Notice to Applicants

The Widow’s Pension Law, passed by the Kentucky Legislature, provides for the widows of soldiers only, and they must have been residents of the State of Kentucky since January 1, 1907.

Widows must have been married prior to 1890.

To be eligible the applicant must have remained a widow after the death of her soldier husband, and must be indigent.

Read the questions in the application carefully and answer them fully.

Read the law, and unless you come clearly under the laws it will be useless to file application.

 Samantha Ann Barnes …….of said State and County, desires to avail herself of the pension allowed to Indigent Widows of Soldiers, General Assembly, approved March 11, 1912, hereby submit her proofs and after being duly sworn true answers to make the following questions , deposes with answers as follows:

1. What is your full name and where do you reside? (Give a State, County and Post office)

Samantha Ann Barnes, PO. Station at Somerset, County of Pulaski, State of Kentucky.

 2. How long and since when have you been a resident of this State? Twenty-three years

 3. When and where were you born and what was your maiden name?

Franklin County, Tennessee        March 31, 1850        Samantha Ann Short

 4. When and where was your husband born---state his full name, and where you and he were married, and who preformed the marriage ceremony? Born in Franklin County, Tennessee.      George S. Barnes married at company station on the Nashville and Chattanooga          R. R.   Rev. Parson Jones.

 5. When and where and in what Company and Regiment did your husband enlist or serve in during the between the States? Do not know

6. How long did your husband serve in said Company or Regiment? Do not know

 7. When and where did your husband Company or Regiment surrender? Do not know

 8. Was your husband present at the time and place where his Company or Regiment surrendered? Do not know

 9. If not with his command at surrender, state clearly and specifically where he was, when he left command for what cause and what authority? Do not know

 10. When and where did your husband die? At the hospital at Cincinnati, Ohio about 18 of March

 11. At this time of your husband’s death were you living with him as his lawful wife? Yes

William Hudson and Schuyler Haid of said State and County having, been present as a witness in support of the application of Mrs. Samantha Ann Barnes for a pension under Confederate Pension Law, approved March 11, 1912, after being duly sworn, true answers to make the following questions, disposes and answers as follows.

1. What is your name and Post office address? William Hudson, Cynthiana, Kentucky

2. Are you acquainted with the applicant, Mrs. Samantha Ann Barnes……………Yes

 3. Where does she reside, and how long since when has she been a resident of this State?

Somerset, Kentucky and has been a resident of Kentucky since 1889 to my knowledge

 4. Were you ever acquainted with her husband?    Yes

5.were either present at their marriage?     No

 6. How long did you know him? About one year

7. When and where did George S. Barnes enlist in the War Between the States, and what Company and Regiment did he enlist, and how do you know that?   Do not know

 8. Were you a member of the same Company and Regiment at the close of war?   No

 9. How long did he perform military duty?    Don’t know

 17. Do you know of your own knowledge that the applicant is the lawful widow of …….

George S. Barnes……..Yes and they were living together as husband and wife to the date of his death.

 18. Has she remained unmarried since her soldier’s husband death, and is she a widow? Yes

19. What property effects or income has the applicant, if any and how do you know this of your own knowledge?   None       and well acquainted with her and her circumstances.

I, Elias Haid Notary Public, in the and for said county, hereby certify that the applicant, Mrs. Samantha Ann Barnes   resides in said county, and has been a bona fide resident of this state since the 1 day of January    1900 and that the witnesses William Hudson and Schuyler Haid are of trustworthy character, and that their statements are entitles to full faith and credit.

I do further certify that before answering the foregoing questions the applicant and said witnesses took the oath here in prescribed, and the full test of the affidavits was read to the applicant and witnesses before the same was signed and subscribed.

Note----1.   Before any question are sworn, the Clerk or Notary shall swear applicant and the witnesses in the interest of and solemnly swear that you will true answers made to each of the questions asked of you and the evidence you give will be the whole truth so help you God.  

2. Additional affidavits may be attached if blank spaces are insufficient

3.   All affidavits must be made before an officer of the court.

4. Only widows who were the wives of soldiers need apply and now widows. Those married before 1889.

5. Two witnesses are necessary to make out claims.

6. Attach certified copy marriage license in every case or get -----of Clerk of Courts, under and seal--------office duly certified by officiating minister or the affidavit of the witnesses present at the ceremony, or the affidavits of two witnesses who know that they have been man and wife prior to January 1, 1889 and were living together at the time of his death.

                        Under last Legislature act of Kentucky indigent Confederate Soldiers or their widows, under certain conditions, could obtain a pension. Am trying to obtain the date and facts to make application for widow of George S. Barnes who was a member of Company A, 4 th Tennessee Cavalry, Baxter Smith Col., D. W. Alexander, Capt, (1st Tennessee Regt. 1861) and my information is George S. Barnes was a prisoner of war in Fort Delaware. I understand this fort has been dismantled and that you have the records.

            Will you please, to help a poor widow, write me such facts as you find on record, particularly George S. Barnes’ release from prison.   It will help this poor woman to the extent of $10.00 per month. Thanking you in advance, I am

Barnes, Private, Company A, 8 th Tennessee Cavalry, also known as 4 th Tennessee Cavalry, Confederate States Army, enlisted June 1, 1863 at Williams Mill, was captured near Pelham, Tennessee July 10, 1863, date and place of capture also shown as July 7 or 6, 1863 on Cumberland Mountains: was imprisoned at Fort Delaware from March 3, 1864 to June 10, 1865, and that on the last named date he was released on taking the oath of allegiance.

Is Petition, Ex Part

                        The application of Samantha Ann Barnes was this day presented to the court under the laws of the State of Kentucky granting pensions to widows of Confederate Soldiers in the war of Rebellion, and states that the application seems to have been duly and regularly filed on March 11, 1913, and the Courts after hearing the evidence produced and being advised returned the following findings, to wit:

            The applicant herein, Samantha Ann Barnes is the widow of George S. Barnes who served in Company “A” 8 th Tennessee Cavalry. That the applicant is old and infirmed and that she incapable in laboring in whole or in part for her support. The following witnesses were introduced and after being duly sworn their testimony is sufficient of said findings is as follows:

            R. J. Jackson and John Stringer state that they have known the applicant for several years and that she has no earning capacity -------and is old and infirmed. In view of the above finding this Court must respectfully recommends that the applicant herein be granted, and have the applicant placed on the rolls as pensioner under the laws of the State of Kentucky.
