June Term 1844

 

State of Tennessee, Benton County, June Term 1844

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in June. It being the 3rd day of said Month in the year of our Lord Eighteen hundred & forty four there being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson, Elijah Alsup, and George W. Farmer.

The Clerk of this Court and sheriff of Benton County Revenue bonds having been examined and approved by the Judge of the Circuit Court of this County and ordered to be spread upon the Minutes of this Court with the Certificate thereto which are in words and figures following (viz.)

State of Tennessee

Know all Men by these presents that we David Brewer, Nicholas Brewer, J.W. Utley, Ephraim Perkins and Seth Utley, all of the County of Benton are held and firmly bound unto Dancy P. Hudson Chairman of the County Court of Benton County and his successors in office in the penal sum of fifteen hundred dollars the payment of which well and truly to be Made we bind ourselves, our heirs & Representatives jointly and severly firmly by these presents sealed with our Seals and dated this 16th day of May A.D. 1844.

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday of March in the year 1844 duly and lawfully elected Sheriff & Collector of the public and County Taxes in and for the County of Benton by the qualified voters thereof for the term of two years Next ensuing. Now if the said David Brewer shall well and truly collect all County Taxes and revenues within said County which by law he ought to collect and shall well and truly account for and pay over to the County Trustee of said County of Benton All County Taxes & revenue by him collected as should have been collected on or before the first day of December 1844. Then this obligation to be void & of no effect otherwise to remain in full force from the date above.

State of Tennessee, Benton County, May Circuit Court for said County A.D. 1844.

The Clerk of the County Court having returned here before the Judge of the aforesaid Court. The Sheriff bond of the aforesaid

County for the payment of County duty to the Trustee of said County, and the Judge of said County having disapproved the same thereupon came the said Sheriff and Collector David Brewer together with his securities J.W. Utley, Ephraim Perkins, Nicholas Brewer & Seth Utley before the said Judge and acknowledged the due execution of the foregoing bond and that the same is their act and deed and said bond was thereupon received & approved May 16th1844.

Jones, Governor of the State of Tennessee and his successors in office in the penal sum of Five hundred dollars the payment of which well and truly to be Made we bind ourselves, our heirs and Representatives, jointly & severly firmly by these presents sealed with our seals and dated the 16th day of May A.D. 1844.

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday of March in 1844, duly and lawfully elected Sheriff & Collector of the public Taxes in and for the County of Benton by the qualified voters thereof for the Terms of two years Next ensuing. Now if the said David Brewer shall well and truly collect all State Taxes and also all Taxes on school land within said County which by law he ought to collect and shall truly account for and pay over all Taxes by him collected or which ought to have been collected by him as such Sheriff & Collector as aforesaid on or before the first day of December in the year 1844 to the Treasurer of the State then this obligation to be Null and of no effect otherwise to remain in full force from the date above.

State of Tennessee, Benton County, May Term of the Circuit Court for said County A.D. 1844.

The Clerk of the County Court having returned here before the Judge of the aforesaid Court the bond of David Brewer Sheriff & Collector of said County, for the State revenue of said County for 1844. Taken in the County court and the said

Bond having been disapproved thereupon came the said David Brewer Sheriff & Collector together with his securities Nicholas Brewer, I.W. Utley, Ephraim Perkins & Seth Utley before the Judge of the aforesaid Court, All of whom entered into and acknowledged the due execution of the foregoing bond. And the same is their act and deed and said bond was thereupon received and approved May 16th 1844.

Know all men by these presents that we W.P. Morris, J.W. Utley, Jesse Hammonds, A.C. Presson, L.W. Brewer, D. Brewer, Daniel F. McElyea, Asbury McElyea, S.B. Pearce and Cullen Nowell, all of the County of Benton are held and firmly bound unto James C. Jones as Governor of the State of Tennessee and his successor in office in the penal sum of Five thousand dollars which payment well and truly to be Made we bind ourselves, our heirs and representatives jointly & severly firmly by these presents sealed with our seals and dated this 17th day of May A.D. 1844.

The condition of the above obligation is such that whereas the above bound Wm. P. Morris was on the first Saturday of March, A.D. 1844 duly and lawfully elected Clerk of the County Court of Benton County by the qualified voters of the said County for the Next ensuing four years.

Now if the said Wm. P. Morris shall faithfully collect and account for and pay over all Taxes and Revenue accruing to the State Treasury that shall or ought to come into his hands as Clerk of the County Court of Benton County to the Treasurer of the State of Tennessee at the time and in the manner the law directs then the said obligation to be void otherwise to remain in full force and virtue from the date above.

Pearce & Cullen Nowell his securities and entered into

and acknowledged the due execution of the foregoing bond before the Judge of the said Circuit Court and that the said bond is their act and deed and thereupon said bond was Received and approved May 17th, 1844.

Jones as Governor of the State of Tennessee and his successors in office in the penal sum of one thousand dollars for the payment of which well and truly to be Made we bind ourselves our heirs & representatives jointly and severly firmly by these presents Sealed with our seals and dated this 17th day of May A.D. 1844.

The condition of the above obligation is such that whereas the above bound Wm. P. Morris was on the first Saturday of March 1844 duly & lawfully elected Clerk of the County Court of Benton County by the qualified votes thereof for the Next Ensuing four years. If therefore the said Wm. P. Morris shall faithfully collect, account for and pay over to the Trustee of Benton County at the time and in the Manner the law directs all taxes revenue and sums of Money accruing or that may accrue to the said County by fines, forfeitures, Merchants' Licenses and for all their sums of revenue received by him as such clerk as aforesaid. And which by law he is bound to collect and pay over to the Trustee of said County then this obligation to be void otherwise to be & remain in full force from that date above.

The Clerk of the County Court of said County having returned here the County Court in April last and the said bond having been disapproved thereupon came the said Clerk of the County Court W.P. Morris together his securities J.W. Utley, Jesse Hammonds, A.C. Presson, L.W. Brewer, David Brewer, Daniel F. McElyea, Asbury McElyea, Samel C. Pearce & Cullen Nowell before the Judge of the aforesaid Circuit Court and entered into and acknowledged the execution of the foregoing bond and that the

same is their act and deed therefore the said bond is received and approved May 17th 1844.

Personally appeared in open Court J.G. Sims, Esqr., and tendered to the Court his resignation of Justice of the peace in the fifth Civil District of Benton County which was received by the Court and thereupon it is ordered by the Court that the Sheriff proceed forthwith to open and hold an election in the Town of Camden to fill said vacancy.

The Clerk of this court presented a settlement Made with John Buchanan, Administrator of the Estate of John B. Graham deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with A.J. Benton one of the administrators of the Estate of Wilis Norman Deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Nathan Williams Esqr. Administrator of the Estate of Dennis Messer, deceased Made report to this Court that there was no property to be administered on which said report was ordered by the Court to be recorded.

On Motion it is ordered by the Court that the Sheriff summons twelve freeholders of Benton County to examine the sanity or insanity of William Bridges and report to this Court immediately.

On Motion of Anderson Lashlee who Made oath according to law and together with him George W. Farmer his security appeared in open Court and entered into and acknowledged the due execution of their bond inthe penal sum of one thousand dollars whereupon it is ordered by the Court that the said Anderson Lashlee have letters of Administration upon the estate of J.L. Williams deceased to be Made out in due form of law when required.

June Term 1844

Personally appeared in open Court Samuel Madden and produced a certificate of his Election to the office of Constable of the fifth Civil District of Benton County and together with him Cullen Nowell, J.W. Utley, James Merick, H.C. Camp, Daniel F. McElyea, Joseph Wiseman, John Phifer and James E. Merick, his securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of four thousand dollars conditioned as the law directs
thereupon came the said Samuel Madden and took an oath to support the Constitution of the United States & the State of Tennessee an oath against dueling & also the oath of office.

Personally appeared in Court Cullen Nowell and together with him James Merick, H.C. Camp, A. Bruce, J.W. Utley, W.P. Morris, J.J. Cole, A.C. Presson and Samuel Madden his securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of four thousand dollars conditioned as the law directs of said Nowell having taken the oats prescribed by law at a former term of this Court.

Thomas Jones having been appointed at a former term of this Court, Trustee of Benton County According and Not having given bond and security as the law directs. It is ordered by the Court that the same be disannulled and for Nothing held and the Court then proceeded to fill the vacany occasioned by the removal of Dr. R.S. Collins & the death of Dr. J.L. Williams and for that purpose did appoint Dr. M.L. Travis & A. Hawkins Esqr. to appear in open Court and together with them W.P. Morris & J.W. Utley their securities who entered into and acknowledged the due execution of their bond in the penal sum of fifteen hundred dollars conditioned for the faithful discharge of their
duty as such Trustees.

Personally appeared in open Court one of the Jurors of Revenue who was appointed at a former term of this Court to view and Mark a public road from James Camp's to Wesson's ferry Made report to this Court which said report was rejected.

June Term 1844

On Motion it is ordered by the Court that Joseph Benton appointed overseer of the road in room of Henry C. Camp to work from Samuel Benton's to Davidson's ferry on Tennessee river and all the hands that worked under the said H.C. Camp or in the bounds shall Now work under the said Joseph Benton on said road which is established in the 2nd Class.

The court then proceeded to appoint a jury to serve at the Next term of the Circuit Court to be held for the County of Benton at the Courthouse in the town of Camden on the 2nd Monday of Sept. next and the following Gentlemen was appointed (viz)

1st Dist. William Johnson, Edward Hatley,
2nd Dist. Willie Ellis, Wm. Smith and John Robison
3rd Dist. Cullen Looper, Alberry Harris, Wesley J. Barnes
4th Dist. Julius J. Cole, John F. Johnson, Leyton P. Pearce.
5th Dist. Reuben D. Beasley, Littleberry Williams, Joseph Serratt.
6th Dist. John D. Rushing, Hezekiah Greer, Henry Allen
7th Dist. John W. Hill, D. W. Benton
8th Dist. William Holland, Hyram Pearce, Benjamin Brewer.
9th Dist. John McGloun, Arthur Pitt, Thomas Wynn, and Ichabod Farmer,

the constable to attend on said Court and that a venire facias issue accordingly.

Venire issued 6th June 1844.

Personally appeared in open Court Ichabod Farmer Constable of the 9th Civil District and together with him George W. Farmer his security who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of four thousand dollars conditioned as the law directs, said Farmer having heretofore taken the oaths prescribed by law at a former term of this Court.

Agreeable to an order Made at the present term of the Court ordering the Sheriff to summons a jury to examine the Sanity of William Bridges. Whereupon the Jury summoned by the Sheriff appeared in open Court and Made the following report (viz.) We believe agreeable to evidence that the said William Bridges is at times insane and the jury aforesaid not having reported that the said Bridges was possessed of any property. It is therefore considered by the Court that the report aforesaid is Not sufficient to place Bridges as a County charge or that the Court should appoint a guardian &c.

June Term 1844

Personally appeared in open Court Lilly Crocker and produced a certificate of his election to the office of Constable of the fourth Civil District of Benton County and together with him Thomas Jones, Samuel B. Pearce, L.H. Pope, Julius J. Cole, Irvin B. Carnes, Noah Strickland and W.P. Morris his securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of four thousand dollars conditioned as the law directs whereupon the said Lilly Crocker appeared in open Court and took an oath to support the Constitution of the United States & of the State of Tennessee an oath against dueling and the oath of office.

On Motion it is ordered by the court that Richard N. Wood be appointed overseer of the stage road in room of Zepheniah Collins to work from Burnside Creek to Beaverdam Creek hands as follows (viz.) Daniel Holland, Henry Durdin, J.B. Thomas, Benjamin Holland, Nelson Serrett, I. Inso, Charles Thompson, A.R. Carnes, James Madden, Charles W. Serrett, Zepheniah Collins, and all other hands in the bounds shall work under the said Wood on said road which is established in the 1st Class.

Court then adjourned until Court in Course.
