John J. Walker's Will
State of Tennesse
County of Warren
Know all men by these present
that I, John J. WALKER, citizen of the County of Warren and State of Tennessee,
being in good health of body and disposing memory now in my seventyfirst
year of my age and calling to mind the mortality of my body and that it
is appointed for all men once to die to make and ordain this to be my last
will and testament and as to what of this world's effects it has pleased
God to bless me with and to save trouble and confusion, I bequeath and
dispose of the same in the following manner and for (to wit):
Principally and first of all
I give and bequeath to my beloved wife, Elizabeth WALKER, whom I constitute
my Executive of this testament my Mansion house with my apple orchard with
the hothouse down by the meadow including the kitchen and smokehouse with
the kitchen cupboard & funiture during her natural life or widowhood.
It is also my will and desire that my said wife have a comfortable and
decent maintainance to be raised yearly out of the proceeds of my land
and plantation.
It is my desire that my son,
William Spears WALKER, whom I constitute my executor with his mother &
my son, John James WALKER, have the whole of my land at their mother's
death and the peaceable enjoyment of it from the present but bound from
the above incumbrance and to keep the same in good repair the said lands
to be equally divided them with due regard to quantity, quality and convenience.
It is my will that they each have a horse beast a saddle and bridle worth
a hundred dollars also a good bed and furniture each when they come of
lawful age. It is my will that no trade bargain or contract be made
so as to alter the right of the above land one year during my wifes natural
life.
My daughter, Sarah BOST, having
been provided for already, it is my will that she have a horse beast worth
seventyfive dollars and a saddle at the direction of my executors as to
value.
It is my desire that my daughter,
Silena WALKER, have a horse worth seventyfive dollars, one bed and furniture,
a saddle and briddle to be equal with her sister, Sarah, to be hers when
she becomes of age.
It is my will and desire that
my wife, Elizabeth, have in addition to the above a good horse beast as
is in the farm and a cow and calf both horse and cow to be of her own choosing.
It is my will that all given in my lifetime after the first day of March,
1838, that is mentioned as a part of the legacies above named the value
of them be accounted for in a final settlement of my estate & it is
my will that my wife have in addition to the above, my family bible &
it is my will that after my just debts and funeral charges is paid that
all my cash in hand and notes and accounts be equally divided between my
wife and four children above named with the residue of my personal estate
the same to be divided without any male, and by these presence I do ratify
and established this to be my last will and testament with the executrix
and executor.
I hereby revoke all former wills,
legacies or bequeaths by me made or ordained or any Executors by me appointed
before these here named.
Signed, Sealed on the 31st day
of May in the year of our Lord one thousand eight hundred and thirty eight
in presence of us who in his presence and in presence of each other here
set our names.
