November Term 1847

 

State of Tennessee, Benton County, November Term 1847

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the 1st Monday in November it being the 1st day of said Month in the year of our Lord One thousand eight hundred and forty seven and 72nd year of American Independence.  Their being present and presiding on the bench the worshipfuls, Esquires, to wit; Elijah Alsup, Nathan Williams and John W. Davidson.

On Motion it is ordered by the Court that Vincent Horn be appointed overseer of the stage road in room of Daniel Settles to work from Burnside Creek to Beaverdam Creek, hands as follows, B.N. Wood, Ben Holland, Wm. Farrow, Henry Durdin, Zepheriah Collins, Alfred Aden, Daniel L. Settles, W.L. Sarrett, Felix Reaves, Robertson Reaves and all other hands in the bounds shall work under said Vincent Horn on said road which is established in the first Class.

Issued Nov. 2nd.

Personally appeared in open Court Joel and Elisha Tedder, Admistrators of the Estate of James Tedder deceased and returned a list of Notes, Accounts &C. and also a sale bill of said Estate and oath being Made to the same it is ordered by the Court to be recorded.

On Motion of J.S. Peacock who Made oath according to law and together with him John C. McDaniel and Bird B. Barnett his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Three hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of Andrew K. McDaniel deceased to be Made out in due form of law when required.

The Court then proceeded to Make an appropriation to Thomas Jones one of the Commissioners of the Town of Camden for services rendered as such Commissioner and there being present and presiding on the bench Elijah Alsop,

November Term 1847

Nathan Williams, John W. Davidson, William Barnes, E. Perkins, Samuel H. Davidson, Jesse D. Hall, John C. McDaniel and George W. Farmer and all voting in the affirmative.  It is ordered by the Court that the said Jones be allowed and paid Thirty dollars for said services and that the Treasurer of said board of Commissioners pay the same out of any Money in his hands for public buildings Not otherwise appropriated.

Drew A. Askew and others who were appointed at a former term of this Court to view and Mark an alteration in the road from Drew A. Askew’s to Littleton B. Allen’s Made report to this Court which said report is received by the Court and said road established a highway of this County.

On Motion it is ordered by the Court that Jesse D. Hall be appointed overseer of the road to work from David A. Askew’s to where it intersects the road near Littleton B. Allen’s, hands as follows; B.P. Simmons, R.C. Mathis, B.F. Acres, Gideon Townsend and all other hands in the bounds shall work under said Hall on said road which is established in the 3rd Class.

David A. Askew and others who were appointed at a former term of this Court to view and Mark an alteration in the road leading from Wynn’s ferry road to Camden Made report to this Court which was received by the Court and said alteration established a highway of this County.

On Motion it is ordered by the Court that Daniel Askew be appointed overseer of the road to work from the Wynn’s ferry road to Wesley Daniels’, hands as follows; Drew A. Askew, William Daniel, Wesley Daniel, Asley Askew, Aaron Askew and all other hands in the bounds shall work under said David A. Askew on said road which is established in the 3rd Class.

November Term 1847.

On Motion it is ordered by the Court that Nathan Stagner be appointed overseer of the road to work from Wesley Daniel’s to the road leading from Lewis Hyer to Willis Rushing’s, hands as follows; B. Gross, Simeon Nicholas, Calvin Bomer, George Stagner, Wm. Lindsey, Wm. Waters, James Stagner and all other hands in the bounds shall work under said Nathan Stagner on said road which is established in the 3rd Class.

Issued Nov. 2nd.

On Motion it is ordered by the Court that James Sherly, Jonathan B. Cox and David W. Barnes be appointed Commissioners to lay off and set apart a sufficiency of provisions to serve the widow and family of James Wyatt deceased one year and to make report to the next term of this Court.

Issued Nov. 2nd.

On Motion it is ordered by the Court that Alfred Harris be appointed overseer of the road to work from Ammons’ Branch to Flowers’ Mill, hands as follows; John Prince, Hyram Smith, Isaiah Bright, James Taylor, Cullen Nowell, Addison Nowell, James Nowell, John Baggett, Henry Baggett, William Crabb, James Merrick, William Hogg and all other hands in the bounds shall work under said Harris on said road which is established in the 2nd Class.

Issued Nov. 2nd.

On Motion it is ordered by the Court that Ebbert Wiggle, Stephen W. Burn, Calvin Rushing, W.N. Shilling, William Barnes, Joseph Alsop and William Warmack be appointed a Jury of Review to View and Mark a road to lead from Elisha Herron’s to the bridge near Porter’s Mills and to Make report to the Next quarterly term of this Court of the advantages and disadvantages arising to the public and to individuals.

Issued Nov. 2nd.

The Clerk of this Court presented a settlement Made with Samuel B. Pearce administrator of the estate of John Morris deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with L.H. Pope guardian of Fannie Morris which said settlement was examined and approved by the Court and ordered to be recorded.

November Term 1847.

The Clerk of this Court presented a settlement Made with Wm. Sykes administrator of the estate of A.B. Sykes dec’d. which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Mary Barnett guardian of San Martin Barnett which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Hearty Hansel Administratrix of the estate of James Hansel deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court John Gossett guardian of the Minor heirs of James Malin deceased and together with him Pleasant Mullinix and John H. Williams his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Five hundred dollars conditioned as the law directs.

On Motion it is ordered by the Court that Reubin Bridges, Bennett Holland, Stephen Walker, John Garrett, Stephen Garrett, William Moore be appointed a jury of Review to view and Mark a new road beginning at or near Benjamin Holland’s and running the nearest and best way so as to intersect the Wills’ Ferry road at or near where the widow Walker now lives and to Make report to the next quarterly term of this Court of the advantages and disadvantages arising to the public and to individuals.

On Motion it is ordered by the Court that Willis Rushing, E.S. Hatchett, R.T. Rushing, N.G. Pate, E. Perkins, William Pafford and John Pafford be appointed a Jury of Review to View and Mark a road to lead from near where William Cates now lives thence running the nearest and most practical route to the Town of Camden and to Make report to the next quarterly term of this Court of the advantages and disadvantages arising to the public and to individuals.

November Term 1847.

On Motion it is ordered by the Court that James Sykes, John Petty and John Thornton from hence forward work under J.J. Durdin as hands on the road.

On Motion of John McGill Jr. who Made oath according to law and together with him A.C. Presson and John Presson his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of one hundred dollars conditioned as the law directs. Whereupon it is ordered by the Court that he have letters of Administration upon the estate of Mary Nisler deceased to be Made out in due form of law when required.

Court then adjourned until Court in Course.

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden of the first Monday in December it being the 6th day of said Month in the year of our Lord one thousand eight hundred and forty seven and the 72nd year of American Independence; there being present and presiding on the bench the worshipfuls, Esqrs. (to wit) Elijah Alsop, John W. Davidson and Nathan Williams.

Personally appeared in open Court Thomas Jones and produced a Commission from his Excellency, N.S. Brown, Governor of said State, Commissioning him a Justice of the Peace for the 5th Civil District of Benton County.  Whereupon the said Thomas Jones took an oath to support the Constitution of the United States and of the State of Tennessee, an oath against dueling and the oath of office.

One of the Commissioners who were appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of James Wyatt deceased Made report to this Court which was received by the Court and ordered to be recorded and that the executor procure the same accordingly.
