The Last Will and Testament of L.B. Sartain, So. Pittsburg, Tennessee.

I – L.B. Sartain, of So. Pittsburg, Marion County, Tennessee, being of sound mind and disposing memory, do hereby make, publish and declare the following as and for my last will and testament.

1 – I direct that all my just debts be paid as soon after my death as can conveniently be done.

2 – Mother now deceased 5/25/27 [sic? or 5/25/21? see date of will].

3 – I give and bequeath to my wife Mrs Helen K Sartain, for and during the term of her natural life, my residence, or home place, in So. Pittsburg, Tennessee, together with the furnishings therein and the remainder interest therein, I give and bequeath to my three Sons, L. B. Sartain Jr, Dennis Sartain and Joseph Sartain, equally, share and share alike.

4 – All the rest residue and remainder of my estate, real, personal and mixed, whiver [sic] situated, including the life insurance payable to my estate, I give and bequeath to the trustees hereinafter named in trust, to be held and used and managed by them for and during the duration of the trust, as hereinafter set out, for the benefit and support and maintenance of my wife, Mrs Helen K Sartain, during her life, and my children and the education of my children and for these purposes The Trustees may use all or such part of the income from this trust estate as may be necessary. Or if in the judgement [sic] of the Trustees, it should be necessary or desirable to use any part of the body of the trust estate for such purposes, they shall have the right to do so. The Trustees shall have the right absolutely, to sell, transfer and convey any or all of the trust estate, or to convert the same into other property, and to hold and manage the same as they may deem to be the best interest of the trust estate.

5 – I hereby name my wife, Mrs Helen K Sartain, my Son L. B. Sartain Jr. and A. A. Cook of So. Pittsburg, as Trustees, to take and hold the trust estate, as above provided, and the action of a majority of the Trustees will determine in all questions.

6 – The said trust will cease and determine on upon the death of my wife Mrs Helen K Sartain, unless my youngest Son Joseph Sartain, shall not then have attained the age of 21 years, in which event, it will continue until he shall become 21 years of age, when it will cease and determine, and the balance of the said trust estate then remaining, I give and bequeath equally and share and share alike, to my three Sons, or their heirs and representatives, L.B. Sartain Jr, Dennis Sartain and Joseph Sartain.
7 – I hereby nominate and appoint my Son L.B. Sartain Jr as executor of this my last will and testament, and excuse him, as well as the Trustees hereinbefore named, from giving any bond as such. In witness whereof, I have hereunto subscribed my name in the presence of Alan S. Kelly and S.T. Anderson, whom I have requested to become subscribing witnesses hereto, this the 8th day of January, 1923, at So. Pittsburg, Tennessee.
