March Term 1844

 
State of Tennessee, Benton County, March Term 1844

At a County Court began and held for the County of Benton at the Court house in the Town of Camden on the first Monday in March it being the fourth day of said Month in the year of our Lord one thousand eight hundred & forty four and 68th year of American Independence. There being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson Chairman, Burrel Beard and Elijah Alsop, John D. Rushing David W. Benton.

George W. Farmer Esqr. Revenue Commissioner of the seventh Civil District, John Buchanan Revenue Commissioner of the 9th Civil District, William Barnes Revenue Commissioner of the 3rd Civil District, Wm. M. McAuley Revenue Commissioner of the 4th Civil District and Jesse Hammonds Revenue Commissioner of the 1st Civil District of said County severly appeared in open Court and returned a list of taxable property and Polls in their respective Districts for the year 1844 which was ordered by the Court to be recorded.

On motion it is ordered by the Court that Henry Nicoles be appointed overseer of the road in room of Jonathan J. Rushing to work from Rushing's Creek Meeting house to the edge of Sandy bottom and all the hands that formerly worked under the said Rushing shall Now work under the said Henry Nicoles on said road which is established in the 1st Class.

On Motion it is ordered by the Court that James Camp, Jesse Bruce, Jesse Hammonds, Burrell Beard, Larkin Tippett, James Walker, and John McElyan be appointed a jury of Review to view and Mark a public road form James Camps on the Camden road leading to Perryville to Wilson's ferry and that the said Jurors Make report to the next term of this Court.

The last will and testament of Shadrock Smith deceased was presented in open Court and proven by the oaths of Nathan Williams, Esqr. and Cullen Nowell subscribing witnesses to the same and ordered by the Court to be recorded.

March Term 1844

The Court then proceeded to appoint a jury to serve at the Next term of the Circuit Court to be held for the County of Benton at the Court house in the Town of Camden on the 2nd Monday in May Next and the following persons were appointed (viz)

1st District - Michael Fry, William Hubbs,
2nd District - John Baggett, James Camp and Richard Norden.
3rd District - Wimmiam Camp, John Barnes, Hiram Tittle.
4th District - Leonard H. Pope, William Moore, Joseph Cowell.
5th District - James Gordan, Jeremiah Akin, Jonathan C. Latimer.
6th District - Levin Cottingham, John Watson, Loranso D. Pearce.
7th District - Calvin Parker, John Phifer, Geo W. Farmer.
8th District - Henry Melton, William Cole, Delton Shilling.                                              9th District - William D. Hiro, William Wright, John Atchison, Constable and

that the Clerk of this Court issue a venire Facias, accordingly

Issued 5th March.

On Motion it is ordered by the Court that Whitman H. Rushing and Charles Williams be appointed to work on the road under Little Berry Williams in addition to his former hands.

On Motion of William R. Wynn who Made oath according to law and together with him Lewis Brewer Sr. his security who appeared in open Court and entered into and acknowledged their bond in the penal sum of two hundred dollars conditioned as the law directs. It is ordered by the Courty that the said William R. Wynn have letters of administration upon the estate of Broomfield Grissom deceased to the Made out in due form of law when required.

On Motion it is ordered by the Court that Alford Rushing be appointed overseer of the road in room of Robert Rushing to work from Rushing's Creek Meeting house to top of the ridge between Harmons Creek & Rushings Creed and that all the hands that formerly worked under said Robert Rushing shall now work under Alford Rushing on said road which is established 2nd class.

March Term 1844

Personally appeared in open court Zebabdee Howe, Cullen Nowell, James Cowell, A.R. Sykes, Robert S. Ward, Ichabod Farmer, Lewis W. Brewer and Jas. C. Melton, who severally appeared in open Court with their securities and entered into and acknowledged their several bonds in the penal sum of four thousand five hundred dollars each conditioned as the law directs whereupon they severally appeared in open Court and took an oath to support the Constitution of the United States & State of Tennessee and also an oath against dueling and also the oath of office.

Court adjourned until Court in Course.

D.P. Hudson, Elijah Alsup, Thomas L. Floyd, Jesse Hemmonds, J.G. Sims, Hezekiah Greer, William Barnes, Samuel H. Davidson, B. Beard, N. Williams, John D. Rushing, Geo. W. Farmer, John W. Davidson, David W. Benton, Wm. M. McAuley, J.R. Mathews.

Personally appeared in open court John Atchison and together with him W.P. Morris, J.G. Sims and Milton L. Travis his securities appeared in open Court and entered into and acknowledged their bond in the penal sum of four thousand five hundred dollars whereupon the said John Atchison appeared in open Court and took an oath to support the Constitution of the United Stated & State of Tennessee an oath against dueling and also the oath of office as Constable of the 5th Civil District of Benton County.
