David McCall’s Deed

This indenture made this the 28th day of May in the year of Our Lord one thousand eight hundred and thirty six between D. C. Ward, William B. Moore & Arch (sic) Moore of the one part and David McCall of the other part all of the County of Smith & State of Tennessee witnesseth that the said D. C. Ward, William B. Moore & A. Moore for and in consideration of the sum of fifty two dollars _____ in hand paid the receipt whereof is hereby acknowledged hath bargained, granted, sold and confirmed and by these presents do bargain, sell and convey unto the said McCall, his heirs and assigns forever two lots adjoining the town of Rome known as Lots No. 4, No. 13.  Lot 4 beginning at a stake on the South side of Main Street running South 36 yds 2 feet 10 30/33 of inch to a stake thence South 80 West 33 yds to a stake thence North 36 yds 2 feet 10 30/33 of inch to a stake, thence North 80 East to the beginning containing one fourth of an acre.  Lot 13 Beginning at the Southwest corner of Lot 12 running South 36 yds 2 feet 10 30/33 of inch to a stake then North 80 degrees East 33 yds to a stake then North 36 yds 2 feet 10 inches 30/33 of inch to a stake then South 80 degrees West 33 yds to the beginning containing one fourth of a (sic) acre  To have and to hold the aforesaid lots with all and singular the appurtenances thereunto belonging to him the said David McCall his heirs and assigns forever and we the said D. C. Ward, William B. Moore & Arch (sic) Moore will warrant and defend the right and title of the above named lots unto the said McCall his heirs and assigns from the claim or claims of all other persons whosoever.  In testimony whereof all have hereunto have set our hands and affixed our seals the day and date above written and delivered in the presence of A. L. Bains, J. D. Grissim (sic)

Smith County        ) Then the execution of the foregoing from D. C. Ward, W. B. Moore and A. Moore to David McCall bearing date of 28th day of May 1836 was produced in open court for probate and was duly proven in open court by the oaths of A. L. Bains & J. D. Grissim (sic) the subscribing witnesses to said deed and on motion ordered to be certified for registration.
