Hudson, Gdn. of Sarah Caroline Pressley vs Samuel Henderson et al.  Joseph Henderson of Monore Co. died Aug 1865 testate; in 1866 Samuel Henderson, bro to Joseph, and F.M. Johnston a nephew petitioned to have said Will set aside and it was set aside.  Orator charges proceedings were fraudulent.  Joseph died without issue.  Samuel Henderson of Monroe Co., John Henderson of Ala.; and Rosannah wife of Benj. R. Sands of Iowa are bros. and sister of Joseph.  F.M. Johnston and Margaret A. and Scynthia Johnston (of Loudon Co. ) are nephew and neices by a dec'd sister, and Wm. Landrum a nonresident, is a grandson of Wm. Henderson who was a bro. to Joseph.  1872; wit. Samuel M. Johnston, 78, says Jospeh's mother was my fathers sister; that Joseph was of unsound mind and had violent attacks even to frighten his father and mother especially the former who lived a long time after the latter's death, and that Samuel Henderson, bro. to Joseph was the only one who could control him; Joseph's father died 18 or 20 yrs. ago, and Saml. took care of Joseph. 1873; wit, R.W. Hudson states that Sarah Caroline Pressley alias Henderson is now living with my present wife who was the widow of Aleck. Henderson, and she has lived with her ever since long before Joseph Henderson died; that he doesn't know whose child she is.  Aleck was bro. to Joseph.  1872; wit. Samuel Henderson, 67, bro. to Joseph, states that Joseph was three or four yrs. older than he and that before Joseph died he lived with bro. Aleck. and Aleck. told him (Samuel) that he need not come to see Joseph that night and he did not go, and the next day found the Will was made; wit. Nancy Henderson, 66, is wife of Samuel.  Will of Joseph Henderson is in another suit, and I copied it.

Scott by his first wife.  Eliza K., James, and Nancy J. Scott by his last wife.  Widow Sarah A. moved to Ark. and recently died; Thomas E. lives Blount Co.; Sarah Ann married Bartley Cannon and lives Blount Co. and said Cannon is dead; Mary Jane married J.M. Lanter and removed to parts unknown; Margaret S. married Alvin Logan and died in Blount Co. without issue.  Eliza K. and James both died young without issue.  Nancy J. moved to Ark. and married Francis M. Spradlin and recently died leaving only child Joseph M. Spradlin.  Widow Sarah A. married Sterling Ragsdale.

Boyd as Comm. to fix boundaries which are: begining at Daniel Heiskell's, Estate of John Ramsey dec'd and I.T. Lenior's corner, thence due N with Danl. Heiskell's line to Sweetwater Creek, thence with Sweetwater Creek to large water oak tree on the W bank of said Creek, and on the E side of the Cumberland Presby. Church; thence N including F.A. Ramsey's lot to the N.E. corner of N.I. Mayes lot upon which he now resides thence the line of said N.I. Mayes to the NE corner of W.L. John Howard, 73, says Benjamin Howard told him that the land belonged to Benjamin's sister Nancy Howard who lived with him and died 5 yrs. before Benj. without heirs, never being married; John is bro. to Nancy and she left only him, Benjamin and sister Sarah Hawkins at her death.

No.422) Filed 14 Apr. 1872. M.F. Johnson, Adm. of Emanuel Smith et al vs Robert Rider et al.  Emanuel Smith was arrested by Federal Authorities last part of 1864, taken to prison in Knoxville where he died 29 Dec 1864.  On 13 Apr 1864 Emanuel Smith made note to Alexander Rider for $100 under following circumstances; Rider claimed that James Smith, son of Emanuel, had taken a mule from him, said James being then connected with the Army, and a minor, and Rider claimed Emanuel was responsible, said claim being accompanied with threats of violence.  One Joseph Divine who was in charge of a squad of men at Madisonville also sent word to Emanuel to pay or he would put him in prison, and Emanuel "knowing the desperate character of Divine and his men" gave the note.  Complainant says James Smith did not take mule, and that Emanuel gave note under duress.  The Complainants are, besides Johnson, Hiram Pearson and wife Sarah formerly Smith, James Smith, John Shadden and wife Martha formerly Smith, Nancy C. Smith, all of Monroe Co., Henderson Henson and wife Susan formerly Smith of Loudon Co., and Silas Pearson and wife Jane formerly Smith of Mo. Rider sued on note and took land.  Alexander Rider's children; Robert R., Austin, Alexander, Saml. R., Elizabeth, Mary, Martha, Salina, Nancy Ann wife of Wm. Hunt, James, William, and Sarah wife of James Peck, all of Monroe Co. except last 3 of Iowa.

Married 9 Feb 1857 in Coosa Co., Ala.  On or about 5 May 1865 they were living in Rogersville when he deserted her and their three children who are minors; she has lived in Monroe Co. for 7 years and he is of Ky.  Witnesses say that S.M. taught school and Sue C. taught music in Rogersville Female Academy.  Letter: 26 Dec 1872, Bowling Green Female College, S.M. Gaines, President, to S.P. Hale, enclosing costs in above divorce case.  Divorce was granted.

Thomas Henley is of Ga.; Samuel Henley born 10 Dec 1836 left State latter part of War and is of Ga. and never returned and his death is proven in Court at the term before Dec 1874.  Charles F. was born 10 Dec 1842, six years to the day after Samuel.

Mullins farm and also of 1/3 int. in farm known as Asa Mullins land.  Anna H. left husband Isaac Stephens Sr., and children; 1.Mary M.E. wife of James M. Love 2. Susan B. wife of Riley Dean 3. Casandra P. wife of John W. Givens 4. Margaret A. Stephens alias Margaret A. Birchfield 5. Cyntha A.R. Stephens  6. Isaac Newton P. Stephens a minor 7. John I. Stephens dec'd whose children are Isaac, Susan, Robert, and Anna Stephens all minors.

 

No.479)  Two Folders.   Filed 3 Sep 1873.  A.H. Gallaher, Gdn of Irene C. Barratt et al vs W.A. Upton et al.  John G. Barratt formerly of Abbeville District, S.C. was killed at Sharpsburg Sep 1862 while a soldier in Confederate Army.  He left Widow E.C. and four children:  Irene C., John P., William P., and Flora P. now ife of T.E.H. McCroskey, all of Monroe Co.  Mrs. E.C. Barratt and her bro. J.T. Parks were app. Adms. in Abbeville Dist. and served until Mar 1867 when Mrs. E.C. married W.A. Upton and the Barratts moved to Tenn.  Upton took over charge of Barratt estate, having himself app. Adm. and also Gdn.  The Wards named above owned negroes given them by their grandmother who was the widow of J.P. Barratt dec'd; they were respectively 5,7,9, and 11 when their mother married Upton;  Flora Pauline Barratt McCroskey is full name,  In S.C. Case the four children are given as Flora, Clifford, John and William.  Wit. Stanmore Brooks in Abbeville Dist. is Grand Uncle of the Barratt children: two of the children are girls so Irene C. must be same as Clifford.  Mrs. E.C. is Elizabeth C.

 

No.480) Filed 4 Sep 1873.  Mary I. Hedgcock vs David C. Hedgcock.

David Supposed to be of Texas.  She had lived Monroe Co. for about 23 years; married 3 Apr 1870 in Monroe Co. He deserted her 23 Jul 1871 leaving her with their infant child Margaret Jane.  Divorce granted.

Gregory died Monroe Co Aug 1872 testate leaving Martha L. as his widow and children: 1. Susannah V. wife of James Helton of Monroe Co. 2. James F. 3. Mary E. of Loudon Co. 4. William R. died without issue in lifetime of father 5. Cora F., Loudon Co, a minor.  Widow Martha had Will probated, attended sales, bought one house and lot, and now is dissenting to Will.

Hudson et al.  In Dec 1832 Samuel Johnston of Monroe Co. sold land ot James Bell and Robert Raper of Wythe Co., Va. and the heirs of John Carter of Monroe Co.   James Bell sold to Mrs. Margaret Carter the widow of John, and the mother of the heirs of John Carter: 1. Mary E. (oldest dau.) wife of M.C. Dibrell (who testifies in Sparta Tenn) and by 1845 she is dead and her 2 or 3 children are dead. 2. Robert Carter 3. F. Bates Carter 4. William Carter ( he may be dead ) 5. Jane C. wife of Sameul J. Rowan of Hill Co., Tex they have been married at least 35 yrs.  Mrs. Margaret Carter was due slaves from her mother's estate in Va.  Mrs. Margaret Carter d. Jun 1864 Monroe Co. and she was insane from 1860 until her death.
