         I Warren L Payne of the County of Robertson and State of Tennessee being sound in mind and memory but in bad health do make and publish this my last will and testament as follows.
         In the First, Is my will that my Executor shall pay all my Just debts.
         Secondly, I do give and bequeath to my wife Elizabeth Payne all the lands I may die possessed of with all the appurtenances thereto belonging, during her natural life and after her death to be equally divided between my lawful heirs. I also give unto my wife Elizabeth all my personal estate of every description to dispose of as she may think proper.
         Lastly, I do appoint my son Perry Payne sole Executor to this my last will and testament. Signed, sealed and delivered in our presence this 2nd day of October 1850.

Robertson County Court Dec’r Term 1850
         A proper writing purporting to be the last will and testament of W.L. Payne deceased was produced in open Court for Probate and thereupon came E.L. Payne and J.M. Wright subscribing witnesses to same paper writing, who being just sworn depose and say that they were acquainted with W.L. Payne the testator in his life time and that he acknowledged their presence said paper writing, to be his last will and testament and that he was at that time in his proper mind. The court therefore declared said paper writing to be the last will and testament of the said W.L. Payne dec’d and order that the same be recorded.
