This Indenture made this seventeenth day of October one thousand eight hundred and nine between James Roney Sr. of the County of Sumner and State of Tennessee of the one part and Elizabeth Stalcup of the other part, Witnesseth that the said James Roney for and in consideration of the sum of two hundred and eighty dollars to him in hand paid by the said Elisabeth Stalcup at and before the sealing and delivering of these presents the receipt whereof is hereby acknowledged doth by these presents sell bargain Release and convey enfoeff and confirm unto the said Elisabeth Stalcup her heirs and assigns from me the said James Roney my heirs and assigns executors administrators or any of them all that seat tract or parcel of land situate lying and being in the County of Sumner on the west fork of drakes Creek of big Barron, Containing one hundred and thirty two acres and one hundred twenty eight poles be the same more of less beginning at two white oaks originally North west corner to Benjamin Minesses preemption, Running south eighty three poles and one half to a white oak then seat two hundred and fifty six poles to a white oak, then North eighty three and one half poles to a black gum then west two hundred and fifty six poles to the beginning, Which tract or parcel of land with all ways waters woods and every other appertanance thereunto belonging or in any wise appertaining except that part of a sugar orchet [orchard] lying on the North side of a wagon Road formerly running through the said shugar Camp be the said James Roney reserves the use or benefit of the said part of the said sugar camp to himself for purpose of making sugar and nothing else while the trees are worth attending to make shugar and no longer and he the said James Roney for himself his heirs executors administrators doth hereby covenant and promise to and with the said Elisabeth Stalcup her heirs executors administrators and assigns that he the said James Roney his heirs executors administrators shall and will warrant and forever defend said tract or parcel of land with every of its members from all lawful Claims of any persons whatsoever unto the said Elisabeth Stalcup her heirs and assigns forever in Witness whereof I have hereunto set my hand and seal the day and year above written. The within deed of bargain & sale between James Roney of the one part & Elisabeth Stalcup of the other part for 132 acres & 128 poles of land was duly acknowledged in open Court by the said James Roney the bargainer & ordered to be registered.
