p. 92  Charles McGuire, and William M. Bryan who being elected tried and sworn the truth to speak upon the issue joined upon their oaths do say they fined Joseph Flemming, John Turner, and David Conley, Guilty of the assault and Battery in manner and form as charged in the plaintiff's Declaration and do assess the plaintiffs Damages by occasion of the same, as to Joseph Flemming, Twenty Dollars, as to John Turner, Twenty Dollars, as to David Conly, Twenty Dollars amounting in the whole to Sixty Dollars - and as to the other Defendants they fined them not guilty.  Motion for a new trial & continued.

This day came the parties by their attornies & a Jury of good and lawful men towit:   _____ the ____ Jury____ in this ____ card _____ was ____ Not _____ incorporated ______ Judgment ______ but is _____ omitted _____ in the _____ original ________.   Who being tried and sworn the truth to speak upon the issue joined on their oaths do say, that the said Defendant did assign the said writing obligatory as  in replying he hath alledged and the Jurors aforesaid on their oaths aforesaid do further say that said writing obligatory was lost by tired and accident as also in replying he hath alledged and they do assess the plaintiff Damages by reason of the Defendants detention of his said Debt to $31.50 besides his costs.  Therefore it is considered by the Court that the plaintiff recover against the Defendant.

Ordered by Court that David Nichols act as a constable in this Cournty he having given bond and security as the law directs.

Anderson, Andrew Smith, William Lackey, Isaac McGuire, George McGuire, Robert Puckett, Joseph Thomas, Alexander Lowry, John Austin, William Gist and Richard Hill, who being elected tried and sworn the truth to speak upon the issue joined upon their oaths do say they fine for the Defendant.  It is therefore the opinion of the Court that Thomas Bounds pay the costs out of the County Treasury, when so much may come to his hand not otherwise appropriated.
