Foreword

In older Madison County court minute books the death dates of persons who died intestate (without leaving will) were generally given inthe record when administrators were appointed for their estates. The death dates of persons who died leaving wills are seldom given; generally if dates are noted in the records of probate these are the dates the wills were executed (made). Hence death dates taken from the minute books covered in this publication are mostly from the records of persons who died intestate; some few are from records of persons who died testate. Along with the death date data are mentions of other transactions of the county court covering persons who have lived in Madison County. (Genealogical data has been abstracted and published by the present writer, in four publications, taken from the Madison County will books, 1821-1914.)

107-108. January 5, 1866. Negroes: JOSEPH, age 12 and ALEXANDER, age 10, minors with no one "to protect and support them" were apprenticed until age 21 to their former master, John Irvin.

111. January 6, 1866. Negroes: SUSAN, age 13 and POLLY, age 11, were bound over by their father, JARRETT, to their former owner, Milton Brown, to serve an apprenticeship until age 21. Page 301, September 5, 1866. The Freedmen's Bureau opined that the county court didn't have jurisdiction allowing such indentures so that they girls were returned to their father.

116. February 5, 1866. Negroes: ELIJAH, age about 14, SILAS, age about 13, PAUL, age about 9, HARRIET, age about 7, orphans, were apprenticed until age 21 to their former owner, Alexander Jackson. Page 302, September 5, 1866. The Freedmen's Bureau opined that the county court didn't have jurisdiction allowing such indentures so that the apprenticeship of these children was cancelled.

THERE ARE SEVERAL RECORDED INSTANCES IN WHICH MINOR BLACKS WERE APPRENTICED TO FORMER OWNERS. THIS PRACTICE WAS NATURALLY RESISTED BY THE FREEDMEN'S BUREAU AS IT APPEARED TO BE VIRTUAL IF NOT IN FACT, SLAVERY. THE BUREAU OVERSAW WORK CONTRACTS MADE AMONG WHITE FARMERS AND BLACK FREEDPERSONS AFTER THE CIVIL WAR. THERE WERE MANY SUCH CONTRACTS MADE, BEARING VALUABLE GENEALOGICAL INFORMATION (FAMILY UNITS, AGES OF INDIVIDUALS) WHICH ARE ON MICROFILM "SELECT RECORDS OF THE TENNESSEE FIELD OFFICE OF THE BUREAU OF REFUGEES, FREEDMEN AND ABANDONED LANDS," NATIONAL ARCHIVES, MICROCOPY T-142, ROLL

357. December 4, 1866. JOHN V. CURLIN married daughter of A. G. BEATY in 1846; she is deceased leaving one child. A. G. BEATY died in May/June 1861.

401. January 11, 1867. JOHN F. CLARK died January 19, 1867.
/His tombstone at Brown's Cemetery of f Highway 412 bears only his death year, 1867./

462. May 6, 1867. TILDA GREER "a colored orphan and minor" was placed by her uncle under the charge of John W. Gates and he requests to keep her until she reached age 21; allowed by county court.

485. July 2, 1867. WILLIAM HARBERT, late of Texas "has departed this life." Left large personal estate in Madison County worth two to three thousand dollars. Son-in-law, B. A. Hicks, appointed administrator.

502. August 5, 1867. MARTHA B. EPPS died in Virginia leaving a will probated in that state. Edmond W. Hubard appointed executor in Tenn. as well.

504. August 5, 1867. MARTIN MERIWETHER "a free boy of color", minor, then living with H. A. Meriwether, was apprenticed to him until age 21.

525. September 3, 1867. TIMOTHY P. SCURLOCK died May 20, 1867. Page 538:Widow, ANN H. SCURLOCK. Children: JOSEPH W., KATE L., FANNIE B., CLARENCE, ANN F. SCURLOCK.

She was a dau. of Dr. SMITH of Henderson Station and she had a brother, ROBERT SMITH, who had died about six weeks "ago" in Shelby Co., Tenn. where he had lived for many years. His wife had died in 1861, leaving their two children EDWARD HOUSTON SMITH (died 1865) and GEORGE HAMILTON SMITH, whom she had raised since he was an infant; she applied to county court to adopt him which was allowed.

219. August 6, 1869. ELIZA MERIWETHER'S children, JAMES, ANNIE, THOMAS, KATIE and FRANK MERIWETHER had a deposit of about $20,000 in the Bank of Madison, from her husband and their father, FRANCIS MERIWETHER. John L. H. Tomlin was appointed trustee for them.

223. September 6, 1869. WILLIAM McCALL died in the fall of 1860.

225. September 6, 1869. L. E. TALBOT, Madison Co., Tenn. was issued a certificate of good character preparatory to his applying for license to practice law.

Another Pioneer Gone

Wm. Boone, esq., died at his residence in Madison County, Tenn., 29th August 1873. Aged 65 years and 10 days.
He was born in Franklin County, North Carolina on the 19th of August 1808. Moved to Tennessee with his father in the year 1823. Married Lucretia, daughter of William and Jane Doak, Oct. 13, 1831. Was elected one of the Justices of the Peace for Madison County in the year 1845, which office he has continued to hold until the day of his death — twenty-eight years.
In all the relations of life, W. Boon was a good and true man, an affectionate father, a devoted brother, and a friend always steady in his attachments. He leaves a void in his neighborhood, and family circle which no one can fill, and death itself can only obliterate from memory of those who survive him, the tender associations that cluster about his honored name.
