Smith County, TN

 

In the name of God Amen. This eighteenth day of August in the year one thousand eight hundred and twenty six. I William Haynie of the state of Tennessee, and county of Smith being sick and weak in body, but of a perfect sound understanding and memory and calling to mind the mortality of this my human body and that it is appointed unto all men once to die, I do make this my last will and testament, and I do hereby make and (denounce?) all other testaments by me hitherto made, and do constitute, and confirm this and no other to be my last will and testament and first commending my soul to God who gave it and my body to the earth to be buried in a decent Christian manner.

 

2nd My wish and desire is that all my just debts be paid.

 

3rd I will and bequeath unto my beloved wife Anne Haynie all my real and personal property during her natural life time except that part of my land which I have given to Elijah Haynie my son, which is all my land lying on the west side of  Peyton’s Creek,

 

4th I will and bequeath unto my grandchildren, the heirs of William Haynie my son, all my land lying on the East side of Peyton’s Creek _______ after the death of my ______ wife.

 

5th I will and bequeath unto my grandchildren i.e. the heirs of James Haynie _____ the heirs of E. Haynie, the heirs of Thos. B. Haynie, the heirs of Susannah the wife of Samuel? Estes, the heirs of Judah ________ _______ ________ _______ the wife of Jas Herod, and the heirs of Wm Haynie all share and share alike except one hundred dollars, i.e. fifty dollars to the (use?) of Susannah Evits(?) and her children, over and above their equal share also the other fifty dollars to be equally divided between Juddah’s three children by Jas Herod.

 

And lastly I ______ ______ and appoint Elijah Haynie and Thomas B. Haynie Executors to this my last will and testament to which I set my hand and affix my seal the year and date first above written.
