This indenture made this Twenty first day August in the year of our Lord one thousand eight hundred and nine between John McIvar of the town and County Alexandrea and District of Columbia of the one part and James Payne of the County of Robertson and State of Tennessee of the other part. Witnessed that the said John McIvar for and in consideration of the sum of one hundred and eighty dollars, to him in hand paid by the said James Payne at before the ensealing and delivering of these presents the receipt whereof the said John McIvar doth hereby acknowledge and the rest and every part thereof doth acquit and exonerate and discharge the said James Payne his heirs, executors and administrators hath granted, bargained, sold, absented, relayed and confirmed and by these presents doth grant, bargain, sell, absent, relay and confirm unto the said James Payne his heirs and assigns forever a certain tract or parcel of land containing one hun.dred and eighty acres and one hundred and twenty eight poles be the same more or less lying and being in the County of Robertson in the State of Tennessee on the watters of Red River being part of a certain tract of six hundred and forty acres granted by the State of North Carolina to Stockly Donelson by patent number twenty eight hundred and thirty five, dated the twelfth day of January anno donning one thousand seven hundred and ninety seven and bounded as follows (to wit) Beginning at two black oaks the north west corner of said original survey thence south one hundred and twenty eight poles to Bowman’s line thence east two hundred twenty six and a half poles to the eastern boundary of said original survey thence north with said line one hundred and twenty eight poles to a white oak the north east corner of said original survey, north twenty eight hundred and thirty five thence west two hundred and twenty six and one half poles to the beginning, with all and singular the hereditaments and appurtenances to the said bargained presents belonging or in any way part and parcel thereof and all rents issued severally and profits to them either of them belonging or appertaining to hand and to hold the said land and premises hereby granted with the appurtenances unto the said James Payne his heirs and assigns to the only proper use and behalf of him the said James Payne his heirs and assigns forever and the said John McIvar for himself his heirs executors and administrators doth hereby covenant, promises, and agree that he will at all times hereafter warrant and defend the said land and premises to the said James Payne his heirs and assigns against the claims and demands of him the said John McIvar his heirs, executors and administrators or any person or persons claiming formally or under them or either of them and not otherwise in witness whereof this said John McIvar hath hereunto set his hand and affixed his seat this the day month and year first hereon mentioned.
