         This Indenture made, this 5th day of Octr. In the year of our Lord, 1802, between Thomas Haynes, of the County of Robertson and State of Tennessee of the one part, and Thomas Smith of the other part: Witnesseth, that for and in consideration of the sum of Four Hundred Dollars in hand paid by the said Thomas Smith, the receipt whereof I the said Thomas Haynes do hereby acknowledge, and myself fully satisfied and paid hath given granted bargained and sold demised released conveyed and confirmed and by these presents do grant bargain sell demise release alien and confirm unto the said Thomas Smith all that certain tract of land containing Three Hundred and twenty acres situated lying and being in the County of Robertson and State of Tennessee, on the North fork of Red River, bounded as follows: Beginning at a black walnut on the South bank of the River; runs West thirty six poles across a beat to a hickory sapling on the bank of the River; thence down the meanders of the River to a large Cherry tree; thence West Ninety three poles to a stake in the Barrens, then North one hundred and thirty four poles to the River; thence along the River meanders to a sycamore Priors corner as agreed on by the said Haynes, and Pryor; thence North with Priors line to a stake on the Kentucky line; thence East with the Kentucky line to the patent corner a stake; thence South Three Hundred and seventy poles to the Beginning, together with all woods, waters, mines, minerals hereditaments and appurtenances.
         To have and to hold the before named and bargained premises with all and singular the remainder and remainders reversion or reversions rents and profits of in and to the same belonging to the only proper use benefit and behoof of him the said Thomas Smith, his heirs and assigns forever, and the said Thomas Haynes, doth for himself his heirs executors and administrators covenant and agree to and with the said Thomas Smith his heirs and assigns, that the before recited land and bargained premises he will warrant and forever defend, against the legal claim, right or title of all persons whatsoever.
