham and J. M. Klyce a
certain house and lot in Alamo Crockett, Co, Tennessee,
known as lot No 3 of Said town bounded as follows
Commencing at the North East corner of lot No 2 of
Said town. runs East 24 feet thense South Eighty five
feet thense west 24 feet thense North 85 feet to the
beginning To have and to hold to the Said T. H. Durham
& J. M. Klyce forever we do hereby covenant that we are
lawfuly possessed of Said property and have a perfect
right to convey the Same give that it is unincumbered.
The Said Durham and Klyce to hold Said property
as follows to wit the lot to go to them in equil parts
forever but the use of the upper story of the building to
be for the Sole benefit of Said Klyce and of the lower
Story for the benefit of Said Durham while Said build=
ing Stands on Said lot In consideration of which Said
Durham & Klyce have paid us One hundred Dollars cash
in hands and have Executed their notes for one hundred Dollars
due the 15th day of Nov, 1878 one note for two hundred
Dollars due the 1st day of February 1879 and have also
deeded to J. P. Burns one lot in the town of Alamo

lowing contract & agreement to wit: While the
ownership of said property remains in J, W,
Murchison and if no conveyance of any
Kind is made by him of sd property nor Pro-
ceedings of any Kind had which would deprive
him of the ownership of said property then
the lien herein contracted for shall not be
enforced on any of said Notes until four
(4) years after, the note, on which said lien
matured, But if the title of said property and
full right and ownership of said property in
any way passes from said Murchison
by deed or otherwise as before stated then the
lien herein contracted for may be enforced
on the maturity of said notes, and said lien
is subject to this further restriction, that it is re-
tained for the benefit of said T. H. Durham
his executors or administrators and shall be
forever last if said Notes are assigned or
transfered by said T, H, Durham,

that I there is never to be erecten on this lot any kind building except a brick or
concrete building closer than Fifty Six (56) feet to the building of the Bank of Alamo
or the other buildings now on said row with the Bank building, and this clause in this
conveyance is to be perpetuate, and in any conveyance that may be made of this property
by the said J.T.Jennnings will be subject to this restricting clause.And the said J.T.
Jennings is also to keep the buildings on this lot or parcel of land insured for the
benefit of the holder of the unpaid purchase money notes.And to secure and make sure
the payment of the defered payments or unpaid purchase money notes herein above descr
ibed, a special lien is hereby expressly reserved and retained on the lot or parcel
of land herein conveyed untill said two unpaid.purchased money notes or defered payment

To have and to hold the said tract or parcial of land , with the appurtenances ,estate , title ,
and interest thereto belonging ,to the said W.N. Nolen , J.P. Nolen , and L.N. Nolen their
heirs and assigns , forever . And I do covenant with th e said J.P. Nolen , W.N. Nolen and
L.N. Nolen that I am lawfully seized and possessed of said land in fee simple ; have a good right
to convey it , and the same is unencumbered .
And I do futher covenant and bind myself and my heirs and representatives , to warrant and
forever defend the title to said land to the said J.P. Nolen , L.N. Nolen and W.N.Nolen
their heirs and assigns , against the lawful claims of all persons whomsoever .
