The following are some of the wills of various ancestors of Susan Elizabeth Payne b.Jun 11, 1853 in Dixon Springs, who was married to Alexander Gregory son of Henry Milton Gregory. She was the daughter of William J. Payne and Martha Thornton Garrett.

Will of John Garrett

 

Dated  feb 15, 1742

 

In the name of God, Amen, the 15th day of February 1742, I John Garrot of Amelia county, being in good health of body and of sound and perfect mind and memory, praise be to God, do make and ordain this my last will and tesstament in manner and form following that is to wit: first and prinsably I commend my soul into the hands of almighty God hoping through the merits death and provisions of my saviour Jesus Christ and have full and free pardon of all my sins and to inherit everlasting life and my body I commit to the earth to be decently buried at the descretion of my executors hereafter named and as touching the disposition of all such temporal estates as it has pleased almighty God to bestow upon me, I give and dispose thereof the following:  first I will that my debts and funeral charges should be paid and discharged.

Item:  I give unto my son Charles Garrot my plantation that I now live on with as much of this ___ of land joining far as the Persemon Slash and down the slash to the gulley, and down the gulley to the river as the river goeth.  I also give unto him a young horse or mare at the age of twenty one years.

Item:  I do give my son John Garrot half of the other part of the same tract of land, it lying and being in the fork between the Persemon Slash and the gulley.  I also give him a new gun.

Item:  I give unto my son, Stephen Garrot the other part of the same tract of land, it lying and being the upper part from my son John and joining to Col. William Kennon's line.  I also give him a young horse or mare at the age of twenty one years old, but provided other of my three sons, Charles Garrot, or John Garrot, or Stephen Garrot, should die without heirs lawfully begotten, their part of the land to fall to the other two brothers aforesaid and be equally divided.  I also give to each of them a young horse or mare at the age of twenty one.

Item:  I give unto my son Abraham Garrot, my old gun.

Item:  I give to my son Isaac Garrot,  the plantation he now lives on.

Item: I give to my daughter Nanny Garrot, one feather bed with furniture to it.  I also give unto her one cow and calf, one iron pott, and two pewter dishes.

Item:  I give unto my daughter Susannah Burton, one cow and calf.

Item:  I do make and ordain my loving wife Susannah Garrot and my son Isaac Garrot my full and sole executors of this my last will and testament whereunto I have set my hand and seal the day and year above mentioned.

Will of Abraham Burton

 

In the name of God, Amen, May 13, 1736, I Abraham Burton being sick and weak but of perfect sense and memory, thanks be to God, therefore and calling to mind the mortality of this life, and it is appointed that all must dye do make and ordain this, my last will and testament in manner and form following.  First I desire my just debts shall be faithfully paid and discharged.

Item:  I give my daughter Susannah Garrot one cow and calf.

Item:  I give unto my well beloved son, Abraham Burton and his heirs forever a tract of land containing two hundred acres lying and being in the county of Amelia on Acimateck River near the mouth of Deep Creek whear he now lives.  I also give to my son , Abraham Burton five negroes, Joel, Moll, Indy, Andy, and Sary to him and his heirs forever.

Item:  I give and devise unto my loving son, Charles Burton and to his heirs forever all my land on Swift Creek in Henrico Co, being a tract of land containing two hundred acres more or less, which I purchased from Capt. Thomas Jefferson.  I also give to my son charles, fore negroes, Lego, Dino, Matt, and Joe to him and his heirs forever.

Item:  I give to my loving son, Thomas Burton and to his heirs forever the upper part of the land I now live on.  I also give unto my said son Thomas Burton two negroes, Peter and Bob and one half my personal estate.

Item:  I give unto my loving wife Ann the other half of my personal effects.  I also give unto my wife the use and occupation of the lower half of the land I now live on and the use of two negroes during her natural life, and after her decease I give and devise the said plantation and the aforesaid two negroes which are Seasor and Jenny to my son Thomas and his heirs forever.

Lastly, I conshive and appoint my son Charles Burton my hole and sole executor of this, my last will and testament in witness hereof I have here unto set my hand and fixed my seal the day and year above.

Will of Anne Featherstone

 

In the name of God, Amen, I Ann Burton of the county of Amelia do make and ordain my last will and testament in  the manner and form following:

Item:  I give and bequeath to my daughter Susannah Clifton, my grandaughter Susannah burton, and my grandaughter Anne Garrett all my wearing apparell to be equally divided among them.

Item:  I give to Charles Burton, son of Charles Burton half my stock, two dishes, one baon, four plates, and one large pott.

Item:  _________I also give to my son Thomas Burton the rest residue of my estate real and personal to whom I do appoint to be my executor to him and his heirs forever in witness I have hereunto set my hand and seal this 22 day of December in the year of out Lord 1745.

Will Of Isaeah Payne

 

Will - Recorded in Will Book A - Page 280, Apt 6 - File # 351?, Probated 22nd May, 1818

 

IN THE NAME OF GOD, AMEN. Isaeah Payne of the District of Greenville and State of South Carolina being far advanced in life but of perfect mind and memory and knowing that it is appointed for all men to die do make and ordain this my last will and testament.

 

And first of all I give my soul unto the hands of almighty God who gave it and my body to the earth in a decent and Christian burial. And as touching much worldly estate as it hath pleased God to bless me with in this life I five devise and dispose of the same in the following manner and form.

 

First, I give to my son William Payne one dollar, to Elitha Paris one dollar, to Susannah Thompson one dollar, to Isaac Payne one dollar, Moses Payne one dollar, Sarah Payne one dollar, to Nancy Cox one dollar, to Dorcas Meachen one dollar, and to the heirs of my son Archibald Payne dec'd one dollar.

 

And to my granddaughter Leah Burnsides who is now living with me I give and bequeath one feather bed and furniture, and all the wearing clothes of my deceased wife, and all the earthen ware glasses and cups of every description and pewter belonging to my cupboard, together with all my kitchen furniture. To my son Aaron Payne I give and bequeath all my land and plantation and to his heirs forever, together with all my stock of horses, cattle and hogs, and all my household furniture and property of every kind not otherwise willed and I do hereby appoint my son Aaron Payne the sole executor of this my last will and testament and revoking all others do make and ordain this my last will and testament.

 

Witness my hand and seal this 28th day of January in the year of our Lord one thousand eight hundred and fifteen.

Will of James Bryant

 

In the name of God, Amen, I James Bryant of the county of Powhaten, being sick and weak, but of perfect mind and memory, blessed be to God, do make and ordain this my last Will and testiment, hereby revoking all others heretofore by me made.

Item:  I lend to my beloved wife, Clara Bryant, during her life the tract of land whereon I now live, also the use of seven negroe slaves, to wit: Adam, Jupiter, Ceasar, Jane, Jenny, Sarah and Pheobe;

also all plantation utensils, the stock of every kind and the crop that is on or may be on the said plantation at the time of my decease.

Item:  I give and bequeath to my grandaughter, Elizabeth Bryant, daughter of my son, Thomas Bryant, one negroe girl named Lydia, her and her increase to her and her heirs forever and if either of my grandchildren die under the age of twenty-one or before marriage then my will is the survivor as their shall hold and enjoy in equal proportion the legacy left to the said deceased, to them and their heirs forever.

Item:  My will and desire is that all my estate, lent ot my wife Clara during her life, be after her death, (as well, real and personal) equally divided among my children hereafter named James Bryant Jr., Isaac Bryant, judith Street, Elizabeth Saille, Mary Christian, Martha Leseur, Anne Steinson, Fanny Forsee and my grandaughter, Fanny Bryant, daughter of my son Thomas Bryant, the said negroes with their increase to them and their heirs forever and if any dispute should hereafter arise relative to my will, my desire is that the said dispute be referred to the other judges of the General Court or any three being first named in commission and their determination shall be good and valid the agree giving proper notice of time, and place to discuss the matter aforesaid and I do hereby appoint my sons James Bryant, Issaac Bryant and my son in law John Christian, executors fo this my last will and testament.

     In witness whereof, I have hereto set my hand and affixed my seal this the 25th day of Sept, 1783.

 

 

Will of Peter Guerant, The Huguenot

 

In the name of God, Amen. I Peter Guerrant of the parish of King William, in the county of Cumberland, being in health of body and of sound and disposing mind and memory, praise be Almighty God for the same, but considering the uncertainty of human life, do make this my last will and testament in manner following: That is to say, my just debts being paid first and satisfied.

Item: I give and bequeath to my eldest son John Guerrant Four hundred acres of land, lying on Jushua's Creek, one of the branches of Slate river in Albemarle County, for him and his heirs forever. I also give him, my son John Guerrant, a horse called Jockey and my Philadelphia saddle, for him and his heirs forever.

Item: I give and bequeath unto my son Peter Guerrant, four hundred acres of land lying and being on Hunt's Creek, one of the branches of Slate river in Albemarle County, for him and his heirs forever. I also give my son Peter Guerrant one feather bed and furniture for him and his heirs forever.

Item: I give and bequeath to my son Daniel Guerrant Four hundred acres of land joining on his brother John Guerrant's line, it being part of an order of Council for six hundred acres of land on Joshua's Creek, one of the branches of Slate river in Albemarle County, for him and his heirs forever. I also give my son Daniel Guerrant one negro boy named Caesar, for him and his heirs forever.

Item: I give unto my daughter Esther Guerrant Two hundred acres of land on Collier's line--it being part of the four hundred acres of land on Mountain Creek in Amelia County, for her and her heirs forever. I also give my daughter Esther Guerrant the other new bed, with what furniture there is to it, and a rug, and two cows and calves for her and her heirs forever, and two pounds of current money, and the two cows and calves to be delivered when she shall attain the age of twenty-one years or married.

Item: I give and bequeath to my daughter Magdalene Guerrant the other two hundred acres of land on Mountain Creek in Amelia County, it being the other part of the four hundred acres, for her and her heirs forever. I also give my daughter Magdalene Guerrant the sun of five pounds Current money to be paid out of my personal estate and two cows and calves, to be delivered after she shall attain the age of twenty-one years or married.

Item: I give and bequeath unto my daughter Jane Guerrant Two hundred acres of land, it being part of an order of Council for six hundred acres of land lying and being on Joshua's Creek, one of the branches of Slate River, in Albemarle County, for her and her heirs forever. I also give my daughter Jane Guerrant, the sum of Five pounds Current money, to be paid out of my personal estate, and two cows and calves, to be delivered after she shall attain the age of twenty-one years or married.

Item: I give and bequeath unto my daughter Judith Guerrant, the sum of fifteen pounds Current money for her and her heirs forever.

Item: If in case, my beloved wife Magdalene Guerrant should happen to be now with child, and it should happen to be a boy, I give him thirty-five pounds Current money, to be laid out of my personal estate, for him and his heirs forever, but, if it should happen that my beloved wife is with child of a daughter, my will is that I give her fifteen pounds Current money, for her and her heirs forever.

Item: I leave to my beloved wife Magdalene Guerrant, the use of the plantation I now live on, with the use of three negroes, Tom, Sarah, and Moll, during her natural life, and my will is that my beloved wife shall have the use of all the negroes, during the time of her widowhood. Caesar only excepted which is before given to my son Daniel Guerrant, but in case that it should happen that there be not movable estate enough to satisfy the legacies before given, my will is that Betty shall be sold by way of outcry to satisfy the afore given legacies.

Item: My will is that after my beloved wife Magdalene's decease, that all the negroes and all the plantation I now live on shall be sold by way of outcry and the money be equally divided among my beloved children who will be living at that time.

Item: I do constitute and ordain my well beloved wife Magdalene Guerrant to be the whole and sole executrix of this my last will and testament, and I do hereby declare this and none other to be my last will and testament, revoking all other wills and testaments, which may have by me been formerly made. In witness whereof, I have hereto set my hand and fixed my seal, this Third day of December, One Thousand Seven hundred and forty-nine.

Will of Magdalen Trabue Guerrant Smith

 

To my son James Smith, the whole of crop on plantation I live on and 1/2 the crop on the plantation on Chastain's branch. The other 1/2 of crop divided upon my three sons Peter Guerrant, Daniel Guerrant and John Guerrant. To my three daughters Magdalen Moseley, Judith Smith, and Martha Sublett, my wearing apparel. To my son James Smith, my riding chair and cupboard. To my granddaughter Elizabeth Guerrant, a side saddle. Executor: son James Smith Dated 15 May 1787. Recorded 16 Aug. 1787

Daniel died without a will; therefore his estate was inventoried in full detail. Following are the items listed:

"A true and perfect inventory of all and singular the goods and chattels rights and credits of Daniel Guerrant late of the Parish of King William in the county of Goochland, dec'd, taken, valued and appraised, pursuant to an order of Goochland County Court, by Thomas Dinkins, Stephen Chastain and John Chastain, the 26 day of November in the year of our Lord 1730 as follows: vizt: The deceased's wife's wearing apparel, 13 yd 3/4 Gartering, 1/2 yds Dowlas, 1 1/2 yrds Jr., 45 yrds bro. Lin, 4 yrds Rappers, 25 3/4 yds of hd wide Stuff, 1/2 yds. do, 50 yds Calico, 3 quires paper, 1 piece Inklo, 1 1/2 oz.
