In the name of God Amen.  I William Pendarvis of the State of Tennessee, and County of Smith being old but in tolerable good health and of perfect mind and memory thanks be given unto God.  Calling unto mind the mortality of body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament, that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that gave it and my body I recommend to the Earth to be buried in decent Christian buriel at the discretion of my Executor nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God.  And as touching worldly estate wherewith it thus pleased God to bless me in this Life, I give demise and dispose of the same in the following manner and form.

 

First I give to my oldest son James Pendarvis heir one dollar in addition to what I have already given him.

 

Secondly I give my daughter Nancy C. Glover** one dollar in addition to what I have already given her.

 

Thirdly I give my son Solomon T. Pendarvis one dollar in addition to what I have already given him.

 

Fourthly I give my son Samuel F. Pendarvis one dollar in addition to what I have already given him.

 

Fifthly I give my daughter Eliza J. Garrett one dollar in addition to what I have already given her.

 

Sixthly I give my daughter Margaret M. Herron ten dollars in addition to what I have already given her.

 

Seventhly I give my son William I. Pendarvis one dollar in addition to what he has already had.

 

I desire that all my just debts shall be paid before these legacies and my debts collected.  I appoint my son Joseph A. Pendarvis my Executor to this my last will and testament (Turn Over).  After the expenses of my buriel and my debts are paid my due(?) collected and the legacies paid what remains of my personal and real estate I dispose of in the following manner and form.  First I give my wife Margaret Vance one third and my son Joseph A. Pendarvis whom I have appointed my Executor heir of the other two thirds of my estate.  In witness whereof I have hereunto set my hand and seal this the second day of March in the year of our Lord 1850.

Smith County  )   This the Last Will and Testament of William Pendarvis deceased was produced in open court for probate and the Executor thereof duly proved in open court by the oaths of Archibald L. Taylor, Winston Perry and George C. Allen subscribing witnesses thereto.  Whereupon said last will and testament was ordered to be filed and recorded.
