Soldier’s Application for Pension

I,   Jonathan W. Nichol a native of the State of Tennessee   and now a citizen of Tennessee resident of Murfreesboro in the County of Rutherford and who was a soldier from the State of Tennessee in the War Between the United States and Confederate States, do hereby apply for aid under the Act of the General Assembly of Tennessee entitled “ an Act for the benefit of the indigent and disabled soldiers of the late war between the States, and to fix fees of attorneys or agents for procuring such pensions, fixing a penalty for violation of the same and amendments thereto.” And I do solemnly swear that while in the discharge of my duty in the service of the Confederate States or United States as a member of Smith’s Fourth Tennessee Cavalry Commanding Co. “G” in said regiment. I was wounded in battle or battles of General Wheeler’s raid on Fort Donelson in Feb. 1863 and in the Battle of Bentonville. N. C. March 21, 1865 or contracted the following disease or disabilities to wit: And from these wounds and exposure during service in this war. Suffering severally at times with piles etc. and that by reason of such wound and disability   I am now entitled to receive the benefit of this Act. I further swear that I do not hold any National , State, or County office, nor do I receive aid or pension from any other state or from the United States, and that I am not an inmate of any soldier’s home and that I am unable to earn a reasonable support for myself and family. I do further solemnly swear that the answers given to the following questions are true:

When did you enlist and in what command? Give the name of the regimental and company officers whom you serving under at the date of wound or other disability.

Answer-May 22, 1861 18 th Tennessee Infantry after the Battle of Shiloh April 6, 1862 by permission came back to Tennessee and ----Cavalry Co. which was Co. “G” Fourth Tennessee “Smith’s” Regt. Lieutenant D. L. Youree, F. A. McKnight

What was the precise nature of your wound or disability?

Answer-At Fort Donelson through left arm breaking side out breaking out under shoulder blade. Bentonville through left side penetrating lower lob left lung.

What limb, “if any, did you lose by reason of said wound or wounds, and if no limb, state fully your disability, and if contracted in service, is said disability permanent?

Answer-Did not lose a limb   but from wounds and exposure while in service. My disabilities are permanent.

Were you incapacitated for service by reason of said wounds or disability?

Answer-Only for a few weeks each time

Were you discharged from the army by reason of said wounds or disabilities?

Answer-No

If discharged from the army, were you and what did you do until the close of the war?

Answer-Remained in service until close and surrendered

What was the name of the surgeon who attended you?

Answer-Dr. William Walters Acting Assistant Surgeon of the regiment [1 st wound] and Dr. Delaney Surgeon of the regiment [2 nd Time]

How did you get out of the army, when and where?

Answer-Paroled at Charlotte, North Carolina May 3, 1865

Answer- Did you take the Oath of Allegiance to the United States Government?

Answer- No

If so, when under what circumstances?

Answer-

Are you married or have you been married?

Answer-am married

What is the size of your family living together?

Answer- Wife and two children

What are the respective ages of your wife and the children living with you?

Answer-Wife 58   26 & 10 years

To what sex do your children belong?

Answer- Females

Are not some of your children able to support you?

Answer- They are all gone west, except the two girls

In what business are you now engaged, if any and what do you earn?

Answer-Canvassing with goods on Commission but little or owing to time able to work

What estate have you in your own right, real and personal and what is it value?

Answer-  None atall

What estate has your wife in her own right, real and personal and what is its value?

Answer-None Atall

How have you derived support for yourself and family for the last five years?

Answer-By traveling with ---unreadable--on commission and wife sewing

Do you use any intoxicants to exist?

Answer-None atall

How long have you been an actual resident of the State of Tennessee?

Answer-All my life

Have you an Attorney to look after this petition?

Answer-None

 Personally appeared before me G. H. Wilkerson Clerk of the Courts of Said County, the above named J. W. Nichol, the applicant with whom I am personally aquatinted and having the application read and fully explained to him as well as the statements and answers therein made oath that said statements and answers are true.

           Personally appeared before me G. H. Wilkerson Clerk of said County the above named J. B. Murfee one of the witnesses to the foregoing application and who is a physician in good standing and being duly sworn say that he has carefully and thoroughly examined J. W. Nichol , the applicant and find him laboring under the following disabilities;

Gunshot wound of the left chest, the ball passing through the lower portion of the left lung. Also a gunshot wound of left arm 6 inches below the shoulder fracturing the bone of the arm. These wounds disable him from active manual labor. He also has piles both internal and external which pains him a great deal and very often. They frequently bleed profusely. His disability equals a lose of a limb.

If possible the two witnesses as to character should have served with the applicant in the army and if so let them state in their oath: also any other information regarding applicants army service.

Personally appeared before me G. H. Wilkerson, Clerk of Courts of said County the above named, L. M. Roberts and A.C. Good, two of the subscribing witnesses to the foregoing application with whom I am personally aquatinted, and known to be citizens of veracity and standing in this community and who make oath that they are personally are acquainted with the foregoing applicant and the facts set forth and statements made in this application are correct and true “ to the best of their knowledge and belief and they have no interest in this claim, and that said applicant’s habits are good and free from dishonor. And They further makes oath to the following facts touching the applicant’s service in the Confederate army.

We both served with Capt. Nichol during the war. We was in his company and can conservable say he made a good and gallant soldier never shirked duty in any ---. Since the was he has made a good and true citizen. He needs the help he asks for from caring standpoint of right and justice

            The records show that J. W. Nichol, Captain, Company G, 8 th (also called   4 th) Tennessee Cavalry C. S. A. enlisted September 27, 1862, at Bardstown, Kentucky, to serve three years, and that he was present with his command June 30, 1863, the date of the last muster roll of company file. Nothing has been found of record to show that he was paroled or released from any military prison or post.

            Personally appeared before me George B. Guild who makes oath that he was adjutant   of the 4 th Tennessee Cavalry [Col. Smith’s] Regt. That he was surrendered with the army of Gen. J. Johnston, at Greensboro, N. Carolina and was paroled at Charlotte, N. Carolina, May 3, 1865. That he is well acquainted with Capt. Nichol of Co. G,   4 th Tennessee Cavalry Regt. [Smith’s] that he [Nichol] was desperately wounded   at Bentonville, N. C. just before the surrender and that to the surprise of the everyone, he returned to the Regt. And was surrendered with the Army at Greensboro, N. C. and paroled at Charlotte on the 3 rd day of May 1865, with his Company and Regt. Applicant further knows the fact that he was one of the best and most faithful soldiers in the Army of Tennessee.
