I being in a low state of health but in my proper mind do make this my last will and testament. First I direct that all my just debts be paid as ? after my death ? first I will and bequeath to my wife Sarah C. Payne the whole of estate. ? stock, farming tools, household, and kitchen furniture. But if she should marry again than ? give my perishable property to be equally divided among my children after making my daughter Martha equal with her others sisters. Then to my son Robert one horse saddle and bridle and at my wifes death or marriage I leave my land equal to my ? sons Wm S Payne, James C Payne, and Robert F Payne. In testimony ? I have this 9th day of May in the year 1854 signed and sealed in the presence of the subscribing witnesses

P.S. I also appoint my wife Sarah C. and Wm S. Payne as my Executors to said will this day and date above mentioned.

Sumner County Court March Term 1857

The last will and testament of Robert Payne deceased was this day presented in open court for probate and was duly proved by the ? of Thos Burton and Samuel Austin subscribing witnesses thereto and ordered to be recorded by the court. Sarah C. Payne ? of the executrix ? the said will appeared in open court and ? the executor of the ? will Wm S. Payne the executor ? and ? said Wm S. Payne together with Benj Johnson and Thos Austin ? appeared in open court and entered into and acknowledged this bond to the state of Tennessee in the ? sum of one thousand dollars so delivered by the law directs and _ duly qualified
