June Term 1843

 

State of Tennessee, Benton County, June Term 1843

At a County Court began and held for the County of Benton at the Court house in the Town of Camden on the first Monday in June it being the 5th day of said Month in the year of our Lord one thousand eight hundred & forty three and the 67th year of American Independence there being present and presiding on the bench the worshipfuls, Esquires E. Perkins, Chairman, D.P. Hudson and Nathan Williams.

It is ordered by the Court that the following persons be appointed to serve at the Next Circuit Court for Benton County to be held at the Court house in the town of Camden on the 2nd Monday in Sept. Next which is as Follows (viz)

1st District – Bird B. Barnett, John Beard.
2nd District – Burrel Beard, Nathan Williams and Evans Jordan
3rd District – John Anderson, Robert Hathhorn, Asa Swindle
4th District – Thos. Walker, Briant C. Morgan, Moses Jordan.
5th District – Wyly Arnold, Thos. McGill Sr., J.A. Browning
6th District – Benjamin Greer, John Pearce Jr., William Nance
7th District – James J. Farmer, Wesley Melton, Jacob Cupp.
8th District – Robert Rushing, Thos. L. Floyd, Kennith Reddick.
9th District – Edward Linsay, Elisha Jackson and Samuel Madden,

Constable to attend said Court and that a venire facias issued accordingly.

The Clerk of this Court presented to the Court a settlement Made by him with the County Trustee of Benton County showing the receipts & disbursements of the common school fund which was for the year 1843.  Examined and approved by the Court and ordered to be entered of Record.

The Clerk of this County presented to the Court a settlement Made by him with Ephraim Burchett guardian of the minor heirs of Cyrus Council Dec. which was examined & approved by the Court and ordered to be entered of Record.

June Term 1843

The Clerk of this court presented a settlement Made by the Revenue Commissioners of Benton County with the Trustee of said County which was examined and approved by the court and ordered to be entered of Record.

The Clerk of this Court presented a settlement Made by him with Sarah Hatley, guardian of the Minor heirs of Hardy Hatley, Decd., which was examined and approved by the Court and ordered to be entered of Record.

Personally appeared in open Court Ephraim Burchett guardian of the Minor heirs of Cyrus Council Decd., and together with him Malichaiah Harrison and David Burchett who entered into and acknowledged their bond in the penal sum of one hundred & thirty dollars conditioned as the law directs for the faith discharged of said guardianship.

Personally appeared in open Court Merrick S. Capps and James Stepta Administrator of the Estate of Hillary Capps Deceased and together with them Samuel H. Davidson and John W. Utley who entered into and acknowledged their bond in the penal sum of Eight hundred dollars conditioned as the law directs and oath being made thereto it is ordered by the Court that they have letters of Administration on said estate to be Made out in due form of law as required.

Personally appeared in open Court Amos Bruce who was this day appointed guardian of the Minor heirs of Burrel Lashlee deceased (viz) Wm. P. Lashlee, Temperance Lashlee, John T.B. Lashlee, Paton S. Lashlee, Birel Lashlee, James C. Lashlee and Sarah Lashlee and together with him Jesse Hammonds, Malton Merrick and Jeremiah Perry his securities who entered and acknowledged their bond in the penal sum of three thousand dollars conditioned as the law directs for the faithful performance of said guardianship.

June Term 1843

Personally appeared in open Court J.P. Simms who took an oath to support the constitution of the United States & also the State of Tennessee and to acquaint himself as an honorable Member of the bar it is therefore ordered by the Court that he be admitted as a Member of the bar at this Court.

On Motion it is ordered by the Court that I.B. Carnes be appointed overseer of the road to work from Burnside Creek to the Creek near Thos. Jones and that the following hands shall work under the said I.B. Carnes (viz.) A. Lashlee & hands, Samuel Kelsey, C.K. Wyly & hands, Benjamin Hardy, Joseph Wiseman, Andrew S. Cole, Cade A. Crawly, James Hall, Hugh M. Brown, David McElyea, Asbury McElyea, Alvin Hawkins, M.L. Travis, E.T. Carroll, W.P. Morris and all the hands within the bounds shall work under said Carnes on said road which is Established in the 1st Class.

Issued 6th June

On Motion it is ordered by the court that Zepheniah Collins be appointed overseer of the Stage Road in room of David Holland to work from Burnside Creek to Beever dam Creek and the following hands shall work under said Collins on said road (viz) Daniel Holland, Henry Durden, J.R. Thomas, Benjamin Holland, Nelson Serrett, I. Insca, Whitmon Rushing, Willis Thompson, Charley Thompson, Adam Carnes, Elisha Jackson, Mary Serrett’s hands James Madden, C.M. Serrett and all other hands in the bounds work under said Collins on said road which is established in the 1st Class.

On Motion it is ordered by the court that R.C. Petty be appointed overseer of the road to work from the river at Esquire Wills’ to the stage road and that the following hands shall work under said Petty on said road (viz) William Farrow, W.R. Aden, Albert Aden, Green Poe, James Russell, William Cole, Stephen Boswell, J.M. Petty, E.F. Wills & hands and all other hands in the bounds work under Petty on said road is Established in the 2nd Class.

June Term 1843

Personally appeared in open Court Calvin Hall who was this day appointed Administrator of the Estate of Henry Hall and William Hall deceased and together with him Obediah Bullock, Thos. W. Petty and Charley J. Wheatly who entered into and acknowledged their bond in the penal sum of two hundred dollars conditioned as the law directs it is therefore ordered by the Court that he have letters of Administration on said Estates to be Made out in due form of law when required.

On Motion and it appearing to the satisfaction of the Court that Shadrick Cox, Catherine Cox, Nancy Feriby Cox, Children of Hiram Cox deceased are being raised in a manner that is becoming for white children, it is therefore ordered by the Court that the Sheriff have before this Court at the next term to the said children to be bound out as the law directs and that the Clerk of this Court certify the same to the Sheriff.

State of Tennessee vs. Peter Phifer

This day D.W. Benton and acting Justice of the peace in and for the County of Benton returned into Court the papers and documents relative to the case of bastardy on the body of Jincy Garner, and it appearing to the satisfaction of the Court that the affidavit Made in this case was taken before the expiration of thirty days it is therefore considered by the Court that this Cause be hence dismissed.

Personally appeared in open Court Joel Rushing guardian of the Minor heirs of Abel Rushing deceased and together with Jackson Rushing and John W. Utley, his securities and entered into and acknowledged their bond in the penal sum of two thousand dollars conditioned as the law directs for the faithful performance of said guardianship.

June Term 1843
State of Tennessee, Bastardy, Use of Jancy Garner vs Peter Phifer

This day came the parties aforesaid by attos, and the plaintiff by attos Moves the Court for a new hearing in this Cause and for reasons appearing to the satisfaction of the Court It is considered by the Court that a new trail be granted in this Cause, and that the same be continued until the next term of this Court, And thereupon the said defendant together John Melton, his security appeared in open Court and acknowledged themselves to owe and be indebted unto the State of Tennessee in the sum of two hundred fifty dollars each to be levied of their goods and chattels, lands and tenements for the use of the State to be void on condition that the said Deft. do Make his personal appearance before this Court at their Next term to be held for the County of Benton at the Court house in the Town of Camden on the first Monday in July Next then and there to answer the State of Tennessee of said charge of bastardy and not depart thence without leave of the Court.

Court then Adjourned until Court in Course.
