TRANSER ELLISON TOLIVER TO JOHN W. GILBERT & BENJAMIN ROANEY 69 Acres

I Ellison Toliver have this day bargained and sold and do hereby transfer & convey to J. W. Gilbert and B. Roaney for the consideraton of one thousand dollars to me in hand paid for a certain tract of land lying in Sumner co., Tenn No.18 District, bounded as follows: Beginning in the center of the Turnpike one chain South from the center of the Honey Run Creek, thence up said creek with is meanders to a sugartree making in all forty six chains & sixty six links, thence South 12 SW 12 chains & fifty five links to white oak in Lewis Warrens line, thence West to the center of Turnpike 17 chains, thence with the center of the pike 39 chains and 36 links to the Beginning. Containing by estimation sixty nine acres be the same more or less with the exception of the Grave Yard forty ft long & forty wide, the same to the said J. W. Gilbert & B. Roaney their heirs & assigns forever. I do furthermore covenant with the J.W. Gilbert & B. Roaney that I am lawfully seized of said land and have a good right to convey it and the same is unincumbered. I further covenant and bind myself & heirs and representatives to warrant & forever defend the title to said land & every part thereof to the said J. W. Gilbert & B. Roaney their heirs and assigns against the lawful claims of all persons whatever. This February 7th eighteen and sixty one
