In the name of God, Amen,
Know all men by these presensts that I, Wm. Mayes of the county of Sumner and the State of Tennessee, knowing the uncertainty of death have thought proper to make and publish my last Will and Testament and by these presents do make and publish this my last Will & Testament in manner and form following. First, I will my soul to God who gave it and my body to a decent Christian burial.
Secondly, I wish all my dust debts and funeral expenses paid.
Thirdly, I give to my children Pleasant Mayes, Joel C. Mayes, Wm. Smith Mayes and Mahala Peadon the sum of one dollar each to them and their heirs forever.
Fourthly, I loan to my wife Nancy Mayes all my Estate real and perishable until my two children Frances M. Mayes and Texanner Mayes becomes twenty-one years old provided she lives a widow so long, but if she should die or marry, then I give the same to my two youngest children Frances M and Texanner and their heirs forever. And in the event one of the said youngest children should die then I give the part allotted to it to the other one. And if my wife Nancy should remain a widow until the said Texanner comes of age say twenty-one years, then I give her one fourth ao all the perishable property and other three- fourths of the perishable property togeother with my land to the said Frances M. Mayes and Texanner Mayes forever.
Fifhly, I appoint my wife Nancy Mayes my sole Executrix to this my last Will & Testament. And I herby revoke all former Wills by me keretofore made ratifying and confirming this my last Will and Testament. In witness whereof i hereunto set my hand and affix my seal the third day of November in the year of our Lord, one thousand Eight Hundred and Fify-three.
