May Term 1846

 

State of Tennessee, Benton County, May Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in May.  It being the fourth day of said Month in the Year of our Lord one thousand eight hundred & forty six and 70th year of American Independence, there being present and presiding on the bench the worshipfuls, Esqrs,; (to wit) E. Perkins, Chairman, Johnathan K. Thomas and Nathan Williams.

The Clerk of this Court presented a settlement Made with Wm. R. Wynn, Administrator of the Estate of Bloomfield Grissam, Deceased, which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made by the Revenue Commissioners with Amos Bruce, Trustee of Benton County, which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Anderson Lashlee, Administrator of the estate of J.L. Williams, deceased, which said settlement was examined and Non concurred in by the Court until the vouchers are receipted over the proper names.

On Motion it is ordered by the Court that William Greer be appointed overseer of the road in room of John H. Williams to work from Lewis Cross’ to the 13 Mile Tree, hands as follows; John Watson, Samuel Presson, William Bonds, Freeman Presson, Wm. P. Thorington, Hudson Taylor, Joseph Pickler, Lewis Cross, John Davenport, William Stewart, J.H. Williams, Thomas Higdon, James Smith and Lewis Roswell, all other hands in the bounds shall work under said Greer on said road which is established in the 1st Class.

May Term 1846.

On Motion it is ordered by the Court that William McGill be appointed overseer of the road to work from Oliver Armor’s to H. Greer’s, hands as follows, A.C. Presson, Robert Ward. John T. Presson, Jr., James A. Greer, Geo. W. Rushing, Willis B. Eddington, David N. Nisler, John T. Presson, Sr., and all other hands in the bounds shall work under said McGill on said road which is established in the 2nd Class.

Issued May 5th.

 On Motion of Zecheriah Childers who Made oath according to law and together with him William J. Greer and Asbury McElyea his securities who appeared in open Court acknowledged the due execution of their bond in the penal sum of Six hundred dollars conditioned as the law directs.  It is therefore ordered by the Court that the said Zecheriah Childers have letters of Administration upon the estate of James Colier deceased to be Made out in due form of law when required.

On Motion it is ordered that Thomas Kee be appointed overseer of the road to work from Lilly Crocker to the Creek the other side of Samuel B. Pearce’s, hands as follows; Littlebury Pearce, Darling Pearce, Whitman Jordan, John House, F.W. Pearce, Ansil Pearce, James Holland and all other hands in the bounds shall work under said Kee on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Ulysses Kirk be appointed overseer of the work from the forks of the road at Nivin’s to Carroll County line, hands as follows; Green Flowers and hands, James Flowers, Archibald Kirk, Wilie Ellis, Peter Self, Jr., Thomas Curtis, Theophilis Kirk, Jesse Hale, John D. Norden, Redder Hollowell, Jeremiah Hale, Richard Evans, Martin Evans, Gillum Smothers and all other hands in the bounds shall work under said Ulysses Kirk on said road which is established in the 2nd Class.

On Motion of Joseph Wiseman, it is ordered by the Court that the said Wiseman be released from working on the stage road and that he be placed as a hand under Lemuel Thompson on the Perryville road.

May Term 1846.

On Motion of Irvin B. Carnes and it appearing to the satisfaction of the Court that there was a considerable amount of Notes, Accounts & etc. belonging to the estate of Edward Kaywood deceased left filed in the Clerk’s office of this County and reported doubtful by Samuel D. Strayhorn who was legally appointed Administrator of said estate and it appearing to the satisfaction of the Court that the said Irvin B. Carns holds claim against said estate due and that said Strayhorn has left this State and said claims unpaid.  It is therefore considered by the Court that the said Irvin B. Carns be allowed and granted a special administration upon said insolvent claims.  Whereupon came I.B. Carns into open Court and together with J.W. Utley, J.J. Wiseman, A.G. Holt and Cullen Nowell his securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of Five hundred dollars conditioned for his faithful performance as administrator as aforesaid.  Whereupon it is ordered by the Court that he have letters of administration upon said effects to be Made out in due form when required.

Personally appeared in open Court Anderson Lashlee, Administrator of the estate of James S, Sayles, deceased with the will annexed and returned a sale bill of the property of said estate and oath being Made to the same it is ordered by the Court to be recorded.

Court then adjourned until Court in Course.
