February Term 1847

 

State of Tennessee, Benton County, February Term 1847

At a County Court began and held for the Town of Camden on the first Monday in February, it being the first day of said Month in the year of our Lord One thousand eight hundred & forty seven and 71st year of American Independence, their being present and presiding on the bench the worshipfuls, Esqrs, (to wit) Elijah Alsop, Nathan Williams and John W. Davidson.

The Clerk of this Court presented a settlement Made with John Melton guardian of Susannah Hall which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement pro rata Made with A.W.C. Matheny Administrator of the estate of James Daniel deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Court then proceeded to appoint a jury to serve at the next Circuit Court to be held for the County of Benton at the Courthouse in the Town of Camden of the 2nd Monday in May next.  Whereupon the following persons were appointed (viz.)

2nd Dist.            D.M. Burkett, James M. Camp and John Baggett
3rd Dist.            James Sherly, Wm. H. Camp and George Thomason
4th Dist.            Julius Cole, John McAuley
5th Dist.            G.W.L. Hudson, Johnathan R. Thomas and Willis Rushing
6th Dist.            John D. Rushing, John H. Williams and Thomas Ward
7th Dist.            James Garner, James J. Farmer and Perry Melton
8th Dist.            Hugh Alsop, Alexander McRae and John Pearce.
9th Dist.            Loflin Beaton, Neal McNeal and Drew A. Askew

All good and lawful men of said County of Benton and Lewis Lashlee, officer to attend said Court and that the Clerk of this Court issue a venire facias accordingly.

Personally appeared in open Court J.A. Jordan one of the executors of the last will and testament of Herbert Haynes deceased and returned an inventory and account of sale of the property of said estate and oath being Made to the same it is ordered by the Court to be recorded.

February Term 1847.

On Motion it is ordered by the Court that William H. Camp be appointed overseer of the road in room of Moses Taylor to work from the Kirkman’s ferry road to Birdsong, hands as follows; Alfred Burn, William Burn, Reubin Mitchell, Calvin Marksbanks, Kinchen Taylor, Samuel H. Davidson and all hands in the bounds shall work under said Camp on said road which is established in the 2nd Class.

Issued Feby. 4th.

On Motion it is ordered by the Court that Middleton Thomason be appointed overseer of the Huntingdon road to work from where said road crosses the Lexington road to Chalk Level, hands as follows; Hinton A. Mitchell, Henry Roswell, Washington Adams, Samuel Crockett, Meredith Edwards and all other hands in the bounds shall work under said Thomason on said road which is established in the 2nd Class.

Issued Feb. 4th.

On Motion it is ordered by the Court that William Hogg be appointed overseer of the road in room of Hillary Lewis to work from Ammond’s Branch to Flower’s Mill, hands as follows; John Smith, Isaiah Bright, Addison Nowell, Hyram Smith, C. Nowell, Alfred Harris, John Baggett and all other hands in the bounds shall work under said William Hogg on said road which is established in the 2nd Class.

Issued Feb. 4th.

Personally appeared in open Court William Barnes, Administrator of the estate of James Wyatt deceased and Made return of a sale bill of the property and effects of said estate and oath being Made to the same it is Ordered by the Court to be recorded.

Mary Barnes who appeared at a former term of this Court and signified he dissent to thte will of her husband Jesse Barnes, deceased, appeared in open Court and withdrew her dissent to said will and prayed the Court to rescind their former order Admitting said dissent and also that she may be released from all liability upon her bond, it is therefore considered by the Court that said order be rescinded and that William Barnes the executor Mentioned in said will enter into bond and securities as the law directs.  Whereupon the said William Barnes appeared in open Court and together with him Mary Barnes, Wesley J. Barnes, Isaac Anderson, Davis W. Barnes, A.C. Presson and E.P. Bellowe his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two thousand dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters testamentary upon the estate of Jesse Barnes deceased.

February Term 1847.

to be Made out in due form of law when required.

On Motion it is ordered by the Court that Charles Oatsvall be appointed overseer in room of William Hatley to work from James Sherley’s to Haltley’s Branch, hands as follows; Edward Hatley, Green Hatley, William Hatley, Franklin Smith, Stanford Hatley, Edward Hatley, Sr., Harvey Dancer, James E. Dancer and all other hands in the bounds shall work under said Oatsvall on said road which is established in the 2nd Class.

Issued Feby. 4th.

Upon petition of J.W.P. Lewis and R.H. Hawthorn securities of John Gossett guardian of the Minor heirs of James Malin deceased praying to be released from further liability upon their bond as said security.  It is ordered by the Court that the Clerk of this Court issue a summons commanding said John Gossett guardian as aforesaid to appear at the next term of this Court and give other and sufficient security otherwise the Court will proceed as directed by law.

Court then adjourned until Court in Course.
