I Robert West of the county of Smith and the State of Tennessee being of sound mind and disposing memory do make and publish this my last will and testament hereby revooking and making void all others made by me at any time. I hereby will and devise and bequeath all my property and personal property as follows, that is to say

 

First    I will and desire that my funeral and burial expenses and debts be paid as soon after my death as possible out of any money that I may have possesed of or that may first come into the hands of my executor.

 

Second  I will and bequeath to my beloved wife Martha M. West all the lands that I

own, consisting of about one hundred and eighty-five acres (including and excluding

(2) acres around and including the family grave yard) and desire that she have full

control of the same during her natural life, and at her death the same shall be equally

divided (if practical) or sold and the proceeds equally divided between my distributees and heirs at law. No account to be taken of any advancements made by me heretofore.

 

Third   I will and bequeath to my son A.O. West (2) two acres land including the

family graveyard, the same excluded in the above or second item in the is will.

 

Fourth   I will to my said wife Martha M. 2 feather beds, 2 bead steads, 7 cooverlets

and a sufficient quantity of *counterpins, quilts, blankets ,sheets, pillows and bolsters

to furnish said beds and I also will her one press and all tableware on hand, one ?,

one clock, one large dining table, and three small tables, one churn, all the chairs on

hand, one looking glass, one cooking stove, and all the cooking vessels on hand, one

side saddle and bridle, one shot gun, all shoe tools on hand, all washing tubbs and

water buckets on hand, two choice wheat boxes, two choping axes, two choice

plows and one set plow gear, two weeding hoes and one grubing hoe, one horse,

one cow and calf, Seven head of  stock hogs, five head of sheep, 25 lbs. of corn and

I also will and desire that my said wife, Martha M. shall have set apart after my

death, in addition to the above named articles of property a sufficient and ample of

provisions and nesessaties of life to do and have her plentifully for one year from and

after my death and should there not be a sufficient anount on hand, then and in that

case the same shall be furnished her by my executor or he shall furnish money to buy

the same one of any funds that she many have on hand.

 

Fifth   I will and desire that my executor pay to my said wife Martha M. ($50.00) as

her necesseties may require or as she may call for it.

 

Sixth   I nominate and appoint my son A. O. West my executor to this will. Executed

and signed on the 23rd of August 1880.

Signed and acknowledged in our presence and we in the presence of each other on

State of Tennessee, Smith County:  County Court July Term 1881. Be it remembered

that on this the 4th day of July 1881 a paper writing bearing date Aug. 23rd 1880

proposing to be the last will and testament of Robert West deceased was produce in

open court and offered for probate then case being in open court R. R. West and

Newton Lankford subscribing witnesses to said paper who being duly sworn saying

that they were personally aquainted with Robert West the testator in his life time and

that he signed and acknowledged the paper writing and there to be his last will and

testament in their presence and that they witnessed the same in his presence and in

the presence of each other and that he was of sound mind and disposing memory at

the date of signing and acknowledgeing the same, and that he has since died a

resident citizen of Smith Co. Tennessee. It is there for ordered by the Court that said

paper writing be ordered to probate as the last will and testament of the said Robert

West deceased and that it be recorded and filed as the law directs in such cases.

*According to The 1828 American Dictionary of English Language –Noah Webster a

counterpin or sometimes pronounced counterpane is a particular kind of coverlet for a

bed. A coverlet stitched or woven in squares. Another dictionary calls it a bedspread

 

*R.R. West is Ridley Robert West

*A.O. West is Archibald Overton West

 

Robert (Robin) West 1801-1881 is the son of Elder Miles West and Lucy Parker

West . His wife is Martha (Patsy) Knight the daughter of John Knight
