Marshall County Tennessee Will Book A

pages 315 & 316

 

     I, Bethena Boyett, do make and publish this as my last Will and Testament, hereby Revoking and making void all other wills by me at any time made.

     First, I direct that my funeral Expenses and all my Debts be paid as Soon after my Death as possible out of any Money that I may die possessed of or may first come into the hands of my Executors.

     Secondly, I give and bequeath to my beloved Sister, Alsey Jackson, One Hundred Dollars, one feather Bed and one half my bed Clothing to be paid by my Executor out of the Money my two Grand Sons, Jesse Boyett and Josiah Boyett owe for land I have sold to the said Jesse Boyett and Josiah Boyett.

     Thirdly, I give and bequeath to my beloved Brother, Jesse Boytt, Five Dollars.

     Fourthly, I give and bequeath the balance of my Estate to be equally divided between my beloved Brother, James Boyett, Eliza Boyett, the said Jas Boyett's wife - Zilpha Boyett, Daughter of the aforesaid Jas Boyett, Jesse Boyett, Son of the said Jas Boyett, Josiah Boyett, Son of the said Jas Boyett, Edith Boyett, Daughter of the said Jas Boyett, Chelly Jane Boyett, daughter of the said Jas Boyett, Jas Eth[???] Boyett, son of the said Jas Boyett, Benjamin Franklin Boyett, son of the said James Boyett and William Thomas Boyett, Son of the said Jas Boyett.

     I do hereby nominate and appoint Allen C. Tucker my Executor.

     In Witness whereof I do to this my Will Set my hand and seal this 4th of July 1853.

Personally appeared in open court Hugh Huston and William S[not legible], subscribing witnesses to the within will, who, after being duly sworn here in open court proved the due Execution of Said Will as the law directs.

Witness my hand at office this 5th day of September 1853
