Will of James HEMPHILL
Marshall County TN Will Book A
In the name of God Amen I James Hemphill of Lincoln County ans State of
Tennessee Being of sound mind and disposing Judgement and enjoying clamness of
mind do make and declare this to be my last will and testament in manner and
form following & do hereby make all former wills by me made null and void -
first I commit my soul to God who created it & my body to the dust, to be
buried at the discretion of my family - Second I will that my Bural expences be
paid also my Just degts if any. I will that my Lands be divided in the
following manner - beginning at the north west corner of my fifty acres entery
& from thence in a direct line through the center of my barn, thence
eastward from fifteen to twenty five feet so as to leave the fence of the old
field to the western division til lthe Line running along the meanders of said
fence to the corner near a poplar stump.
Thence along the eastern side of said fence to the north east corner of
said fence or field. Thence in a direct Line to Johnsons South boundary,
Leaving as near as possible equal quantities of timber to each dividion of said
Lands in this part. I do hereby bequeath unto my son James Hemphill
the eastern division of said Lands including my two entries. I hereby
bequeath unto my son Jesse Hemphill the Western division of said Lands. I
will unto my wife Elsie Hemphill a comfortable support equally off each
division of the above Lands with the full use and benefit of my dwelling house
and one half of my Orchard ans free access to my Spring including a comfortable
supply of fire wood Laid in the yard during her widowhood. I will unto
her my cow named gentle and sucking calf, forever I also will unto her
one bedstead, bed & bed furniture, my cupboard & funiture, also my
kitchen funiture, also the one half of my sheep. I will and bequeath unto
my son James hemphill above named the other half of my sheep and all my stock
of hogs. I will unto Margaret my daughter my bay mare and three head of
young Cattle also one bedstead, bed & bed clothes - I bequeath unto my sons
John Hemphill, William Hemphill, Robert Hemphill and Nathan Hemphill and my
daughters Esther Hemphill, Jane Bell, Martha Williams and Mary McNight each two
dollars. I do hereby declare this to be my last will & testament in
manner and form as above; done this thirteenth day of February in the year of
our Lord one thousand eight hundred & thirty six, and of the independance
of the United States of America the sixteenth. Signed sealed delivered in
