Jermiah Walker's Will
I, Jermiah WALKER do make and
publish this as my last will and testament hereby revoking and making void
all other wills by me.
First, I direct that my funeral
expences and all my just debts be paid as soon after my death as possible
out of any monies that I may have possessed of or may first come into the
hands of my executor or Administrator.
Secondly, I give and bequeath
to my beloved wife Polly WALKER her daughter and their increase one gray
mare and one womans saddle two beds one bedstead and bureau to be hers
forever als to have posession of my mansion house I now live in and to
be supported of the proceeds of the place during her natural life or widowhood.
And thirdly, I have nothing
more to give my son Wm. C. WALKER because I have given him his portion
in lands & other property and
Fourthly, I have nothing more
to give to the heirs of Jaems H. WALKER, dec'd.
And Fifthly, I give and bequeath
to my daughter Nancy WILLIAMS (KILLIAN) the
tract of land at the big spring that shs is now in possession of and not
to be sold from her without her approbation and the reason why I give her
no more is because I have given her portion in money & property.
And Sixthly, I have nothing
more to give to my daughter Martha McGEE for I have given her, her portion
in a negro woman money and other property.
And Seventhly, I have nothing
more to give to the heirs of my son, John B. WALKER, dec'd, for I have
given him his portion in his life time, in lands, money & other property.
And Eighthly, I give and bequeath
to the heirs of Annah KILLIAN deceased my daughter fifty dollars, a piece
and the reason I give no more is because I gave her her portion in her
life time in money & other property.
Ninthly, I give and bequeath
to the heirs of Sarah LOCKHART dec'd. my daughter fifty dollars she having
rec'd other in her life time.
Tenthly, I give and bequeath
to my son Jeremiah A. WALKER the whole of the tract of land that he now
lives on but if he dies without issue the land to be sold & the money
to be equally divided among all of my heirs.
Eleventhly, I give and bequeath
my two sons to wit: Francis M. WALKER & Isaac E. WALKER all the
tract of land I now live on with two tracts of mountain land adjoining
it to wit: two hundred & fifty acres be the same more or all
of it except one acre where the graveyard & meeting house now is I
reserve for public use with all the property of every discription both
out of doors and in the houses with all the money I may leave except those
I have given to my wife and except two hundred fifty dollars of this property
to be sold if no money on hand to pay the heirs of the heirs of the two
daughters above named Dec'd and again except one bed and furniture and
one cow to Margaret WALKER that I am now raising when she is of age or
marries. I give my negro man Joseph to Francis M. WALKER my so, and
I give my negro woman Elviry to Isaac E. WALKER , my son, and I give Robert
my Negro man to both of them jointly to take care of until death, and if
one of the boys dies, before they are of age the other to have his share.
Lastly, I do hereby nominate
and appoint Polly WALKER my beloved wife my guardian without having to
give any security for the two boys until they are of age or manage their
property for them and also my Executor or Administrator in witness where
of I do hereby set to this my will my hand and seal this the 25th of October
1854.

Know all men by these presents,
that I Martha KILLIAN of the County of De Ralb State of Alabama have made
constituted and affirmed and these presents do make constitute and affirm
Daniel KILLIAN of the same county and State my true and lawful attorney.
For me and in my name place and stead to demand ask for, collect, and receive
all sums of money that may be due or coming to me from the estate of my
grandfather Jermiah WALKER deat late of Warren County State of Tenn.
Granting my said attorney full
power and authority to do and preform all and every act and doing what
is necessary to be done in and about the premises as fully to all intents
and purposes as I could do if personally present. Hereby ratifying
and confirming all that my said attorney shall do or cause to be done by,
witness hereof In testimony whereof I have have here to set my hand and
affixed my seal this the 13ths day of October A.D. 1857

KILLIAN whose name appears signed to the above and foregoing Power of Attorney
and acknowledged that the signed sealed and delivered the same on the same
day the purposes therein contained given under my hand and seal this the
15th day of Octobert A.D. 1857

of said Count and the keeper of the seal thereof do hereby certify that
James PARKER whose name appears signed to the fore going certificate of
acknowledgement is and was at the time of signing his name an acting Justice
of the Peace in and for said County duly commissioned and qualified and
that full faith and credit are due to all his official acts as such I further
certify that his said signature is genuine.
In testimony where of I have
set my hand the orricial seal of said County done at Lebanon Ala. this
12th Oct. 1857.
