December Term 1847.

Personally appeared in open Court Charles G. Haynes and J.A. Jordan executors of the last will and testatment of Hubert Haynes deceased and returned a sale bill of the property of said estate and oath having been Made to the same it is ordered by the Court to be recorded.

Personally appeared in open Court Alexander McRae Administrator of the Estate of Benjamin Brewer deceased and returned a sale bill of the property of said estate and oath being Made to the same it is ordered by the Court to be recorded.

One of the Commissioners who were appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of Benjamin Brewer deceased one year, Made report to this Court, it is ordered to be recorded.

Personally appeared in open Court John D. Rushing who was this day appointed guardian of the Minor heirs of Elisha Jackson deceased and together with him David Brewer and Jesse D. Hall his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of One thousand dollars conditioned as the law directs.

On Motion it is ordered by the Court that Abraham Sanders be appointed overseer of the road to work from Carroll County line to Natchez Trace, hands as follows; S. Romley, John Sanders, Elijah Melton, Dempsey Sanders and all other hands in the bounds shall work under said Abram Sanders on said road which is established in the 2nd Class.

Issued Dec. 8th.

On Motion it is ordered by the Court that John Russell be appointed overseer of the stage road to work from the Town of Camden to Burnside Creek, hands as follows; Daniel Holland, A.R. Carnes, C.M. Sarrett, W.C. Prewitt, A.T. Routin, Harvey Lowther, Wm. A. Steele, John Higdon and all others hands in the bounds shall work under said Russell on said road which is established in the 1st Class.

December Term 1847.

On Motion it is ordered by the Court that Wiley Arnold be appointed overseer of the stage road to work from Beaverdam Creek to the forks of the road opposite to Wm. C. Horn’s, hands as follows; Daniel Settles, hands B.C. Settles, James Sykes, Lewis Lashlee, Wm. P. Lashlee, Wm. Durdin, Thomas Durdin, Peyton S. Lashlee, Nelson Sarrett, Hyram Johnson, J.A. Frederick, J.J. Durdin and all other hands in the bounds shall work under said Wiley Arnold on said road which is established in the 1st Class.

Issued Dec. 8th.

The Clerk of this Court presented a settlement Made with Lewis Lashlee, Administrator of the estate of Mary Lashlee deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Thomas King guardian of John Morris which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with John Gossett guardian of the Minor heirs of James Malin deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Whereas it appears to the Court here that Roland Rushing late tax Collector of Benton County for the year 1847 having become in some degree deranged in Mind and wholly unqualified in the opinion of this Court to proceed with the Collection of said taxes and moreover it appears that he obstinately refuses to attempt a further collection of said taxes;

And whereas it further appears that there is a considerable portion of the taxes due for said year 1847 and that John D. Rushing, Levin Cottingham and others are the securities of the said Roland Rushing.  It is therefore ordered by the Court that in consideration of the above facts that the said John D. Rushing one of the securities of said Roland Rushing be and he is hereby authorized and informed to make full and complete collections of the remnant of taxes which now remains uncollected upon the book of the Collector in as full and complete a manner as the said Roland Rushing could himself and

to make full and complete settlements with the Trustee of Benton County and the Treasurer of the State accordingly.

The Court then proceeded to appoint Revenue Commissioners to take a list of taxable property and polls in Bento County for the year 1848, who are as follows (to wit);

1st Dist.            John C. McDaniel
2nd Dist.            David M. Burkett
3rd Dist.            Samuel H. Davidson
4th Dist.            Wm. M. McAuley
5th Dist.            Jonathan K. Thomas
6th Dist.            J.D. Rushing
7th Dist.            David W. Benton
8th Dist.            Elijah Alsop
9th Dist.            John Buchanan

And they proceeded to take said list as the law directs.

Personally appeared in open Court Charles G. Haynes and J.A. Jordan executors of the last will and testament of Hubit Haynes and together with them Amos Bruce, Francis Baber and Griffin Dodd their securities who appeared in open Court and acknowledged the due execution as the law directs.

On Motion of Levin Cottingham it is ordered by the Court that Nathan Williams and George W. Farmer proceed on the 24th of this instant to Make settlement with the Commissioners of the Town of Camden touching their receipts and disbursements of Money for the building of Jail for the use of Benton County.

On Motion it is ordered by the Court that Daniel Lightner be appointed overseer of the road to work from where it leaves the Wynn’s Ferry road at or near the Baptist Meeting house on Lick Creek to Henry County line, hands as follows; Moses Mahew, Mathew McDaniel, Wilie Shores, Thomas Gofford and all other hands in the bounds shall work under said Lightner on said road which is established in the 2nd Class.

Issued Dec. 9th.

 One of the Jurors of Review who were appointed at a former term of this Court to view and Mark a road beginning at or near Wm Cates and running the nearest and best way to the Town of Camden Made report to this Court which was received.  (New Justices called upon the bench for the purpose, one voting in the Negative) and said road as laid off is hereby established a highway of this County.

Personally appeared in open Court Sarah Young who was this day appointed guardian of the Minor heirs of Elisha Young deceased and together with her James McDaniel and A.C. Presson her securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of One thousand dollars conditioned as the law directs.

Court then adjourned until Court in Course.

State of Tennessee, Benton County, January Term 1848

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in January, it being the third day of said Month in the year of our Lord one thousand eight hundred and forty eight, there being present and presiding on the bench, the worshipfuls, Esqrs. (to wit); Elijah Alsop, Geo. W. Farmer, Nathan Williams, John D. Rushing, Sterling Brewer, Hezekiah Greer, Thomas Jones, John C. McDaniel, J.R. Thomas, William Barnes, Jesse D. Hall, Samuel Davidson, John Buchanan, Wm. M. McAuley, Evans Jordan, E. Perkins, John W. Davidson and David Burkett.

Personally appeared in open Court Samuel Oxford guardian of the Minor heirs of Joshua Curtis, deceased and together with him James Hogg his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Forty Dollars conditioned as the law directs.

Personally appeared in open Court one of the Commissioners who was appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of A.K. McDaniel deceased one year and made report to this Court which was received and ordered by the Court to be recorded.
