This Indenture made this twenty eight day of August in the year of our Lord One thousand eight hundred and fifteen between John W. Byne, Sheriff of the County of Sumner and State of Tennessee of the one part and John McCann of the County and State aforesaid of the other part. Witnesseth that the said John W. Byne, Sheriff of the county aforesaid by virtue and in pursuance of a writ of fini facias to him directed from the worshipful County Court of Sumner on a suit in which said John McCann was plaintiff and William Boyce, Nicholas Boyce, Richard Boyce, Aaron Boyce, James Boyce and Elizabeth Boyce heirs of Nicholas Boyce, deceased were defendants dated the ninth day of March in the year of our Lord 1815 and signed by David Shelby Clerk of Sumner County Court after giving lawful notice of the day of sale hath exposed to public sale at the Court House in the Town of Gallatin on the sixth day of May in the year of 1815. All the Right, title and interest of William Boyce, Nicholas Boyce, Richard Boyce, Aaron Boyce, James Boyce and Elizabeth Boyce, heirs of Nicholas Boyce, deceased to a certain tract or parcel of land situate, lying, and being in the County of Sumner aforesaid on the waters of the middle fork of Station Camp Creek. Beginning at a dogwood, white Oak and Elm the corner from the Beginning of the tract of land deeded by Charles Carter to Nicholas Boyce deceased Running thence West twenty seven poles to a Hickory the North West corner of said John McCann's tract of land on which he now lives, Thence North nine poles to a dogwood, Thence West thirty eight poles to a stone, James Leith's South East corner. Thence North along Leith's line fifty six poles to a stake, Thence East eighty seven poles to a stake, Thence South Sixty five poles to a stake, Thence West twenty two poles to the Beginning containing by estimation thirty two acres be the same more or less and the said John McCann the highest bidder and did become the purchaser for the sum of two hundred dollars the receipt whereof I hereby acknowledge and for which consideration I have sold and do by these presents sell all the right, title, claim and interest of William Boyce, Nicholas Boyce, Richard Boyce, Aaron Boyce, James Boyce and Elizabeth Boyce heirs of Nicholas Boyce, deceased to the above described land to the said John McCann. To have and to hold the aforesaid land with all and singular the rights, profits, Emoluments, heriditaments and appertaining to the only proper use benefit and belief of him the said John McCann his heirs and assigns forever and I the said John W. Byne, Sheriff as aforesaid will warrant and forever defend the aforesaid land and bargained premises to said John McCann his heirs and assigns against the lawful claim or claims of these the said William Boyce, Nicholas Boyce, Richard Boyce, Aaron Boyce, James Boyce and Elizabeth Boyce heirs of said Nicholas Boyce deceased.

In testimony whereof I the said John W. Byne sheriff as aforesaid have hereunto set my hand and affixed my seal the day and date above written ~

The within deed of bargain & sale between John W. Byne Sheriff of the One part & John McCann of the other part for 32 acres of land was duly acknowledged in open Court by the said John W. Byne the bargainer & ordered to be Registered.
