Francis Parker Will

Smith County Tennessee, Will Book 1803-1925, pp. 55-56

Be it known unto all men that I, Francis Parker Senior of the State of Tennessee, Smith County, taking into consideration the uncertainty of life, being now weak in body but of sound mind do make and constitute my last will and testament in manner following:

1.   It is my will and desire that my wife Lucy should have and be possessed of all my property of whatsoever kind, excepting such as is hereafter mentioned, in trust for the maintenance of herself and my children under age, and for their proper education; but if she should marry, the trust to be void and the property trusted to her, to be put into the hands of the Executors of this will for the purpose above mentioned.

2.   The tract of land on Dixons Creek together with the mills, containing two hundred acres is to be equally divided among my sons Abraham, Francis, Archibald, John and Warmark.

3.   My son Francis is to have his choice of the two colts, Prince and Jolly, and out of the present crop of cotton a good new saddle and bridle to be purchased for him, together with a feather bed and furniture.

4.   My son Archibald to have the remaining colt, and out of the crop of cotton a good new saddle and bridle to be purchased for him, together with a feather bed and furniture.

5.   My children John, Warmark, and Lucy as they come of age or marry are to have each a horse, saddle and bridle and a feather bed and furniture.

6.   The feather bed that I lent to my daughter Polly when she married Thos. Nash, I now give to her together with one dollar in money.

7.   To Francis Nash, the son of my daughter Tabitha, I give one dollar in money as his portion.

8.   After the foregoing special legacies are satisfied, the property that remains in the hands of my wife Lucy, or the Executors of this will, is to be equally divided among my children, Abraham, Francis, Archibald, John and Warmark and Lucy, then of lawful age at the death or marriage of my wife Lucy are to have their portions immediately, but those under age to receive their portions from the Executors of this Will when they arrive at lawful age.

9.   My wife Lucy, Miles West and William Barton I hereby appoint Executors to this my last will and testament earnestly entreating them to have it executed faithfully.

In testimony whereof I have hereunto set my hand seal this 28th September one thousand eight hundred and seven.
