State of Tennessee, Benton County, January Term 1847

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in January, it being the 4th day of said Month in the year of our Lord One thousand eight hundred & forty seven and 71st year of American Independence, there being present and presiding on the bench the worshipfuls, Esqrs. (to wit) E. Perkins, J.K. Thomas, Jesse D. Holt, D.P. Hudson, Eligah Alsop, George W. Farmer, John W. Davidson, David W. Benton, Nathan Williams, J.D. Rushing, William Barnes.

The Clerk of this Court presented a settlement Made with Mary Barnett, guardian of Sam Martin Barnett which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with John F. Johnson guardian of the Minor heirs of Wm. B. Griffis deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Amos and Jesse Bruce administrators of the estate of James Bruce deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Daniel and R.M. Graham, Administrator of the estate of John Graham deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement with Robert Rushing guardian of Nancy Ann Bomer which said settlement was examined and approved by the Court and ordered to be recorded.

On Motion it is ordered by the Court that William Armor be appointed overseer of the road in room of Henry Stegall to work from the head of the Race Tracks to Oliver Armor’s, hands as follows; Henry Stegall, Franklin Armor, Robert Armor, Wm. H. Presson, John Presson, Marcellus Cain and George Armor shall work under said Armor on said road which is established in the 2nd Class.

January Term 1847.

This day appeared in open Court John M. Williams the attorney in fact of Hugh M. Brown and W.C. Prewett and Made application for letters of administration upon the estate of Thomas C. Brown, deceased in favor of the said Hugh M. Brown who entered into bond and security as the law directs.  It is ordered by the Court that the letters of Administration be detained until said Brown appeared in open Court and takes the oath prescribed by law.

On Motion of Cade A. Crawley who Made oath according to law and together with him S.C. Pavatt his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of One hundred & fifty dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of administration upon the estate of Joseph Taylor deceased to be Made out in due form of law when required.

The Court then proceeded to elect a Chairman to preside over the deliberations of the Court for the present year.  Whereupon Eligah Alsop is duly elected said presiding officer.

The Court then proceeded to elect a quorum to hold the quorum Courts for the present year.  Whereupon the following Justices were elected (to wit) Eligah Alsop, John W. Davidson and Nathan Williams were duly elected said quorum.

The Court then proceeded to elect Revenue Commissioners to settle with the Clerks and Trustee of Benton County.  Whereupon Nathan Williams and George W. Farmer were duly elected said Revenue Commissioners. 

Personally appeared in open Court Lewis Lashlee who produced a certificated of Benton County and together with him William Sykes, W.F. Prevatt, Joseph Sarrell, Wm. C. Holmes, Thomas Jones, Irvin B. Carns and A. Lashlee his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Four thousand dollars conditioned as the law directs.  Whereupon the said Lewis Lashlee took an oath to support the Constitution of the United States and the State of Tennessee, an oath against dueling and the oath of office.

January Term 1847.

The last will and testament of Jesse Barnes deceased was produced in open Court and the due execution thereof proven by the oaths of William Hatley and John Barnes subscribing witnesses to the same which was ordered by the Court to be recorded.  Whereupon Mary Barnes appeared in open Court and signified her dissent to said Will and prayed for letters of Administration to be granted to her with the will annexed which was granted by the Court.  Whereupon the said Mary Barnes appeared in open Court and together with her John Barnes, William Barnes, Samuel Dancer and William Hatley her securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two thousand dollars conditioned as the law directs.  Whereupon it is ordered by the Court she have letter of administration upon the estate of Jesse Barnes deceased with the will annexed to be made out in due form of law when required.

The Court then proceeded to levy a tax on all taxable property and polls in Benton County for the year 1847 and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative, it is therefore ordered by the Court that the following tax be levied and collected (to wit) for the payments of County contingencies on each $100 worth of property 7˝ cents, on each white poll 12˝ cents.  And on each Merchant’s and grocery license $5.00 and on each Stallion or Jack for Mares the season’s price of one Mare.  For the payment of Jurors on each $100.00 worth of property 7˝ cents and on each white poll 12˝ cents and for the payment of paupers on each $100.00 worth of property 7˝ cents and on each white poll 12˝ cents and for the building of a Jail on each $100.00 worth of property 7˝ cents and on each white poll 50 cents.

On Motion of Wm. D. Hyer it is ordered by the Court that he have the privilege of establishing a Ferry on Tennessee River at Mason’s Point.  Whereupon said Wm. D. Hyer appeared in open Court and together with him Edmond Brewer and David Brewer his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two thousand dollars conditioned as the law directs.

January Term 1847

On Motion it is ordered by the Court that Robert Pettigrew be appointed overseer of the road in room of James M. Camp to work from Flowers’ Mill to Perry County line and all the hands that formerly worked under said Camp or in the bounds whall work under said Pettigrew on said road which is established in the 2nd Class.

Personally appeared in open Court R.W. Rowe executor of the last will and testament of William Walker Deceased and returned a sale bill of the property of said estate and oath being Made to the same it is ordered by the Court to be recorded.

The Court then went into the election of a Ranger for the County of Benton for the Next ensuing two years and there being present and presiding on the bench a Majority of all the Justices in Benton County and upon counting the votes it appears that James Alston is duly elected said Ranger.  Whereupon said James Alston appeared in open Court and together with him John H. Williams and Wm. C. Holmed his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Five hundred dollars conditioned as the law directs.

David Brewer Sheriff & Collector of the public Taxes of the County of Benton appeared in open Court and returned a list of Taxable property & polls in said County for the year 1846.  And oath having been Made to the same prescribed by law that the same is insolvent and that he has been unable to collect the State and County taxes due severally thereon or any part thereof for the said year 1846 and which said report is as follows; (to wit)

Making in all 49 white polls and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is Ordered by the Court that the Sheriff and Collector as aforesaid have a credit for said insolvencies and the Clerk of this Court certify the part belonging to the State to the Comptroller of the Treasury and the part belonging to the County to the Trustee accordingly.

The Court then went into an election of a tax Collector to collect the public and County taxes of the County of Benton for the year 1847 and there being present and presiding on the bench a Majority of all the Justices in Benton County and after voting by ballot it appears that Roland Rushing is duly and lawfully elected tax Collector for Benton County for the present year.

The Court then proceeded to Make an appropriation to the Justices who held the quorum Courts for the year 1846.  And there being present and presiding on the bench a majority of all the Justices in Benton County and all voting in the affirmative, it is ordered by the Court that said Justices be allowed the sum of 75 cents each per day for each day so served and that the Trustee pay the same out of any money in the Treasury for general County purposes not otherwise appropriated.

The Court then Made an appropriation to Geo. W. Farmer and Nathan Williams Revenue Commissioners for Making settlement with the Trustee for the year 1846.  And there being present and presiding on the bench a majority of all the Justices in Benton County and all voting in the affirmative.  It is ordered by the Court that the said Geo. W. Farmer and Nathan Williams be allowed & paid the sum of Two dollars each for said services and that the Trustee pay the same out of any Money in the Treasury for general County purposes not otherwise appropriated.

January Term 1847.

One of the Jurors of Review who were appointed at a former term of this Court to view and Mark an alteration in the Mason’s Point road Made report to this Court which said report was received by Court and said alteration established a highway of this County.

On Motion it is ordered by the Court that Riley Pearce be appointed overseer of the Mason Point road to work from Porter’s Mill to the 4 Mile post, hands as follows; Wm. J. Greer, Neil McNeil, Josiah Hobson, Wm. L. McKenzie, Gilbert McKenzie, Thomas Colier, F.R. Campbell, John Pearce and all other hands in the bounds shall work under said Wm. R. Pearce on said road which is established in the 2nd Class.

Issued Jan. 8th.

On Motion it is ordered by the Court, there being present and presiding on the bench a Majority of all the Justices in Benton County that the following persons be appointed a Jury of Review (to wit) Zecheriah Barker, Littlebury Williams, Littlebury Pearce, Samuel B. Pearce, Charles Williams, B.C. Morgan and Charles Cowell to view and Mark an alteration in the road leading from Paris to Reynoldsburg beginning at the forks of the road at the foot of the hill at the Davidson old field near Cypress Creek to the new road cut out by Wm. C. Holmes where it intersects the old Paris road and to Make report to the April Term of this Court of the advantages and disadvantages arising to the public and to individuals.

Issued January 8th.

Court then adjourned until Tuesday Morning 9 o’clock.

Court met according to adjournment.  Present and presiding the worshipfuls, Esqrs. Eligah Alsop, Nathan Williams and John W. Davidson.

On Motion it is ordered by the Court that Wm. D. Hyer be appointed overseer of the Mason’s Point road to work from the 4 mile tree to Tennessee river, hands as follows; All hands at Point Mason, Thomas J. Snider, Hugh B. Snider and Jenkins shall work under said Hyer on said road which is established in the 2nd Class.

Issued Jan. 8th.
