James McClain's Will
MARSHALL COUNTY, TENNESSEE

I James McClain a citizen of the County
of Marshall and the State of Tennessee being of sound mind and capable of
disposing of what little worldly goods that I hold or may be entitled to or is
now invested in the hands of those who may be legally appointed to hold for me
as my guardian but being in a low state of health with a malignant disease and
concerning that my dissolution cannot be much longer delayed do in view thereof
do make and publish this as my last will and testament thereby making void all
other instruments of this kind that I may have at any time heretofore made.
In the first place I desire all my jost
debts and funeral expenses be paid out of any money that I may now be possessed
of or which may first come into the hands of my Executor.
In the second place I give and bequeath
unto my beloved Mother, Flora McClain, all the residue of my estate or funds
that is now in the hands of my guardian James A. Neil to be hers and to her
forever in consideration of the care and attention bestowed by her on me during
my in this position or last illness. In
other words, I particularly desire that my Mother be liberally paid for all the
trouble and care she may bestow in nursing and attending on me during all the
times I may have to require attendance in that way.
In the third and last place I hereby
nominate and appoint John Leonard executor to this my last will and testament.
In testimony of all of which I have
hereunto Subscribed my name and affixed my seal the 9th day of
October 1850.

presence of the Testator and at his
particular
instance and request October 9, 1850.

appeared in open Court David McGahey and William D. Bonds subscribing witnesses
to the forgoing will who being first duly sworn in open Court, proved the due
Execution of said Will according to Law.
It is therefore ordered by the Court that said will be included of
record.
From under my hand at office this 4th
day of November 1850.
