December Term 1846

 

State of Tennessee, Benton County, December Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in December, it being the 7th day of said Month in the year of our Lord One thousand eight hundred & forty six and 71st year of American Independence, there being present and presiding on the bench the worshipfuls, Esqrs. (to wit) E. Perkins, J.K. Thomas and Nathan Williams.

Issued Dec. 9th.

On Motion it is ordered by the Court that Wm. J. Greer be appointed overseer of the road leading from Wyatt’s Mill to Point Mason and to work from the Bridge to Nancy McKenzie’s hands as follows; Henry Melton, R.M. Graham, Neil McNeil, Thomas Colier, W.L. McKenzie, Malcom McKenzie, Gilbert McKenzie, T.R. Campbell, Josiah Hobson, Hyram Pearce and all other hands in the bounds shall work under said Greer on said road which is established in the 2nd Class.

Issued Dec. 9th.

On Motion it is ordered by the Court that Noah Wyatt be appointed overseer of the road to work from Andrews’ Ferry to the Slough Bridge in Sandy bottom, hands as follows; Elisha Jackson, William Akers, Robert Jackson, Burrel Wynn, Wm. R. Wynn, James Lindsey, Wm. Lindsey, Wm. Waters, Joseph Weatherly, James Stagner, Nathan Stagner, Uriah Stagner, George Stagner, West Daniel, J. Myrick, B. Allen, B. Gross, A.W.C. Metheny, Lawson Nichols, Green Nichols, Simeon Nichols, Wm. Metheny, Perry Mathis and all other hands in the bounds shall work under said Wyatt on said road which is established in the 2nd Class.

Issued Dec. 9th.

On Motion it is ordered by the Court that Moses Taylor be appointed overseer of the road to work from the Kirkman’s Ferry road to Birdsong, hands as follows; Alfred Burn, William Burn, Beubin Mitchell, Calvin Marchbanks, Kinchen Taylor, Samuel H. Davidson, Jr.  All other hands in the bounds shall work under said Moses Taylor on said road which is established in the 2nd Class.

December Term 1846.

On Motion it is ordered by the Court that Benjamin Thompson be appointed overseer of the road to work from the Town of Camden to Abel Utley’s, hands as follows; All hands that formerly worked under Charles H. Thompson or in the bounds with A.J. Utley shall now work under Benjamin Thompson on said road which is established in the 2nd Class.

Issued Dec. 7th.

The Court then proceeded to appoint Revenue Commissioners to take a list of taxable property and polls in Benton County for the year 1847; Whereupon the following persons were appointed (to wit)

2nd Dist.            Nathan Williams
3rd Dist.            Samuel H. Davidson
4th Dist.            John W. Davidson
5th Dist.            D.P. Hudson
6th Dist.            H. Greer
7th Dist.            Geo. W. Farmer
8th Dist.            Sterling Brewer
9th Dist.            Jesse D. Hall

On Motion it is ordered by the Court that Young Adams be appointed overseer of the road to work from Thomas Osburn to Cypress Creek and all the hands south and west of the Old Eagle Creek road that runs from the Perry County line to Willis Beard’s by Osburn’s thence to Birdsong and all the hands that formerly worked under Eli Hatley or in the bounds shall now work under said Young Adams on said road which is established in the 2nd Class.

One of the Jurors of Review who was appointed at a former term of this Court to view and Make an alteration in the Paris road Made report to the Next term of this Court and that they recommend the new way as cut out by Wm. C. Holmes to be the nearest and best way.  Whereupon it is ordered by the Court that said report be adopted and said alteration be established as a highway of this County.

One of the Jurors of Review who were appointed at a former term of this Court to view and Mark a road leading from the Town of Camden to Travis’ Bridge on Sandy Made report to this Court as follows; that said road shall begin at Thomas Jones and run the ridge between Cane Creek and the branch that T.A. Presson lives on, thence on by John H. Williams to Carroll County line which said report is adopted and said road established as a highway of this County.

December Term 1846.

On Motion it is ordered by the Court that Samuel Presson be appointed overseer of the road to work from John H. Williams just to open out the road at Travis’ Mill to Carroll County line and all the hands with one mile of said road shall work under said Samuel Presson on said road which is established in the 2nd Class.

Issued Dec. 10th.

The last will and testament of Herbert Haynes deceased was produced in open Court and the due execution thereof proven by the oaths of Green Flowers and Evans Jordan who are subscribing witnesses to the same.  Whereupon J.A. Jordan and Charles P. Hayes, the executors therein Mentioned appeared in open Court and together with them Redden Holloway, Francis Baber, D. Brewer and J.R. Mathews their securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Three thousand dollars conditioned as the law directs.  Whereupon it is ordered by the Court that they have letters to be made out under form of law when required.

On Motion of J.M. Basford who Made oath according to law and together with him Pleasant Mullinix and J.S. Harper his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of James Basford deceased to be Made out in due form of law when required.

On Motion of Allen C. Presson who Made oath according to law and together with him William Barnes his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of One hundred & fifty dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of administration upon the estate of Mary Cottingham deceased to be made out in due form of law when required.

December Term 1846
State of Tennessee, Benton County

Be it known that at a County Court of Monthly sessions held at the Courthouse in the Town of Camden in and for the County aforesaid on the first Monday in December 1846 and being the 7th day of said Month satisfactory evidence was adduced in open Court to prove and disprove to the satisfaction of said Court that John Sarrett was a petitioner of the United States at the rate of $40.00 per annum and that the said John Sarrett died in said County on the 7th of September 1834 and at the time of his death left a widow, Mary Sarrett, who survived him until 19th day of October 1843 – at which time she also died in said County of Benton, leaving the following named children (to wit); Elizabeth Browning formerly Elizabeth Sarrett, Joseph Sarrett, Wilson M. Sarrett, Parthena Sarrett, Attilla Bruce, formerly Attilla Sarrett, Eliza Stephenson, formerly Eliza Sarrett, Lewis Lashlee, Administrator of Mary Lashlee, formerly Mary Sarrett, Charles M. Sarrett and Mahold Sarrett who are the only heirs at law and legal representatives of the said Mary Sarrett deceased and that Amos Bruce and Wilson M. Sarrett are the administrators of the said Mary Sarrett deceased with the will of John Sarrett deceased annexed.

The last will and testament of James Wyatt deceased was this day produced in open Court and the due execution thereof proven by the oath of Allen C. Presson one of the subscribing witnesses thereunto annexed and it is ordered by the Court that said will be over to be proven by the other witnesses at the next term of this Court and upon satisfactory evidence being adduced before the Court that the executrix therein Named is unable and unqualified to discharge the duties of executrix as the law directs.  It is therefore considered by the Court that William Barnes take upon himself the administration of said estate.  Whereupon the said William Barnes appeared in open Court and together with him Thomas Swindle, Noah Wyatt and William Wyatt his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Three hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of James Wyatt deceased to be Made out in due form of law when required.

December Term 1846.

Personally appeared in open Court Josiah T. Florence who was this day chosen and appointed guardian of Arena Reddick, A Minor and together with him Wm. P. Lashlee, William Sullens, David Morris and Thomas Jones his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Four hundred dollars conditioned as the law directs.

On Motion it is ordered by the Court that D. Brewer, Lewis Brewer, Sr., Edward Brewer, Lewis Holland, Calvin B. Reddick, Edward Lindsey and John Pearce be appointed a jury of Review to view and Mark an alteration in the road leading from Porter’s Mill to Point Mason leaving the old road at Hopson’s and turn to the right at John Pearce’s and intersecting the old road at Snider’s old place and that they make report to the next term of this Court of the advantages and disadvantages arising to the public and to individuals.

Issued Dec. 10th.

On Motion it is ordered by the Court that Morgan McDaniel be appointed overseer of the road to work from where it leaves the Wynn Ferry road at or near the Baptist Meeting house on Lick Creek to Henry County line, hands as follows; David Lightner, Moses Mahew, Mathew McDaniel, Willis Shores, Thomas Gofford, Charles Robbins and all other hands in the bounds shall work under said McDaniel on said road which is established in the 2nd Class.

Issued Dec. 10th.

On Motion it is ordered by the Court that Wm. F.T. Bloodworth be appointed overseer of the Paris road to work from the old Rushing Creek Meeting house to the Turn Pike and all the hands that formerly worked under James Greer on said road or in the bounds shall now work under said Bloodworth which is established in the 2nd Class.
