Sept. Term 1843

Personally appeared in open Court R. W. Rowe executor of the Estate of William Walker deceased and returned an inventory of the property of said estate and oath having been Made thereto was ordered to be recorded.

Peter Phifer and others who appointed at the former term of this Court to lay off and set apart a years provision for the widow and family of John Nobles deceased report to this Court which was ordered by the Court to be recorded.

Thomas Jones and others who were appointed at a former term of this Court to lay off and set apart a years provisions for the widow and family of Hillary Capps deceased Made report to this Court which was ordered by the Court to be recorded.

On Motion it is ordered by the Court that James Harrison be appointed overseer of the road to work from Williams Malins on Eagle Creek to Thomas Osburns and all the hands living North & east of the old Eagle Creek road that runs from the Perry County line to Willis Beards thence on by Osburns to Birdsong and all the hands that formally worked under H. Crabb or in the bounds shall now work under the said James Harrison on said road which is established in the 2nd. Class.

On Motion it is ordered by the Court that McCaney Osburn be appointed overseer of the road to work from Thomas Osburns to Sycamore Creek and that all the hands south and west of the old Eagle Creek road that runs from the Perry County line to Willis Beards by Osburns thence to Birdson and all the hands that formally worked under H. Crabb or in the bounds shall now work under the said Osburn on said road which is established in the 2nd Class.

On Motion it is (unreadable words) James Merick and others who were appointed at a former term of this court a Jury of Review to view and mark out such alterations as they may think best for the public from Berry Williams to Flowers Mill on Birdsong Made the following report (viz.) we have met agreeable to the within order and agree that the road shall stand as it now is from Berry Williams to Williams Swindle and that

said road be so altered that it run thru said Swindles land where it did run formerly and to stand as it now does from there to Knowells and these to run on the other side of his lot and to run as it Now does to said Mill which said road and alterations is ordered by the Court to be established a public highway of this County.

On Motion it is ordered by the Court that Robert Prock be appointed overseer of the Perryville Road in room of M.C. Massey to work from the forks below the widow Matlocks to the Perry County line and that all the hands that formerly worked on said road or in the bounds shall now work under said Prock on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Johnathan J. Rushing be appointed overseer of the road in room of Asa D. Rushing to work from Rushings Creek Meeting house to the edge of Sandy bottom and all the hands that formerly worked under said A.D. Rushing and John Smally & the hands at his house and then down Rushings Creek on the south side all the hands that live in this County west of Sandy up the Mouth of Bare Creek shall work under said J.J. Rushing on said road which is established in the 1st Class.

On Motion it is ordered by the Court that Stark Moore be appointed overseer of the road in room of Green Flowers to work from the forks of the road at Nevins to Carroll County line and that the following hands work under said Moore on said road (viz.) Green Flowers & hands Eulissus Kirk, Archibald Kirk, Wiley Ellis, Peter Self Jr., Thos Curtis, Theophilus Kirk, Jesse Hall, John D. Nordin, Reddin Hollowell, Jerry Hale, Richard Evans, Martin Evans, Gillem Smothers and all the other hands in the bounds work under said Moore on said road which is Established in the 2nd Class.

Sept. Term 1843.

Edward Lindsey and others who were appointed at a former term of this Court to view and mark a road leading from Tennessee River at a point near where Lewis Heris lives and to intersect the road leading from Cottons old ferry to Wyatts Mill Made report to this Court.  It is therefore ordered by the Court that said road be established a public highway of this County.

Personally appeared in open Court Calvin Hall Administrator of the Estate of William and Henry Hall deceased and Made return of an inventory of said estates and oath having been made thereto it is ordered by the Court to be entered of record.

Personally appeared in open Court James Stepto one of the Administrators of Hillary Capps deceased and returned an inventory of the sale of the property of said estate and oath having been Made thereto it is ordered by the Court to be recorded.

William Lindsey and others who were appointed at a former term of this Court to view and Mark an alteration of a road and report to this Court (viz.) commencing at the upper end of James Lindsey field and running as the road now stands except that part near said Lindsay's will run on the opposite side of this house and the balance of said road to stand as formerly and it is ordered by the Court that said alterations be established a public highway of this County.

Personally appeared in open Court Berry W. Whitley and who Made oath according to law and together with John Melton and A.S. Hall his security appeared in open court entered into the acknowledged their bond in the sum of one hundred & forty dollars conditioned as the law direct, it is therefore ordered by the Court that he have letters of Administration on the estate of Starling Whitley to be made out in due form of law when required.

Sept. Term 1843

On Motion it is ordered by the Court that Lewis Heris be appointed overseer on the road leading from Tennessee river near said Hires so as to intersect the road leading from Cottons old ferry to Wyatt's Mill and it is ordered by the Court that said Hire & hands and William Hire and hands open and keep up said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Littleberry Williams be appointed overseer of the road to work from Cane Creek to big Cypress Creek and that the following hands shall work under said Williams on said road (viz.) Martin G. Ford, Briant C. Morgan, William Westerman & Kerneg Mitchell and all the hands in the bounds which is established in the 2nd Class.

On Motion it is ordered by the court that Thomas Swindle be appointed overseer of the road to work from the Natchez Trace road to Ammons branch and that the following hands work under said Swindle on said road (viz) Nathan Swindle, John Smith, N. And Isaac Smith work under said Swindle on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Cullen Nowell the appointed overseer of the road to work from Ammons branch to Flowers Mill and that the following hands work under said Nowell on said road (viz) John Smith Sr., Isaah Bright, Addison Nowell, Hiram Smith, John Baggett, Coleman Brewer, Alfred Harris and John Prince and all other hands in the bounds shall work under said Nowell on said road which is established in the 2nd Class.

Sept. Term 1843

On Motion and it appearing to the satisfaction of the Court that William Rushing an aged and infirm person of this County is in a condition which requires the Court to take cognition of his case for his support and Maintenance.  It is therefore ordered by the Court that the sheriff of this County take the said William Rushing into his charge and care and that he have him provided for until the next Term of this Court.  At which time he will have him before this court to be disposed of as the law in such cases provide.

On Motion it is ordered by the Court that John Arnold be appointed overseer of the road in room of William Holms to work from Tennessee River by the way of E. Crows former residence to the four mile tree and that the following hands shall work under said Arnold on said road (viz) Wyly Arnold, Josiah Arnold, James Melton, Davis Patterson, James Sykes, James Cuff, James Prince, Joseph Allison, Hiram Johnson, Asbury Cuff, Wm. A.T. Cate and John Davis and all other hands in the bounds shall work under said Arnold on said road which is established in the 1st Class.

On Motion of Laton P. Pearce it is ordered by the Court that a certain piece of road beginning at the forks of the road between John F. Johnsons and said Pearces and ending at the old Ross's ferry road be and the same is disannuled and the said Pearce shall for the future work the new cut way which is now established a public highway of the County.

Court then adjourned until Court in Course.
