Clarkey Haynie Will

Smith County, Tennessee

March, 1872

 

I Clarkey Haynie, being of sound mind and disposing memory, do make and publish this my last will and testament hereby revoking all others made by me at any time.

 

First: I desire that all my just debts be paid as soon after my death as possible out of any paper money that I may die seized with or that may come into the hands of my Executors after my death.

 

Secondly: It is my will that the gold that I may have  on hand be equally divided between my three sons that are living and three of my daughters, each one having one hundred dollars, Viz. Milton Haynie, E. B. Haynie, H. B. Haynie, Pollie Royster, Clarkey Perry and Julia Herrod. Should the amount not be sufficient for each to have one hundred dollars, he or she not receiving the full amount in gold, it is my will that it be supplied with paper money, two dollars in paper for each gold dollars.

 

3rd. It is my will that my two grand children, Clarkey Haynie and Elijah Haynie, a daughter and son of James Haynie, dec’d, have one hundred dollars and that Elijah have seventy-five dollars and Clarkey twenty five dollars.

 

4th. It is my will that my daughter Susan Knight, wife of Robert Knight have the hundred dollars in gold which he borrowed from me and that the interest of said money from the time it was borrowed until the settlement be calculated and that it go in part or whole as the case may be of all the money that may come to hand to be divided, after the above specifications are complied with.

 

5th. It is my will that the money that may come to hand after the above is complied with be equally divided between my children, above named and grand children, viz: Clarkey and Elijah receiving one share to be divided equally between them.

 

6th. It is my will that Alice Haynie, daughter of H. B. Haynie have my Bureau and a small chest and candlestand.

 

7th. It is my will that Clarkey Haynie daughter of James Haynie, dec’d, have my desk—two windsor chairs and a cherry bedstead and dressing table.

 

8th. It is my will that Mary Haynie, daughter of Milton Haynie have my saddle & bridle.

 

9th. It is my will that all other property that I may have be given to my daughter in law Margaret E. Haynie.

 

10th. It is my will that my two sons E. B. Haynie and H. B. Haynie execute this my last will and testament and that they have twenty five each for their services.

Smith County                 County Court, March Term 1872

 

Then a paper writing purposing to be the last will and testament of Clarkey Haynie, dec’d, was produced in open court and offered for probate, wherefore J. N? Haynie and Juda A. Haynie subscribing witnesses thereto appeared in open court, who being duly sworn deposed that they are acquainted with the Testatrix Clarkey Haynie, dec’d, that the signature to the said paper writing of Clarkey Haynie and mark thereto was acknowledged by the Testatrix in her life time in their presence and at her request and that she was at the date of the same of sound mind and disposing memory.

 

It is therefore ordered by the Court that said last will and testament be admitted to probate and duly recorded and filed according to law.
