Deed Book I, Page 558 - 25 February 1828
Abel Gregory & his wife Mary to James Piper 31 ½ acres
Abel Gregory b. Abt. 1797 NC, son of Jeremiah and Barbara Rawls Gregory, and brother
to Joel L. Gregory (my ggg-grandfather) who also lived on Peytons Creek. Mary Polly
Gregory, his wife, was b. Abt. 1805 TN. James Piper was b. Abt. 1804 TN. Both Abel
and James were farmers and can be found in the 1850 Smith Co., TN census. One
interesting thing about this deed is that they spoke with Abel's wife, Mary, seperately.
Being that it was a joint ownership, that she agreed to the sale without any persuasion.

This Indenture made and entered into this 25th February
1828 between Abel Gregory and his wife Mary Gregory of the
one part and James Piper of the other part all of the County of
Smith and State of Tennessee, that the said Abel and Mary for the
sum of two hundred and fifty dollars to them in hand paid the receipts
where of is hereby acknowledged hath bargained, sold and delivered and
by these present doth hereby baragin, sell and deliver to the said James
a certain tract or parcel of land lying in the County of Smith,
Beginning on an ash and birch trees the west side of Peytons Creek
Wm. Gregorys northeast corner of a fifty three acre tract that the said
Gregory purchased of Joel Dyer running west 168 poles to a stake in
Abel Gregorys east boundary line thence north 30 poles to a poplar
stump thence east 168 poles to a sugar tree on the west bank of said
creek thence south 30 poles to the beginning containing thirty one
and a half acres be the same more or less, to have and to hold to the
said James his heirs and assigns forever with the hereditaments
and appertinances thereto belonging or in anywise appertaining
and the said Abel and Mary hereby covenants for themselves their
heirs and assigns that they will warrant and forever defend the
said bargained premises to the said James his heirs and assigns
forever against the claims of all and every person or persons lawfully
claiming the same. In testimony whereof we have set our hands and
seals this day and date above written, signed and sealed in

Smith County       }Court of pleas and quarter sessions August term
1828. Then the execution of this deed and bargain of sale from Abel
Gregory and Mary Gregory his wife to James Piper was duly
acknowledged in open court by Abel Gregory and Mary Gregory,
the said Mary Gregory having first been examined by Zachariah
Ford and Frederick Uhls, two of the members of this court appointed
commissioners for that purpose, privately and apart from her
husband the said Abel Gregory touching the executions of said
deed report that the said Mary Gregory says she executed said
deed of her own free will and consent, on motion the same
is ordered to be certified for registration.
