This indenture made the sixteenth day of June in the Year of our Lord one thousand seven hundred and eighty nine between Josiah Payne of Davidson County and State of Tennessee of the one part and Benjamin Johns of Washington County and State of Virginia of the other part, Witnesseth that the said Josiah Payne for and in consideration of the Sum of Six hundred and forty dollars to him in hand paid by the said Benjamin Johns the receipt whereof he doth hereby acknowledge hath granted bargained and sold and by these presents doth bargain grant and sell to the said Benjamin Johns his heirs and assigns a tract of good and valuable land fit for cultivation Containing Six Hundred and forty acres of Land lying and being in the County of Sumner on the west side of the Caney Fork river and bounded as follows Beginning at a white oak and beech on the west bank of the Caney fork Running west two hundred and twenty six poles to a sugartree and beech thence South four hundred and fifty two poles to a stake thence east two hundred and twenty six poles to a stake thence North to the beginning, Together with the appurtenances thereto belonging, to have and to hold the said tract or parcel of land with its appurtenances unto the said Benjamin Johns and his heirs and assigns and the said Josiah Payne for himself and his heirs doth warrant and defend said land from any claim or claims of any person or persons whatsoever in witness whereof the said Josiah Payne hath subscribed his name and affixed his seal the day and year first above written.

This indenture made this 22nd day of September Eighteen Hundred and ten between the Commissioners appointed by the General Assembly of the State of Tennessee to lay off a Town in the County of Smith by the name of Carthage and Conveying titles to the purchasers of Lots of the one part and Benjamin Johns of the County of Smith and State of Tennessee of the other part, Witnesseth that the said Commissioners for and in consideration of the sum of Seventy four dollars and fifty cents, to them in hand paid, hath bargained and sold unto the said Benjamin Johns a certain Lot No. 30, Beginning at a stake No. 30 and running agreeable to the plan of said town so as to include the said Lot, agreeable to the survey made by the Commissioners thereof with all the privileges and appurtenances thereunto belonging or in anywise appertaining to have and to hold the same free and clear of all encumbrances from the Commissioners, their Successors in office, their Heirs, Executors, Admrs and Assigns forever. In Witness whereof we the said Commissioners do hereunto set our hands and affix our Seals the Day and date above written.

This indenture made this 22nd day of September in the year of our Lord Eighteen Hundred and Ten between William Walton of the County of Smith and State of Tennessee of the one part and Benjamin Johns of the County and State aforesaid of the other part, Witnesseth that the said William Walton for and in consideration of forty one dollars to him in hand paid the receipt whereof is hereby acknowledged this day bargained sold aliened and confirmed unto the said Benjamin Johns his Heirs and Assigns forever a certain parcel or tract of Land situated,  lying and being in the County of Smith and State of Tennessee, bounded as follows, Beginning at a Honey Locust running north thirty west eighty nine poles to a Hickory, thence west eighty poles to a stake, one pole across the Millrace, thence south twelve and a half east twenty two poles to a stake, thence south one deg eleven poles to a stake, thence south forty nine deg east fourteen poles to a stake, thence south thirty four deg east fourteen poles to a stake, thence south seventy two deg east eight poles to a stake, thence south sixteen deg east eighteen poles to a Beech on the bank of the creek below the mill, thence south eighty seven deg east eighty eight poles to the beginning, Containing Forty one acres and Eight poles more or less, to have and to hold with all the profits privileges hereditaments and appurtenances thereunto belonging to the said Benjamin Johns his Heirs and Assigns forever and the said William Walton doth for himself his Heirs Executors and Admrs do warrant and defend the said granted premises against the lawfull claims of any person or persons whosoever but to the only proper use and behoof of him the said Benjamin Johns his Heirs and Assigns forever. In witness whereof the said William Walton hath hereunto set his hand and seal this day and year first above written.

This indenture made this 24th day of September in the year of our Lord Eighteen Hundred and Ten between William Pendarvis of the County of Smith and State of Tennessee of the one part and Benjamin Johns of the County and State aforesaid of the other part, Witnesseth that the said William Pendarvis for and in consideration of sixty dollars to him in hand paid, the receipt whereof is hereby acknowledged, hath this day bargained sold aliened and confirmed unto the said Benjamin Johns his Heirs and Assigns a certain tract or parcel of land situated, lying and being in the County of Smith and State of Tennessee, bounded as follows, Beginning on three Hickory Saplings and Black tree, at William Pendarvis’s south east corner running west seventy eight poles to a small Hornbeam Dogwood and Ash, thence north thirty seven deg west forty poles to a small sugartree and Lin; thence north six deg east twenty nine poles to a Beech corner of James Woods, thence ninety four poles to an Ash Sugartree and Red Oak, thence south forty deg east sixteen poles to a stake, thence to the beginning. Containing thirty seven and one fourth acres more or less, to have and to hold with all the profits privileges hereditaments and appurtenances thereunto belonging to the said Benjamin Johns his Heirs and Assigns forever, and the said William Pendarvis doth for himself his Heirs Executors and Admrs warrant and defend the said granted premises against the lawfull claims of any person or persons whatsoever but to the only proper use and behoof of him the said Benjamin Johns his Heirs and Assigns forever. In witness whereof the said William Pendarvis hath hereunto set his hand and seal, the day and year first above written.
