Josiah Gale's Will

In the name of God Amen I Josiah Gale of Chesterfield county be-

ing in good health and of sound mind do make this my last will and teste-

ment in manner following to wit, First I lend my beloved wife Sally Gale

the use of all my estate, both real &  personal during her life & widow

hood and at her death or marriage which shall first happen my will is that

my estate so lent her be equally divided among all my children then living

or their legal representatives. I appoint my son James Gale and my

Brother in law Lafon & my friend Phillip Turpin of Swife Creek Executors

of all this my last will & testement hereby revoking all wills by me

heretofore made. In witness whereof I have hereunto set my hand and

affixed my seal this day August 1791

Sealed, published, and declared by the said Testators as his last will and

Testament in presence of us who at his request have subscribed our name as

The last will & Testament of Josiah Gale Deceased was proved by the

oath of Burkinhead Pitts, a witness thereto & continued for further proof.

James Gale & Thomas Lafon executors therein named gave bond and took the

Virginia, Chesterfield County, to wit,  I Thomas Watkins Clerk of the aforesaid County do certify that the foregoing is a correct copy of the will of Josiah Gale Deceased which has been party proven in the court of the said County and is now filed in my office In testemony whereof I have hereunto subscribed my hand carried the official seal of the said County to be here unto affixed this 14th day of October in the year of Christ one Thousand eight hundred & five in the thirteenth year of Said commonwealth

the above as an Inventory of the Estate of said Joseph Gale,

An Inventory and appraisment of the Estate of Josiah Gale Decd was re-

turned and ordered to be recorded.

 

State of Virginia, Chesterfield County To wit, I Thomas Watkins

Clerk of the afforesaid County do certify that the foregoing is a correct copy of the Inventory &

appraisment of Josiah Gale Decd which has been returned and duly recorded in the court of

said County.

In Testemony whereof I have hereunto subscribed my hand & caused the aforesaid seal of said

County to be hereunto affixed this 14 day of October In the year of Christ one Thousand eight

hundred & five and in the thirteenth year of the said commonwealth.

P 23     Chesterfield County, State of Virginia.  I Edward Mosely presiding

Majastrate for said County do certify that Thomas Watkins whose signature

is above is clerk of the court of said county Given under my hand this 11th

day of October 1805

Virginia to wit Be it known to all to whom it may concern that I Alexander McRae in

pursuance of an act of the General Assembly entitled, an act for reducing into one the several

acts and parts of acts respecting the powers & duties of the Executive, Being the Senior

member of the Privey council, and as such in the absence of the Governor do hereby certify

that Thomas Watkins is clerk of the Court and Edward Mosely the Senior Majistrate for the

county of Chesterfield and in the commonwealth and that full faith and credit is due to what so

ever may be attested by either of them in their characters respectively as such. (L S.) given

under my hand with the seal of the Commonwealth annexed at Richmond this 22nd day of

October 1805.

Transfer of Court Jurisdiction Over Josiah Gale Estate

The written certified copy of the last will an Testament together with

an Inventory account of the Estate of Josiah Gale decd was Exhibited to

court & appearing to be properly authenticated there fore ordered to be

recorded.

Be it remembered that I Sally Gale relect & widow of Josiah Gale Decd have

this day relinquished grant claim & do by these present relinquish quit

claim to and put into possesion of James Gale Executor of the last will &

testament of said Josiah Gale and also to the other Legal heirs and their

representatives of the said Josiah Gale Dec& all my right title claim &

Interest in & to the Estate, both real & personal which was willed by law

in said will during my natural life or widow hood by said will bearing date

the first day of August 1791 and attested by Wm. Flaming & Burkenhead Pitts

Which said relinquishment & deed of acquittal shall be considered in as

full and ample manner & as equally binding on me as if the continqencies of

said last will of

on proviso that the said executor or Executors of said Josiah Gale Decd.

division of said Estate agreeable to the true interest and meaning of the

 Dwelling house of Sally Gale in said County on the 26th day of September

1805 & Sally Gale signed by Mark sealed & Delivered the written deed of

relinquishment & acquittal to the executor & Legatees of Josiah Gale Decd

before us given under our hands the date above.

Persuant to a Division made by the Estate of Josiah Gale Deceased, We Elisabeth, Josiah,

John & Sally Gale have received James Gale Executor, the Sum of six Hundred and sixteen

and one eighth dollars in property cash.  In full of our Legacies & all other claims gainst the

said Estate, given under our hand & seal this day of January one Thousand eight hundred &

six.

Smith County     Agreeable to an order from the worshipful

court of said County to us directed to settle with James Gayle Executor of

the last will & testement of Josiah Gayle Decd said James Gayle produces

an Inventory of the Estate of the aforesaid Josiah Gayle Decd to the

amount of $4929 and produces receipts in full of Elizabeth Gayle, Josiah

Gayle, John Gayle & Sally Gayle four of the Legatees, proven by the oaths

P 29    of Wilson Yandell for their respective shares of said Estate

amounting to $ 2464.50 there is still a Ballance in said James Gales Hands

of $2464.50 of which $616.12 he the said Gale is entitled to as his

share he being one of the Legatees of said Estate the Ballance of $1348.37 1/2

he still holds in his hand as guardian for the other three Legatees, they

being under age to wit, Polly Gayle, Robert Gayle and Thomas Gayle.  In

tentemony whereof we set our hand this 12th day of March 1806 (Signed)

Know all men by these presents that I Sarah Gale of Smith County and State of Tennessee have

for & in consideration of the sum of one Thousand Dollars to me in hand paid by James Gale

Executor  J. Gayle Decd The Receipt whereof is here by acknowledge have bargined sold and

delivered unto the said James Gale two negro men named Harry & Phill and I do by these

presents enguage for my self my heirs executors or assigns for ever to will warrant and defend

the right &Title of said negroes to him the said Gale against the claim or claims of all and

every person whom ever having or pretending to have a claim in witness whereof I have here

unto set my hand and seal this twenty sixth day of September oneThousand eight Hundred &

five.
