February Term 1846

 

State of Tennessee, Benton County, February Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in February, it being the 2nd day of said Month in the year of our Lord one thousand eight hundred & forty six and 70th year of American Independence, their being present & presiding on the bench the worshipfuls, Esqrs, to wit, E. Perkins, Chairman, J.K. Thomas and David W. Benton and Nathan Williams.

The Clerk of this Court presented sundry settlements Make with Executors, Administrators and Guardians which are as follows to wit; With R.C. and John M. Petty, Executors of the last will and testament of Thomas Petty deceased, Charles E. Thompson one of the Administrators of the estate of Wiggins Collier deceased; Michael Fry Administrator of the estate Joseph Fry dec., Robert Rushing guardian of Sarah Ann Bomer; James K. Nance, guardian of the Minor heirs of John D. Nebin deceased; John F. Johnston, guardian of the Minor heirs of Wm. B. Griffis deceased, M.C. Barnett, guardian of James Harrison, Amos Bruce and Wilson M. Sarrett, Administrator of the estate of Mary Sarrett, deceased.  All of which were examined and approved by the Court and ordered to be recorded.

In obedience to an Act of the General Assembly entitled an act to license Tipling houses and requiring the Clerk of the County Courts to enter into bond with security for the faithful accounting for and paying over the Revenue Collected off of Tipling houses, W.P. Morris appeared in open Court and together with him Amos Bruce his security who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of One thousand dollars conditioned as the law directs.

One of the Jurors of Review who were appointed at a former term of this Court to view and Mark an alteration in the road to lead from Benjamin Acers’ on Lick Creek to Hampton’s ford on Sandy River Made report to this Court which was received and said road was established a highway of this County.

February Term 1846

On Motion it is ordered by the Court that Mathew Mannon be appointed overseer of the road to work from Benjamin Akers to Hampton’s ford on Sandy, hands as follows; William Mizell, David Dorch, John West, Henry Cooper, and all other hands North of these bounds shall work under said Mannon on said road which is established in the 2nd Class.

Issued Feby. 3rd.

On Motion it is ordered by the Court that Allen T. Corbitt be appointed overseer of the road to work from the forks of the road at the corner of A. Lashlee’s fence to John M. Browning’s, hands as follows; J.T. Florence, Wm. K. Perkins, John Higdon, Wm. A. Steel, Benjamin Redden, E. Perkins, hands, A.J.B. Hudson, J.W. Hudson and all other hands in the bounds shall work under said Corbitt on said road which is established in the 2nd Class.

Issued Feby. 3rd.

On Motion of Anderson Lashlee who Made oath according to law and together with him Zechariah Barker his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Five hundred dollars conditioned as the law directs.  It is therefore ordered by the Court that the said Lashlee have letters of Administration upon the estate of Jane Sayles deceased to be Made out in due form of law when required, and the said Lashlee together with Zecheriah Barker his security who appeared in open Court and acknowledged due execution of their bond in the penal sum of Six thousand dollars, Conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of James S. Sayles, dec. unadministered on the by Jane Sayles executrix of James S. Sayles deceased with the will annexed to be Made out in due form of law when required.

On Motion it is ordered by the Court that Allen Williams be appointed overseer of the road to work from Cane Creek to big Cypress Creek, hands as follows, Kerny C. Mitchell, Mastin G. Ford, Bryant C. Morgan, Littlebury Williams, Whitman H. Rushing shall work under said Allen Williams on said road which is established in the 2nd Class.

February Term 1846.

One of the Jurors of Review who were appointed at a former term of this Court to view and Mark an alteration in the road leading from Willis Rushing’s so as to intersect the Wyatt’s Mill road near Jesse Raspberry’s Made report to this Court which was received and it is ordered by the Court that said alteration be established a public highway of this County.

On Motion it is ordered by the Court that Allen Stiers be appointed overseer of the road to work from where the Lexington road crosses the Huntingdon road to Chalk Level, hands as follows; Middleton Thomason, Thomas Kee, Mark Hatly, Hinton H. Mitchell, Lewis Hollmark, John Mothershead and all other hands in the bounds shall work under said Stiers on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Evans Jordan be appointed Revenue Commissioner in the 1st Civil District of Benton County for the purposes of taking a list of taxable property and polls in said district for the year 1846, in place of Thos. R. Jett, who were formerly appointed, said Jett having failed and refused to discharge the duty of Revenue Commissioner aforesaid.

On Motion it is ordered by the Court that Ezekiel Tippett, James White and Charles Duncan be appointed Commissioners to lay off and set apart a sufficiency of provisions to serve the widow and family of Henry D. Walker, deceased one year and to Make report to the Next term of this Court.

On Motion of William Wesson who Made oath according to law and together with him James Walker and John R. Smith his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars, conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of Henry D. Walker deceased to be Made out in due form of law when required.

February Term 1846

On Motion of John McGill and James Crossno who Made oath according to law and together with them John McGill and William McGill their security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Four hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that they have letters of administration upon the estate of Henry Nisler deceased to be made out in due form of law when required.

The Court then proceeded to appoint a jury to serve at the next term of the Circuit Court to be held for the County of Benton at the Courthouse in the Town of Camden on the second Monday in May Next.  Whereupon the followsing persons were appointed to wit

latter officer to attend said Court and that a venire Facias issued accordingly.

On Motion of Robert Jones who Made oath according to law and together with him William Warmack and L.W. Brewer his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Four hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of administration upon the estate of Isom Jones dec. to be Made out in due form of law when required.

On Motion it is ordered by the Court that William Barnes be appointed overseer of the road to work from the Creek to the Camden road leading to Wyatt’s Mill, hands as follows; David Alsop, John Ragsdale, Haggard Bird, D.N. Shilling, Zechariah Childers and all other hands in the bounds shall work under said Barnes on said road which is established in the 2nd Class.

February Term 1846

On Motion it is ordered by the Court that A.C. Presson, Thomas Ward and Robert Ward be appointed Commissioners to lay off and set apart a sufficiency of provisions to serve the widow and family of Henry Nisler, deceased one year and to Make report at the Next term of this Court.

On Motion it is ordered by the Court that James Cowell be appointed overseer of the road to work from the 2 Mile tree to the 13 Mile tree, hands as follows; Lewis Roswell, Henry Roswell, William Presson, John Davenport, William Wiseman, Joseph Cowell, Jr., Mathew Presson and all other hands in the bounds shall work under said Cowell on said road which is established in the 1st Class.

Issued Feby. 3rd.

On Motion it is ordered by the Court that Lewis Brewer, William Warmack and John G. Allen be appointed Commissioners to lay off and set apart a sufficiency of provisions to serve the widow and family of Isom Jones deceased and to Make report at the Next term of this Court.

Issued Feby. 4th.

On Motion it is ordered by the Court that John W. Dudley be appointed overseer of the road in room of Alfred Rushing to work the same piece of road that said Alfred Rushing worked and all the hands that formerly worked under said Alfred Rushing or in the bounds shall now work under said Dudley on said road which is established in the 2nd Class.
