September Term 1844

 

State of Tennessee, Benton County, September Term 1844

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in August it being the 2nd day of said Month in the year of our Lord one thousand eight hundred & forty four and 69th year of American Independence there being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson, George W. Farmer and Wyatt Arnold, B. Beard and Elijah Alsop.

The Clerk of this Court presented a settlement Made with J.A. Browning guardian of Jacob A Bomer which said settlement Made with J.A. Browning guardian of Jacob A Bomer which said settlement was examined & approved by the Court and ordered to be recorded.

On Motion it is ordered by the Court that James Cuff be appointed overseer of the road in room of John Arnold to work from Tennessee River by the way of E. Crows former residence to the 4 Mile tree and that the following hands work under said Cuff on said road ( viz. ) Willie Arnold, Josiah Arnold, James Melton, David Patterson, James Sykes, John Arnold, James Prince, Joseph Allison, Asbury Cuff, Wm. A.T. Cate, John Davis and all the hands in the bounds shall work under Cuff on said road which is established in the 1st Class.

The Clerk of this Court presented a settlement prorate of the Estate of Daniel Brewer deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court A. Lashlee administrator of the Estate of J.L. Williams deceased and returned an inventory & account of the sale of said estate & also a list of Notes and officers’ receipts and oath having been Made thereto it is ordered by the Court to be recorded.

September Term 1844.

Personally appeared in open Court William M. Malin and William Mothershed Administrator of the estate of William Malin deceased and returned an inventory and account of sale of said estate also a list of Notes accounts & cash found in the possession of the said deceased and oath having been Made thereto it is ordered by the Court to be recorded.

On Motion it is ordered by the Court that C.M. Sarrett be  appointed overseer of the stage road to work from Burnside Creek to the Town of Camden hands as follows – Daniel Holland, Benjamin Hardy, A.R. Carnes, Sam Bogal shall work under said Sarrett on said road which is established in the 1st Class.

Issued the 3rd of Sept. 1944.

On Motion it is ordered by the Court that R.N. Woods be appointed overseer of the stage road to work from Burnside Creek hands as follows; Benjamin Holland, William Farrow, Henry Durdin, J.K. Thomas, Samuel Crockett, Zepheniah Collins, James Madden, Alford Aden, Vincent Horn, Daniel Settles & Felix Reaves and all other hands in the bounds shall work under said Wood on said road which is established in the first class.

On Motion it is ordered by the Court that Charles H. Thompson be appointed overseer of the Perryville road to work from the Town of Camden to the Kirkman’s ferry road, hands as follows – Benjamin Thompson, Benson Turner, William Walker, Jackson Utley, Mattison Wiseman, Lemuel Thompson and William Thompson and all other hands in the bounds shall work under the said Charles H. Thompson on said road which is established in the 2nd Class.

September Term 1844.

Pleasant Mullinix and others who were appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of William Malin deceased one year Made report to this Court which is ordered by the Court to be recorded.

On Motion it is ordered by the Court that James Wyly be appointed overseer of the road in the room of James S. Sayles to work from Ross’s Ferry to Chalk Level and all the hands that formerly worked under James S. Sayles or in the bounds shall work under James Wyly on said road which is established in the 2nd Class.

Issued 3rd Sept.

On Motion it is ordered by the Court that Jefferson Hicks be appointed overseer of the road in room of William Swindle to work from Chalk Level to Darby’s old place and all the hands that formerly worked under said Swindle on said road except ( Geo. C. Swindle) or in the bounds shall now work under the said Hicks on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Charles J. Wheatley, Wm. W. Wheatley, Obediah Bullock, Jacob Cupp, Wherry C. Cole and Thomas Pully be appointed a jury of Review to view and Mark an alteration in the Mason’s Point road on the land of James Garner and Make report to the Next term of this Court.

On Motion it is ordered by the Court that James J. Farmer be allowed to turn the road at his house around the corner of his lot fence on the North side also around the corner of his new ground fence on the south side of said fence as far as his west boundary line.

On Motion it is ordered by the Court that Jesse Elmore be appointed overseer of the stage road to work from Lewis Cross’s to the Carroll County line and ll the hands that formerly worked under John M. Elmore or in the bounds shall now work under the said Jesse W. Elmore on said road which is established in the 1st Class.

September Term 1844 –

On Motion it is ordered that John McAuley be appointed overseer of the road to work from where the Lexington road crosses the Ross’s ferry road to the Carroll County line hands as follows; John Garrett, Stephen Garrett, Joseph Walker, Stephen Walker, Julius Cole, John Cole, Ivy Cole and all the other hands in the bounds shall work under the said McAuley on said road which is established in the 2nd Class.

Wilson M. Serrett one of the Jurors of Review who were appointed at a former term of this Court appeared in open Court and report that the road should run the new cutway and it is ordered by the Court that Charles M. Serrett be allowed to stop up his lane and that the new cut will be established a highway of this County.

On Motion it is ordered by the Court that Henry Stigall be appointed overseer of the road to work from the forks of the road at the head of the Race Track to Hezekiah Greer hands as follows; William Watson, John Presson, Wm. Presson, John T. Presson, A. Presson, William Armor, Oliver Armor, William Wiseman and all other hands in the bounds shall work under said Stigall on the said road which is established in the 1st Class.

A.C. Presson Sheriff and Collector of the public taxes for Benton County appeared in open Court and returned a list of taxable property and polls in the said County for the year 1843 and Made oath as prescribed by law in that case Made and provided that the same is insolvent and that he has been unable to collect the State and County taxes due thereon or any part thereof for said year 1843 which said report is as follows to wit;

Making  in all eighty two white polls and one slave valued at four hundred dollars, there being present on the bench the worshipfuls, Esqrs., D.P. Hudson, Geo. W. Farmer, Perkins Rushing, S.H. Davidson, Alsop Beard, Barnes Hammonds and Arnold being a Majority of all the Justices in Benton County and all the voting in the affirmative & have credit for said insolvencies and that the Clerk of this Court Make out and certify to the Comptroller of the State and County Trustee the amount os said insolvencies accordingly.

On Motion it is ordered by the Court that Thoomas Ward be appointed overseer of the road to work from Hezekiah Greer’s to Pearce’s Bridge on Sandy and that the following hands work under him ( viz) G.W. Rushing, John F. Presson, Jr., J.A. Greer, W.B. Eddington, David Nisler, Robt. L. Ward, R.D. Ward, W.D. Markham, Alf. D. Pearce, D.C. Rushing, John Pearce, Jr., James Black, J.K. Nance hands Joseph Barnes, William McGill, John Thornton, David McGill, James Crossno, Dickson Crossno, Jesse McGill, James Watson, Abel Rushing, Levin Rushing and James Rushing with all the hands in said

Issued  4th Sept,

On Motion ist is ordered by the Court that George Francisco, Jr. be appointed overseer of the road to work from Pearce’s Bridge to Henry County line and that all the hands west of Sandy rinver in Benton County subject to work on roads above the mouth of Bear Creek with James Webb work under the said Franscisco on said road which is established in the first Class.

Ephrain Perkins Entrytaker &c. having been Notified by W.A. Steele one of his securities appeared in open Court and together with him E.F. Wills, B. Herron, Nicholas Brewer, Wm. K. Perkins, Wm. K. McAuley, S.H. Davidson, James Presson, W.J. Greer and Robert H. Hawthorn his securities who appeared in open Court and acknowledged the due execution of following bond which in words and figures as follows (Viz.)
