This is the WILL of Isaac Columbus Flat, Sen. The WILL is typed out exactly how it looks, including the misspellings. Any words that could not be made out, a line will be drawn. Known all men by these presents that I Isaac Flat sen. A farmer, of the County and State aforesaid and conserning the uncertanity of human life, and the sertainty of death and being in my propper mind and frilly competent to transact and understand my business. Do make and publish this my last will and testament. First my will is that my children survive me as soon after my decease as is convinant bury me decently at the place set apart for that purpass on the oppossite side of the creek from where I now live. Also my will and desire is that my wife be buried at the same place when she depart this life if that be her desire. And I desire that all my just debts be paid if any. And after this is all done. My will and desire is that my wife retain possession. Possession of the farm ____it in a way that it may render her a comfortable support the remainder of her natural life, and at her death, my will is that my propperty real an personal. Be divided between or among my ten children as follows. First I will and bequeath to my son William H. Flat five dollars out of my estate and that is all that I desire that he shal heir or have out of my estate. And further my will and desire is that my son Jones H. Flat shall heir or have ten dollars. Out of my estate. And he being dead and _____away my Executor will pay the ten dollars, that I will to Jones H Flat to his widow Miriam Flat, and his heirs to wit Tennessee Julin, Milly Maberry, Sarah Brown, Pairlie Maberry, B.A. Flat, Josee Lane, Alsa Lane, Dicy Lane, and Isaac Flat Jr. heirs at law of Jones H Flat and they can divid the ten dollars among themselves in the way that best soots them, and my will and desire is that my other eight children shall in hear equal in the division of my estate to wit John M. Flat, George W. Flat, Isaac C. Flat Elizabeth Pairlee Dorrity, Amanda Jane Brown, Mary Margaret Brown, Thomas M Flat and Alsa Sarah Lock.

It is my will and desire and I hereby appoint my son Isaac C Flat, my Executor to wind up my Estate and see that each one of my heirs receves their respected shears or parts according to my WILL.

I am of the opinion and belief that my farm is ____ able of being divided into four divisions and each one will mak a small but comportable home, and it has just bin divided into the four divisions by three disinterested free holders to wit A.D. Maberry, W.A. Ragland and John H. Davidson who has put a valueation on each one of the places or farms, and also set. Each one out by meets and bounds which is substantially as follows towit Lot 1 or the tract including the manson and out building where I now live bounded as follows Beginning on G. W. Flat. North boundery line ____North 36 pas to an apple tree. Thince North _ East 13 pas to ___, thence north 48 pas to a stake in the Davidson old line. Thence west 14 pas to a mulberry at the edge of the yard. Thence north 9 E up the __54 pas to the Richmond or Fox line, thence west with the same 76, Thence South 74 ? pas to a hickery in top of the ridge. Thence East 26 pas to a stake with two poplar pointers. Thence South 54 pas to a chestnut and sassafras Lane's corner. Thence East 104 pas to begin containing 102(4) acres. Which was valued by the above named Commissioners at one thousand dollars. And it is my will and desire that my son John M Flat shal won the above ____tract or parcel of land and he will pay to others seven heirs the amount that is required from him to make them equal with him in my Estate. Lot 2 bounded as follows towit beginning on alanthis (?) tree near the Spring and running west 14 pas to a mulberry near the yard. North 9-East 54 pas. To the Richmond line, then East 14 pas to the creek and up the same north 40____? Pas. North 66-East 8 pas, East 8 pas, North 75 East 36 pas, south 75 (or 15?), 8 pas, North 74-East 23 pas, North 85 East 86 pas. South 60-East 41. 90 pas to a stake. Then a South west course along the hill side so astrem(?) below a price of good land which is to belong to the ridge tract to a burch near the fence. Then south 45-west-18 pas to a burch. Then west 60 pas to beginning, containg 68 acres and valued by the above named Commissioners at three hundred dollars and it is my will and I hereby bequeath to my daughter, Alsa Sarah Lock the trat of land just described which is lot 2 in the division. And she is here by required to pay the other seven heirs the amount sufficient to make them equal with her in the division of my estate according to my _____. Lot B bounded as follows to wit Beginning on a stake in George W. Flat North boundry line and running with the East boundry of Lot 1-North 9 East 86 pas to an apple tree. Then North 51 east 12 pas to a stake. Then North 48 pas to the south bordering of Lot 2 and with the same East 60 pas to a burch then North east 18 pas to a burch. Then with the south boundery line of Lot to the East boundery of the original tract. Then South with west boundery of Lot 2-49 pas to a stake with Black ook? And Bac? Pointers their down the hallow. South 43-west 24 pas to a stake. South 70-west-20 pas to a stake-South 76-west 16 pas to a stack. Then South 50 west 41 pas to a rock Davidson corner and wi__ line North 68-west 7 pas to a small dogwood.

South 67 west 14 pas stake, South 64 -west 6 pas to top of ridge ten west 30 pas to beginning. Containing 52 acres and valued by the above named commissioners at two hundred dollars. And it my will as I hear by bequeath unto my son George W. Flat that tract of land discribed on lot 3-in the division and He is required to, the other seven heirs the amount required to make ther equal with him in my estate according to my Will.

Lot 4-as set apart is bounded as follows towit beginning on a small burch near the edge of the old ridge field and a bit south of the south east corner on Lot 2 and North East corner of Chestnut corner and with his line South 78-East 6 pas. South 38-East 4 pas. South 20-East 20 pas. To a bunch of black walnuts South 14 pas. South 12-East 8 pas. South 3?-west 36 pas to the widow Chaffin line a buckeye and with her line South 24-East 19 pas to a stake South 82 !/2-East 6 pas to a stake two burch pointers South 22-East 36 pas South 14 pas to the old fense row, west 18 pas to a maple, then with Isaac C Flat Jr, line with its various meander to a rock Davidson Corner also corner to Lot No 3-and with the East boundry of Lot 3-to the beginning containing 76 acres as valued by the above named commissioners at three hundred dollars and it is my will and desire and I hear by bequeathing unto my son Isaac C Flat Jr. the tract of land just discovered which is Lot 21 (?) as set a part and valued by said commissoners and he is required to pay the other seven heirs the amount sufficient to make them equal with him in the division of my estate according to my WILL. It is further my WiLL and I hereby require the heirs at law in my estate to give John M Flat, George W Flat, Isaac C Flat Jr and Alsa Sarah Lock one two or three years to pay for their shears and lots that I WILL or set apart to them byi them paying the legal intrest on the several amounts going to them.

And further it is my WILL and I hereby set apart one acre which I dedicate and give out of my lands as a family grave site at the place across the creek from the house and I also give the right of way to the said grave yeard for persons to and from said grave yard that it may be protected improved and beautified as much as is necessary.

This is the FINAL SETTLEMENT to the WILL of Isaac Columbus Flat, Sen. County, Tennessee. I transcribed the document as it originally appears. (Note: the last name in the WILL that Isaac wrote up says FLAT, here in the Settlement they spell it FLATT).

I, G.B. Settle, Deputy Clerk of the County Court of Jackson County Tennessee have on this the 3rd day of April 1915, at my office in the town of Gainesboro Tenn., proceeded to make an Executors settlement with Isaac C Flatt, Jr,. as Executor of Isaac Flatt sen. Deed., and to state an account of the same, which is the words and figures following towit: all of which is respectfully submitted to the April term of this Court 1915. The heirs were notified as required by law, of the time and place of making said settlement.

There was no personal property belonging to the estate, except that which was exempt, which went to the widow at the death of Isaac Flatt, sen (see Report of Isaac Flatt Jr., Executor, Wills book, #? "C" page 430.)

The landed estate of the deceased Isaac Flatt sr. was divided by him before his death, into four lots. And a valuation placed on each lot or tract, and in his will he designated the four children that should have the above lots, and the valuation on same, as follows: Lot 1. Valued at one thousand dollars, and willed and bequeathed to John M. Flatt: he to pay the other seven heirs an amount sufficient to made them equal with him in said division, which would be $775.00. Lot 2. Valued at $300.00, and bequeathed to Alsa Sarah Lock, she to pay the other seven heirs an amount, sufficent to make them equal with her in said division, which would be $75.00, by agreement of all the heirs the said Alsa Sarah Lock, was to be given the amount she owed on her lot, $75.00, for staying with and taking care of the deceased Isaac Flatt and his wife during the last twelve months of their life. Lot 3. Valued at $200.00. and bequeathed to Geo. W. Flatt, and he was to be paid by the other heirs $25.00 to make him equal with them. Lot 4. Valued at $300.00, and bequeathed to Isaac C. Flatt Jr. and he is required to pay the other seven heirs an amount sufficient to make them equal with him in said division, which is $75.00.

There were ten heirs named in the will of Isaac Flatt sr. as follows to wit: William H. Flatt, Jones H. Flatt, John M Flatt, Geo. W. Flatt, Isaac C. Flatt Jr, Elizabeth Pairlee Dorrity, Amanda Jane Brown, Mary Margaret Brown, Thomas M. Flatt and Alsa Sarah Lock. William H Flatt was to have only $5.00, and Jnes H. Flatt or his heirs were to have only $10.00 out of said estate, the other eight heirs to share equal in said estate. (See Will, recorded on wills book "E" page 45)

One receipt from D. A. Lane, for $1.10, her interest in the estate of Isaac Flatt, decd. As heir of Jones H. Flatt, dated Oct, 4, 1898.

One receipt from A. D. Lane for $1.10, her interest in the estate of Isaac Flat, decd,. As heir of Jones H. Flatt, decd,dated April 15th. 189____.

One receipt from Josie Lane, for $1.10, for her interest in the estate of Isaac Flatt, decd. As heir of Jones H. Flatt, decd, dated March 26, 1900.

One receipt from B. A. Flatt for $1.10, his interest in the estate of Isaac Flatt decd. As heir of Jones H. Flatt decd, interest in the estate of Isaac Flatt decd. Dated June 5, 1899.

Amount paid William H. Flatt:

One receipt from W. Flatt, for $5.00, is interest in the estate of Isaac Flatt, decd, dated March 22,1898.

One receipt from W. M. and M. J. Brown for their interest in the estate of Isaac Flatt sr. decd. Dated December 26, 1899.

One receipt from T. M. Flatt for $215.62 1/3 his interest in full in the estate of Isaac Flatt sr. decd. Dated Dec 29, 1899.

One receipt from G. W. Flatt, in full of his interest in the estate of Isaac Flatt decd, dated Sept. 27th. 1899.

Amount paid heirs of Elizabeth Dorrity:

One receipt from Mariah Sneed her interest in full in the estate of Isaac Flatt decd. Dated April 12th. 1901.

One receipt from J. M. Carter, Lizzie Jolly and Tom McKinney, for their interest in full in the estate of Isaac Flatt, decd. Being heirs of Elizabeth Pairlee Dorrity, dated Jan 20, 1901.

One receipt from J. W. McKinney, for his interest in the estate of Isaac Flatt decd. He being a heir of Elizabeth Pairlee Dorrity, dated Feb. 2, 1904.

Amount paid to their heirs of Mary Margaret Brown:

One receipt from Frank Brown for his interest in full in the estate of Isaac Flatt decd, as heir of Mary Margaret Brown, dated March 2, 1903.

One receipt from J. M. - F.I. and J.L. Brown heirs of Mary Maragret Brown, for their interest in the estate of Isaac Flatt decd. Dated February 13, 1901.

One receipt from Davy Lee Brown, heir of Mary Margaret Brown, for his interest in the estate of Isaac Flatt decd. Dated Feb 2, 1904.

Mary Margaret Browns part of the estate of Isaac Flatt decd. According to the will of the Isaac Flatt decd. Is $225.00, but after paying her part of the $75.00 to Alsa Sarah Lock, as stated above in this settlement, she would be entitled to $215.62. The said Mary margaret Brown is now dead, and has now surviving her nine children, and the following named five have been paid their prorata part of said estate towit: Frank Brown: J.M. Brown: F.I. Brown: J. L. Brown: and Davy Lee Brown, leaving the four following named hiers to wit: Laura Brown: Thomas Brown: Ella Brown and Jennie Brown. Who are to be paid their prorata part of said estate ($107.81) less their part of the cost of this settlement etc, $2.25, leaving $105.56, to be divided among the four last named heirs. To wit:

Laura Brown, prorata share $26.39

Thomas Brown, """""" $26.39

Ella Brown, """""" $26.39

Jennie Brown, """"""" $26.39

The amount of $105.58 is this day paid into the Court by Isaac C. Flatt, Jr. to be equaly divided among the above named four heirs, and the Clerk hereby acknowledges receipt of same.

The cost of this settlement was paid by Isaac Flatt Jr.

Isaac C. Flatt, Executor, also pays into the Court $1.19, the amount going to Tennessee Juilian's heir of Jones H. Flatt decdl which amount will be set up on prorata sheet.

The tract of land, or lot 1, above refered to, bequeathed to John M. Flatt, was deeded by him to Isaac C.Flatt, the executor, who paid the $775.00 which was going to the other seven heirs.
