July Term 1844

At a County Court begun and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in July it being the first day of said Month in the year of our Lord eighteen hundred & forty four and 68 year of American Independence there being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson, George W. Farmer, Elijah Alsop, Hezekiah Greer, S.H. Davidson, J.R. Mathews, David W. Benton, Nathan Williams, John D. Rushing, William Barnes, Wm. McAuley, Jesse Hammonds, E. Perkins.

The Clerk of this Court presented a settlement Made with Jesse Hammonds, Executor of the last will & Testament of the estate of Nancy Harrison dec. which said settlement was examined approved and ordered to be recorded.

The Clerk of this Court presented a settlement Made with William Warmack Administrator of the Estate of Isaac Wyatt dec. which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Hoel Rushing guardian of the Minor heirs of Abel Rushing deceased (viz.) Jermina and Sarah Rushing which said settlement was examined & approved and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Ephraim Burchett guardian of the Minor heirs of Cyrus Council deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court John D, Rushing guardian of Sytha Ann Murray, Minor heir of Jefferson Murray deceased and together with him Levin Cottingham and Hezikiah Greer his securities who appeared in open Court & entered into and acknowledged their bond in the sum of three hundred & fifty dollars conditioned as the law directs.

July Term 1844

Personally appeared in open Court Presley Thornton guardian of Eliza Ann Harrison a Minor heir of Nancy Harrison deceased and together with him James M. Camp and Jesse Hammonds his securities who appeared in open court and entered into and acknowledged the due execution of their bond in the sum of one thousand dollars conditioned as the law directs.

Personally appeared in open Court Sarah Hatley guardian of the Minor heirs of Hardy Hatley deceased and together with her Henry C. Camp and Jonathan B. Cox her securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of five hundred dollars conditioned as the law directs.

On Motion of William J. Greer who Made oath according to law and together with him John D. Rushing and John Wynn his securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of two hundred dollars conditioned as the law directs whereupon it is ordered by the Court that William J. Greer have letters of Administration upon the Estate of Jose C. Melton to be Made out in due form of law where required.

On Motion of John M. Petty and it appearing to the satisfaction of the Court by affidavit filed that the said Petty should have an appropriation of two dollars & 42 cents in consequence of his having sustained by a loss of his cow having been posted by James S. Sayles whereupon it is ordered by the Court that the said John M. Petty be allowed & paid the above named sum of two dollars & 42 cents and that the Trustee of Benton County pay the same out of any Money in the Treasury for general County purposes Not otherwise appropriated.

On Motion of E. Perkins Esqr. for an appropriation to him for a fee paid S.C. Pavott as attorney in the case of the Commissioners of the Town of Camden against James M. Camp executor of George Camp deceased and a Motion being Made to postpone the said appropriation and not to Make it at present those who voted for the postponement of the said appropriation are Esqrs. D.P. Hudson, William Barnes, John D. Rushing, Hezekiah Greer, George W. Farmer, and David W. Benton, 6 And those who voted for Making the appropriation at present are Esqrs. J.R. Mathews, Nathan Williams, S.H. Davidson, Wm. M. Mc Auley and Elijah Alsop.  It is therefore ordered by the Court that the said appropriation be postponed.

On Motion it is ordered by the Court that the Sheriff of Benton County proceed forthwith to open and hold an election in the Ninth Civil District of Benton County for the purpose of electing a Constable in said District to fill the vacancy occasioned by the death of Jose B. Melton, deceased.

Issued July 4th 1844.

Personally appeared in open Court Jacob A. Browning, guardian of Jacob A Bomar a Minor and together with him David Morris and Josiah T. Florence his securities appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of Nine hundred dollars conditioned as the law directs.

Personally appeared in open Court M.C. Barnett guardian of James Harrison and together with him Bird B. Barnett his security who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of fourteen hundred dollars conditioned as the law directs.

Personally appeared in open Court, Mary Barnett guardian of Eliza and Sam Martin Barnett and together with her Bird B. Barnett her security who appeared in open Court and entered into and acknowledged their bond in the penal sum of fifteen hundred dollars conditioned as the law directs.

July Term 1844

Personally appeared in open Court William Greer and presented a certificate of his election to the office of Constable in the 6th Civil District of Benton County and together with him Hezekiah Greer, Bejamin Greer, John Presson, A.C. Presson, John W. Utley, Wm. D. Wiseman and E.W. Lynch his securities who appeared in open Court and entered into and acknowledged their bond in the penal sum of Four thousand dollars conditioned as the law directs whereupon the said William Greer appeared in open Court and took an oath to support the Constitution of the United States & of the State of Tennessee an oath against dueling and also the oath of office.

Personally appeared in open Court James K. Nance guardian of the Minor heirs of John D. Neber deceased and together with Thomas Jones and William Rowe his securities who appeared in open Court and entered into and acknowledged their bond in the penal sum of Eleven hundred dollars conditioned as the law directs.

On Motion it is ordered by the Court that David Morris, Willis ushing and David W. Benton be appointed commissioners to lay off and set apart a year’s provisions for the widow and family of George Bell deceased and to Make report to the Next term of this Court.

Issued July 4th 1844.

The Revenue Commissioners reported to Court a settlement Made with the Trustee of Benton County which said settlement was entered and approved by the Court and ordered by the Court to be recorded.

On Motion and it appearing to the Court that William Blanks and John Blanks children of Joseph Blanks, aged the first ten years - & the other aged seven years, were ill-treated, were being raised up in a manner unbecoming of white persons, and the said Joseph Blanks appeared in open Court and consented that his said children should be bound unto Isaih F. Cate whereupon the said Court ordered that the said children (viz) William Blanks and John Blanks should be bound unto the said Isaiah F. Cate

until they arrive at the age of twenty one years, and the said Isiah F. Cate appeared in open Court and entered into an indenture with the Chairman of this Court as the law directs and agrees to teach the said children the arty and mystery of a Farmer and teach them to read and write and arithmetic so fas as to understand the rule of three, and when they arrive at full age to give each of them a good suit of Jeans clothes and a good horse, saddle and bridle with Wyatt Arnold and William Sykes his security &C.

The Clerk of this Court presented a settlement Made with Thomas Jones guardian of Solomon Jones a Minor which said settlement was examined and appeared by the Court and ordered to be recorded.
