State of Tennessee, Benton County Court, March term 1843

On Motion it is ordered by the Court that John B. Bridges be appointed overseer of the road in room of William Thorington and to work on the same road and on the part of the road formally worked by William Thorington and that the following hands work under said Bridges (To wit) John Presson, Harvy Presson, Marcilous Cain and John H. Williams, in addition to the former hands working under said Thorington and said road is Established in the 2nd Class.

Issued 13th March 1843.

On Motion it is ordered by the Court that James Lindsey be appointed overseer of the road in room of William Acres and all the hands that formerly worked under said Acres or in the bounds shall now work under said Lindsey on said road and said road is established in the 2nd Class.

On Motion it is ordered by the Court that Peter Fifer be appointed overseer of the Road in Room of Obediah Bullock and all the hands that formerly worked under said Obediah Bullock or in the bounds shall now work under said Peter Phifer on said road and said road is established in the 2nd Class.

Issued 13th March 1843.

On Motion it is ordered by the Court that Lewis Lashlee be appointed overseer of the Stage road in Room of William Sykes and all the hands that formerly worked under said Sykes or in the bounds shall now work under said Louis Lashlee on said road and said road is Established in the 1st Class.

Issued 13th March 1843.

It is ordered by the Court that F.S. petition presented by C.K. Wyly to this Court Make an Alteration of the road leading from Camden to Travis's Bridge on Sandy at or near the widow Thorington and round the premises of said Wyly's land and to intersect the old Road at some convenient point, it is therefore ordered by the Court that a Jury of Revenue be appointed to view and Mark said Alteration Jurors as follows (to wit) James Presson, Thomas Jones, Brown Bridges, James C. Wright, John H. Hudson and James G. Hudson and said Jurors Make Report to the next term of this Court.

March Term 1843

John W. Davidson Revenue Commissioner for Civil District No. 4 - produced in open Court a true list for said district for the year 1843 - And oath being Made to the same, it is therefore ordered by the Court to be Made of Record.

Jesse Hammons Revenue Commissioner for Civil District No.1 produced in open Court a true list for said district for the year 1843 and oath being Made to the same it is ordered by the Court to be entered of Record.

Hezekiah Greer Revenue Commissioner for Civil District No. 6 produced in open Court a true list for said district for the year 1843 and oath being Made to the same it is ordered by the Court to Entered of Record.

There was a Commission from his Excellency the Governor, James C. Jones, Commissioning Burrel Beard a Justice of the Peace for Benton County Also a commission for William A. Steele a Justice of the peace for said County both of which personally appeared in open Court and took an oath to support the Constitution of the United States and the State of Tennessee and an oath against duelling and also the oath of office and took their seats on the bench.

The Court then proceeded to Elect a Clerk to fill the remainder of the unexpired Term of George R. Kelsey removed and to that office did Elect William P. Morris whereupon the said William P. Morris together with E. Perkins, David Morris, Thomas Jones and Lewis Cottingham his securities, appeared in open Court and entered into and acknowledged their bonds in the sum of six thousand five hundred dollars which said bonds is in words and figures (to wit).

March Term 1843

Know all men by these presence that we W.P. Morris, E. Perkins, Thomas Jones, Lewis Cottingham and David Morris All of the County of Benton and State of Tennessee held and firmly bound unto his Excellency James C. Jones Governor of the State of Tennessee to the time being and his successors in office in the sum of five thousand dollars which payment well and truly to be Made we bind ourselves over and each our heirs, executors and Administrators, Jointly, severly and firmly by these presence given under our hands and seal this March 6th 1843.

The conditions of the above obligations are such that whereas the above bound W.P. Morris was this day elect for Constable and a probate clerk of the County Court of said County to fill the unexpired term of George R. Kelsey former Clerk Removed Now should the said J.P. Morris well and truly & faithfully keep all the records belonging to the County Court of said County which he is appointed Clerk of the County aforesaid and well truly and faithfully discharge all other duties as clerk of said Court during his continuance in office then the above obligation to be void otherwise to remain in full force and effect.

Jones Governor of the State of Tennessee to the time being and his successors in office in the sum of one thousand dollars which payment well and truly to be Made we bind ourselves our and each of our heirs, Executors and Administrators, jointly, severally and firmly by these presence sealed with our seals and dated this 6th March 1843.

The conditions of the above obligation are such that whereas the above bound J.P. Morris was this day duly elected Clerk of the County Court of Benton County to fill the unexpired term of George R. Kelsey former Clerk removed.  Now should the said W.P. Morris faithfully collect and pay over to the treasurer of the State all such tax and sums of money which may come into his hands by virtue of his office which may be due the State at the time of same

may be due then the above obligations to be void otherwise to be and to remain in full force and Effect.

The conditions of the above obligations are such that whereas the above bound W.P. Morris was this day elected Clerk of the County Court of Benton to fill the unexpired term of Geo. R. Kelsey former Clerk removed. Now should the said W.P. Morris faithfully collect and pay over to the Trustee all such Tax and sums of Money which May come into his hands by virtue of his office which May be due the County at the time the same May be due there this obligation to be void otherwise to remain in full force and Effect.

Whereupon the said W.P. Morris appeared in open Court and took an oath to support the Constitution of the United States and of State of Tennessee an oath to prohibit duelling and the oath of office accordingly.

Court then adjourned until tomorrow Morning 9 o'clock.

March Term 1843

On Motion it is ordered by the Court that Thomas Jones be appointed Guardian for his son Soloman Jones, a Minor, to take charge of the property willed to said Minor by Grandfather Soloman Jones, Deceased late of Humphreys County thereupon came the said Thomas Jones together with I.B. Carnes, Burrel Beard and Willis Beard his securities and entered into and acknowledged their bond in the sum of one thousand dollars conditioned as the law directs.

Martha Graham widow & relict of the late John B. Graham Deceased having applied in person at the last term of this Court for Commissioners to be appointed by this Court to lay off and set apart a sufficiency of provisions to serve her & her family one year, Agreeable to the Acts of the General Assembly in that case Made & provided and the Court not being advised whether or not the widow is allowed the property exempt from Execution and the years provisions, also the sum was continued on Advisement of the Court until the present Court.  And on Motion of E. Perkins, Esquire, the same taken into consideration by the Court and the vote thereon being taken whether commissioners be appointed to lay off said provisions, those who voted in the Affirmative are D.P. Hudson and Nathan Williams and those who voted in the Negative are Jesse Hammonds, Geo. W. Farmer, John D. Rushing, Hezekiah Greer, David W. Benton, William A. Steele, William Barnes, John W. Davidson, Samuel H. Davidson, J.R. Mathews, Wm. M. McAuley and Elijah Alsup & E. Perkins.

Whereupon it is ordered by the Court that A.J.B. Hudson be appointed to take charge of the court house that is that part of which is not occupied by the Clerks and that it shall be the duty of the said Hudson and he is required to see and cause the same to be kept clean and have a shutter put to the stairs, with a lock and key to the same.  And that he rent out the jury room for the best rent he can procure for that, that part of the

time they are not be occupied by jury and that the said house as aforesaid shall at all times be under the control & management of said Hudson when the Courts are not in session and the Court agrees to make said Hudson a reasonable allowance for his trouble in the said business and the said Hudson is Authorized and required to collect what money or other rents the jury rooms have been rented for heretofore and that he Make report to this Court of the Amounts which he may from time to time collect all rents aforesaid, subject to the disposition of the Court.

It is ordered by the Court that the branch which runs by James Presson and intersects Cane Creek Near Capps field be part of the south boundary line of the 5th Civil District so as to include Thomas Jones and his premises in said 5th Civil District.

Nathan Williams Esqr. Revenue Commissioner of the 2nd Civil District, D.P. Hudson, revenue Commissioner of the 5th Civil District, Thomas L. Floyd Revenue Commissioner of the 8th Civil District, Jesse D. Hall Revenue Commissioner of the 9th Civil District, severally Made return of lists of taxable property and fully in their districts, which were ordered by the Court to be recorded.

Court then Adjourned until Court in Course.

At a County Court began and held for the Court of Benton at the Court house in the Town of Camden on the first Monday in April it being the third day of said Month in the year of our Lord one thousand eight hundred & forty three and 67th year of American Independence there being present and presiding on the bench the worshipfuls Esqrs. (Viz.) E. Perkins, Chairman, D.P. Hudson, N. Williams, Thos. L. Floyd, Elijah Alsup, Hezekiah Greer, Geo. W. Farmer, Jesse Hammonds, S.E. Davidson, John D. Rushing, John W. Davidson, William Barnes, B. Beard, W.A. Steele, John Buchanan, Joseph Mathews.
