Last Will of James Martin

In the name of God, Amen, I James Martin do make and publish this my last
will and testament hereby revoking and making void all other wills by me
at any time made.
First I direct that my funeral expenses and all my debts be paid as soon
after my death as possible out of any moneys that I may die possessed or
may come into the hands of my Executor.
Secondly It is my will and __________that my land, negroes,household and
kitchen furniture and all my stock of every description and all the
property that I may die possessed of both real and personal shall be sold
and the profits thereof equally divided among my six children (namely)
Stephen W Martin, John G. Martin, Elizabeth Martin, Sally Garrett, Jane
Dillon, and Malinda Williams Jones. I want it expressly understood that
it is my will that the portion which will be going to my daughters
(namely) Elizabeth Martin, Sally Garrett, Jane Dillon, and Malinda
________ are for their benefit and the benefit of the heirs of their body
and I hereby direct my executor when he settles up my estate to pay over
to each one of my daughters their respective share in portions agreeable
to their _______ access of said will and not forfeit it to their husbands.
Thirdly I give and bequeath to my three sons in law namely William L.
Martin, William D. Garrett, and William Dillon one dollar each in order to
prevent them from having any claim against their ______________ that shall
arise from my estate.
Lastly I do hereby nominate and appoint Stephen W. Martin and John G.
Martin my executors.
In testimony thereof I do to this my will set my hand and seal this 9th
February 1848.
