June Term 1845

 

State of Tennessee, Benton County, June Term 1845

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the 1st Monday in June.  It being the 2nd day of said Month in the year of Our Lord one thousand eight hundred & forty five & 69th year of American Independence, there being present and residing on the bench the worshipfuls Esqrs. D.P. Hudson, Chairman, H. Greer, Wyatt Arnold, J.W. Davidson, Geo. W. Farmer and E. Perkins.

E.G. Hatchett appeared in open Court and proved by his own oath that he had killed two wolves in the limits of Benton County and produced the scalps thereof to the Court which was adjudged by the Court to be over the age of four months which said scalps was ordered by the Court to be burned or otherwise destroyed by the Sheriff and it is further ordered by the Court that the Clerk of this Court certify the same as the law directs.

Issued June 2nd 1845.

On Motion it is ordered by the Court that John Thorington be appointed overseer of the road in room of Thomas Ward to work from Hezekiah Greer’s to Pearce’s Bridge, hands as follows; Johnathon J. Rushing, Thomas Presson, David Watson, David Watson, Jr., Isaac Watson, James Watson, Jesse McGill, David McGill, James Crossno, Allen D. Crossno, William Turner, John Pearce, Jr., Joseph J. Bane, Thomas Ward and all other hands in the bounds shall work under said Thorington on said road which is established in the 1st Class.

Issued June 3rd 1845.

Personally appeared in open Court, Wyatt Arnold, Justice of the peace in the 5th Civil District of Benton County and produced his resignation as such which was received and it is ordered by the Court that the Sheriff proceed forthwith to open and hold an election to fill said vacancy.

June Term 1845.

The Clerk of this Court presented a settlement made with Obidiah Bullock, Administrator of the estate of John Nobles deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with John Buchanan, Administrator of the estate of John B. Graham deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court John Melton who was this day chosen and appointed guardian of Susanah Hall, a Minor heir of Henry Hall deceased and together with him Sion Melton and Elias Phifer, his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sun of Seventy five dollars conditioned as the law directs.

Personally appeared in open Court Age Hall who was this day chosen and appointed guardian of Lary Hall and Henry Hall, Minor heirs of Henry Hall deceased and together with him Peter Phifer and Ichabod Farmer, his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of one hundred dollars conditioned as the law directs.

The Court then proceeded to appoint a Jury to serve at the Next term of Circuit Court to be held for the County of Benton, at the Courthouse in the Town of Camden on the second Monday in September Next.  Whereupon the following persons appointed (Viz.)

Rushing.        6th Dist.      W. R. Herrin, Paton G. Herrin, A.C. Presson.                                                 7th Dist.      Etheldred Melton, Pridden Melton, James Garner.                                          8th Dist.      Wm. H. Smally, James R. Childers, Daniel B. Herndon                                 9th Dist.      James McDaniel, John Wyatt,

Samuel Madden officer to attend upon said Court and that a venire facias issue accordingly.

June Term 1845.

On Motion it is ordered by the Court that the Clerk of this Court proceed to issue subpoenas to compel all executors, administrators and guardians who are behind in their settlements to appear at the Clerk's office in the Town of Camden before the July Term of the Court for the purpose of Making settlement as the law directs, also all guardians whose duty it is to renew their bonds to appear and renew their bonds at the next July Term, of this Courts.

On Motion it is ordered by the Court that John Hamilton be appointed overseer of the road to work from Darby's old place to Nivins hands as follows; James Nivins, J.W. Lewis, Henry Lewis, William Lewis, Hillsman King and hands and all other hands in the bounds, shall work under said Hamilton on said road which is established in the 2nd Glass.

Issued 3rd June 1845.

Court then adjourned until Court in Course.
