In the name of God - I Martha Weaver of the County of Maury and State of
Tennessee do make and ordain this my last will and testament. First at my
death I ordain and direct that all my Just debts be paid out of my moveable
property after being sold by my administrators Duly qualified. First I
give and bequeath to my Negro Woman called Rachael Her freedom Secondly I
hereby ordain and direct that all the residue of my property whatsoever found
shall be sold by my administrator at public sale on a twelve months credit and
the money arising from such sale shall Equally divided between Benjamin S.
Weaver * Joseph Weaver and John Weaver & ther Ares of my daughter
Mary Weaver Deceased wife of Durham Collins. dec. Tempy Turnce formeley
Tempy Collins & Thomas S. Collins & Missouri Weaver the foregoing Tempy
Turnce & Thomas S. Collins & Missouri Weaver are have one share equally
to be divided beteen them which share is to be equal to that of one of my sons
Benjamin Joseph & John Weaver to James Boon and heirs I will and bequeath
nothing but the tract of Land that I gave said Boon which I think was more than
an equal part I further will and bequeath that the laawful heirs of
Benjamin S. Weaver & Joseph Weaver & John Weaver shall receive said
portion provided either of my sons shall decease before said Legacies are
divided. I furthur will and bequeath that my sons Josph Weaver & John
Weaver shall act as gardin for my negro Woman called Racheal. and I furthur
appoint and direct that my sons Josph Weaver & John Weaver be and are
appointed Administrators of my estate Signed sealed this 26 of October 1835
