                I John D. Lay do make and publish this my last Will and Testament hereby revoking and making void all other Wills by me at anytime made.

1st        I direct that my funeral expenses and all my debts be paid as soon after death as posible out of any money that I may die possesed of or may first come into the hands of my Executor.

 2nd       I give and bequeath to my grandson John R Lay fifty acres of Land on the Whistle ridge including the field cleared by John Lay and when he is of age to have a horse, bridle and Saddle and Schooling to the rule of three paid out of my Estate

3rd       I give and bequeath to all my other heirs except John and James five Dollars in money.

4th        that One hundred acres of land lying part on the watters of the Elk fork and part on the waters of Gillico be sold and divided of by my heirs Equally.

5th        that all the debts owing to me at my death be disposed of by my wife as She pleases.

Lastly I do hereby nomiuate and appoint S.P. Douglap and George Davis my executors in witnes whereof I do to this my Will set my hand and seal this 1st day of March 1859.

{The last Will and Testament of
  John D. Lay of this County was produced here in open Court and the executors there of was acknowledged by the said John D

Lay with whom I am personally acquainted and that he was adjoudyed (?)

By the Court at the time of making said acknowledgement to be of sound

mind and disposing memory.
