Don Carlos and Badgett Family Deeds: 1795-1829

Transcriptions prepared by the Don Carlos Family DNA Project

NOTE: Samuel, James and Burwell F. Badgett are brothers. Their father, James sr. is also named in one deed.  Elizabeth “Betsey” Don Carlos is their sister, married to Robert Cole Don Carlos and separated/widowed from him around 1821. Carter Morgan Don Carlos is the son of Elizabeth and Robert (variously recorded as Carter M Carlase/Doncarlas); Carter would have just reached legal age in 1823.  William Carter Carlos and Robert Cole Don Carlos are brothers, sons of Archelaus Carlos and Fanny Carter (William is variously recorded as William C. Carlos/Carlas/Carles).


Nicolas Bartlett to James Badgett (see images – part 1 and part 2)
Indenture 9 June 1813
Registered 5 December 1814

Indenture 9 June 1813 between Nicholas Bartlett of Knox Co Tennessee and James Badgett of Blount Co, Tennessee.  Sale of 207 and 3/4 acres in consideration of $2,000.  Tract of land situated in Blount Co in the District South of French Broad and Holston rivers on Stock Creek and Little River.  [Stock Creek is a tributary of Little River.]  Boundaries mentioned … corner to James and Robert Price … including spring on bank of Stock Creek and south side below the grist mill of Nicholas Bartlett.  This tract of land being the same tract granted Nicholas Bartlett by the State of Tennessee by patent bearing date of 5 October 1808 No. 272. …

Proven in open court by Robt C Don Carlos and Bural F Badgett and ordered to be registered 4th October 1814. Registered 5 December 1814.

Registered 5 December 1814

Indenture 12 September 1814 between Jesse Kerr of Blount co and Samuel Badgett of same.  Sale of 106 acres and six pole in consideration of $600 for a parcel lying on the West side of Little River … boundaries ….corner to Bromley then with the line of John Sing [Singalton?] …then with the line of  Don Carlos that he purchased of Bromley.

September Term 1814 there was execution of the written deed of conveyance from Jesse KERR to James Badgett proven in open court by Robert Don Carlos and Barwell Badgett two of subscribing witnesses … ordered to be registered 7 October 1814.  Registered 5 December 1814.

Robert Doncarlos to Samuel Badgett (see images – part 1 and part 2)
Indenture 24 February 1817
Registered 15 May 1817

Indenture made 24 February 1817 between Robert Don Carlas of the county of Blount and State of Tennessee and Samuel Badgett of the county and state aforementioned.  Doncarlas in consideration of $500 to him in hand paid by Badgett…confirm onto said Badgett, his heirs and assigns forever a certain tract of land lying in the county and state in the District South of French Broad and Holston rivers on the West bank of Little River … beginning on the West Bank of Little River at Samuel Badgett’s corner running from there up the river to a walnut at Jacob Tipton’s corner from there on the dividing line between Doncarlas and J. Tipton to a jack tree near Tipton’s house to a pine marked by William Tipton on south west corner to Major John Singalton to the above Badgett line then running with the said Samuel Badgett lines to an oak on the bank of Little River being the beginning.  Containing 40 acres more or less. Same tract of land purchased by Don Carlos from Barney Bromley.

   Witness: Burwell Badgett, James Badgett.  Robert Don Carlos (seal).  March Session 1817 Deed of conveyance acknowledged in open court and admitted to record and be registered on 15 May 1917.

James Green to Robert C. Don Carlas (See images – part 1 and part 2)
Indenture 25 March 1817
Registered 1 March 1819

This indenture made and entered into this 25th day of March 1817 between James I Green of the County of Blount and State of Tennessee of the one part and Robert C Doncarlas of the same place as the other part witnessed thereafter and in consideration of the sum of $600 dollars to him in hand paid the receipt whereas is hereby acknowledged the said James I Green hath executed and sold unto the said Doncarlas his heirs and assigns one certain tract of land situated in the county aforesaid on the Littal [Little] Tennessee River adjoining the lands of Richard Dearmond, James Hall and Wyley Luseter containing by estimation one hundred acres and thirty poles and by the survey more or less and bounded as follows ….To have and to hold the said tract of land with all and singular its appurtenances unto the said Doncarlas his heirs and assigns . And the said James I Green from himself his heirs he doth warrant and defend the right clause and interest of the said tract of land with its appurtenances to the said Doncarlas his heirs and assigns against the claim or claims and every person or persons. ….

  Witnesses: acknowledged in presence of Sauz [?] Burnett and John McCroskey. James I Green (seal).

State of Tennessee.  I Jacob F Faute Clerk of the Court of Pleas and Quarter Sessions for Blount County do certify that at the December Sessions 1818 of said court the execution of the written deed of conveyance was duly acknowledged in open court and directed to record and ordered to be registered.  (seal) Given under my hand and seal of office at Offices in Maryville the 26th day of January 1819.  J. F Faute Test.  Registered the 1rst day of March 1819.

Michael Switzer to James Crews Jr (See images – part 1, part 2, and part 3)
Indenture 16 January 1819
Registered 14 April 1819

Indenture made and agreed to 16 January 1819. Sale of 85 acres by Michael Switzer of Blount Co to James Crews Jr of Knox Co TN in consideration of sum of $250.  Tract or parcel lying in the District South of French Broad and Holston rivers on the waters of Little River bounded as follows  … beginning corner of Robert Childress and Nathanial Watson … containing 85 acres one rod … Written signed and sealed in the presence of:

   WitnessWilliam C. Carles, Robert Lowe, Michael Switzer (his mark).

I Jacob F Faute, Clerk of the Court of Pleas and Quarter Sessions of Blount Co do certify that at the March Session 1819 of said Court the execution of the written deed of conveyance was duly acknowledged in open court admitted to record and ordered to be registered.  Seal given under my hand and seal of office at offices in Maryville the 14th day of April 1819.

Wyley Luseter to Robert C Doncarlos (See image)
Indenture 23 November 1818
Registered 24 April 1819

Indenture of 23 November 1818 between Wyley Luseter of Blount County, State of Tennessee and Robert C Doncarlos of the same, witnessed that the said Wyley Luseter this day has bargained and sold and does by these present…in consideration of the sum of $610 dollars currency of the United States….and confirm onto the said Robert C Doncarlos a certain tract or parcel of land situated in the county aforesaid on the south side of Tennessee [Little Tennessee ?] river in the Bend [?] commonly known as Noa [?] containing by survey 89 and one fourth acres… bounded as follows: beginning at a black oak sapling corner with James I Green …thence to a hickory on the river…including the meanders of the river…to the beginning …To have and to hold the said tract or parcel…

At March session 1819 of the Court of Pleas and Quarter Sessions for Blount County the Clerk of the county certified that the execution of the written conveyance was duly acknowledged in open court admitted to record and ordered to be registered …under hand and seal of office at Maryville the14 day of April 1819. Jac F Faute, Test.  Registered the 24th day of April 1819.

Charles Donahoo, Sheriff to James Badgett (See images – part 1 and part 2)
Receipt of funds acknowledged 12 September 1818 

Know all men by these presents that I Charles Donahoo, Sheriff of Blount County and State of Tennessee by virtue of my office and by virtue of two orders of sale _______on two judgements which was obtained by Nicholas Hern and Henderson & Lowery against Robert C. Doncarlos did on the twentieth day of September 1818 at the Court  house in Maryville set up and offered for sale a certain tract of land lying and being in said county of Blount on the waters of Tennessee River containing acres [number not specified] which James Badgett offered and ___[best] the sum of $34 dollars which was the highest offer made for said land. Now know ye that I Charles Denahoo, Sheriff, as aforesaid in consequence of said land it being the highest and least bid made for said land do by virtue of my office and by virtue of the orders of sale aforesaid convey to the said James Badgett and his heirs from all the right total claims of the said Robert C Doncarlas his in and to the said land with the appurtenances hereby acknowledge the receipt of the aforesaid money paid.  Given under my hand and seal Sept 12, 1818: Charles Donahoo (seal), Sheriff of Blount County.  No witnesses. [Note:  the payment date of Sept 12 is BEFORE the 20 Sept judgement date}

Charles Denahoo, Sheriff to James Badgett (See image)
Receipt of funds acknowledged 13 March 1819

This indenture made the 13th day of March 1819 between Charles Denahoo, Sheriff and James Badgett witnessed whereas an order of sale issued from county court house of said county [not named] commanding me to expose [?] to sale a certain tract of land taken as the property of Robert Doncarlas lying on Tennessee River in said county of Blount which order of sale is based [?] on a judgement obtained by James I Green against Robert C Doncarlos on the 10th day of March 1819 at the Court house in Maryville after given due notice and set up and offer for sale the said tract of land as heretofore mentioned containing 90 acres when James Badgett offered and bid the sum of thirty dollars which was the highest bid made for said land. Now know ye that I, Charles Denehoo, Sheriff as aforesaid in consequence of said bid it being the highest and least bid made for said land do by virtue of my office and by virtue of the said order of sale as aforesaid convey to James Badgett and his heirs from all the right title claim of them the said Robert C Doncarlas his heirs has of us [?] to said land with the appurtenances thereto and hereby acknowledged the receipt of the aforesaid sum of money given under my hand and seal March 1819 [no day given],  Charles Denahoo, Sheriff (seal).

James Badgett to Betsey Doncarloss (See image)
Indenture 8 July 1823
No Registration date noted

Indenture made and entered into the 8th day of July 1823 between James Badgett junr of the County of Blount, State of Tennessee of the one part and Betsey Doncarlas of the same place of the other part….  In consideration of the sum of $600 James Badgett has granted and sold Betsey Don Carlos ..  a certain tract of land situated in the county aforementioned on the Little Tennessee River adjoining the lands of Samuel Johnston and James Hall containing 100 acres and thirty two poles …

[Note:  James Badgett is identified as “junior” making him Betsey’s brother– not her father who is also named James.]

Registered 24 December 1824

Indenture made and entered into this 8th day of July 1823 between James Badgett Sen [Betsey’s father] of the County of Blount, State of Tennessee .. and Betsey Don Carlos of the same place….  In consideration of the sum of $610 James Badgett granted and sold to Betsey Don Carlos a tract of land in the same county on the Little Tennessee River adjoining the lands of Robert Wear and James Hall containing by estimation 89 ½ acres and one rod … land formerly owned by James I Green…..  All rights to Betsey Don Carlos her heirs and assigns …

   Witnesses: Carter M. Carlas, Samuel Badgett, William C. Carlas.   James Badgett (seal)

State of Tennessee.  I Jacob F Faute, Clerk of the Court of Pleas and Quarter Sessions of Blount Co do certify that at the September Session 1824 of said Court the written deed of conveyance was duly proven in open court admitted to record and ordered to be certified for registration.  Given under my hand at offices in Maryville this 13th day of Dec 1824.  Registered 24 Dec 1824.

Nemus Crawde to Carter Doncarlas (See image)
Indenture 10 January 1826
Registered 12 February 1829

I Nemus Crawde of the County of Blount and State of Tennessee for and in consideration of the sum of five hundred dollars have bargained and sold and delivered onto Carter Doncarlos of the county and state aforementioned a Negro girl named Mary about five years of age and a Negro boy named Noah about four years old …. Seal the 10th January 1826, Nemas Crawde (seal).

   Witnesses:  Robert Carlas, Jacob Fulthenson.

Bill of sale acknowledged in open court at the September Session 1828 of the Court of Pleas and Quarter Sessions and ordered to be recorded and certified for registration. Given under my seal at offices in Maryville the 26th day of November, registered 12th day of February 1829.  Jacob F. Faute.

James Badgett to William Henderson (See image)
Indenture 12 November 1827
Registered 10 June 1828

Know all men by these presents I James Badgett of the County of Knox State of Tennessee for and in consideration of the sum of $480 the receipt of which is hereby acknowledged  have this day sold and delivered to William Henderson of the County of Blount and state aforesaid a certain negro boy Zak blacksmith age somewhere about twenty years to have and to hold the said boy Zak slave for life unto said William Henderson his heirs executors administrators and assigns and I the said James Badgett for myself heirs executors and administrators and assigns and all and every other person to have or to license with …set my hand and seal this 12th day of November 1827.

Witnesses: Signed sealed and delivered in presence of James Badgett (seal). Jesse Newson [?].

I Jacob F Faute Clerk of the Court of Pleas and Quarter Sessions of Blount county do hereby certify that at the December session 1827 of said Court this written Bill of Sale was duly approved in open court admitted to record and ordered to be certified for registration.  Given under my hand at office in Maryville the 20th day of March 1828.  Jacob F Faute.  Registered the 10th day of June 1828.

David J Freeman to James Badgett (See images – part 1 and part 2)
Indenture 2 February 1827
Registered 12 February 1829

This indenture made the 2nd day of February 1827 between David Freeman of the county of Knox in the State of Tennessee of the one part and James Badgett of the county of Blount and State aforementioned of the other part witnessed that the said David Freeman for and in consideration of the sum of five hundred and thirty four dollars to him in hand paid the receipt whereof is hereby acknowledged hath granted …be sold delivered and confirmed unto James Badgett his heirs…a certain parcel of land lying on Stark Creek …15 acres more or less…I David Freeman have put my hand and seal this day and year above written in the presence of:

Witnesses: Eliah Dunn, William Kidd [?].

I Jacob F Faute…at quarter session of Blount county do hereby certify that at the December session 1828 of said Court the written deed of conveyance from David J. Freeman to James Badgett for 15 acres of parcel was duly proven in open court by Elishe Dunn a witness thereto and this said Eliha being duly sworn said that he knew William Kidd being the name to said deed as a witness and that the said Kidd as he believes is not an inhabitant of the state it is therefore ordered by the court that the said deed be admitted to record & certified for registration . Given under my hand at offices in Maryville this 13th day of January 1829.  …registered the 12th day of February 1829.
